NRA Going All In For Gorsuch

The NRA-ILA reacted very quickly to the nomination of Judge Neil Gorsuch to be the next Associate Justice of the Supreme Court. They released a statement within minutes as well as this graphic which was placed on Instagram.

NRA Applauds Neil Gorsuch’s Nomination to the U.S. Supreme Court

Fairfax, Va.— The National Rifle Association (NRA) applauds the nomination of Judge Neil Gorsuch to fill Justice Antonin Scalia’s seat on the United States Supreme Court.

“President Trump has made an outstanding choice in nominating Judge Gorsuch for the U.S. Supreme Court. He has an impressive record that demonstrates his support for the Second Amendment,” said Chris W. Cox, executive director, NRA-ILA. “We urge the Senate to swiftly confirm Judge Gorsuch to the Supreme Court, just as it did in confirming him to the U.S. Court of Appeals for the Tenth Circuit by a unanimous voice vote.”

During his tenure on the Tenth Circuit, Gorsuch has demonstrated his belief that the Constitution should be applied as the framers intended. To that end, he has supported the individual right to self-defense. Specifically, he wrote in an opinion that “the Second Amendment protects an individual’s right to own firearms and may not be infringed lightly.”

“On behalf of our five million members, the NRA strongly supports Judge Neil Gorsuch’s confirmation to the U.S. Supreme Court. We will be activating our members and tens of millions of supporters throughout the country in support of Judge Gorsuch. He will protect our right to keep and bear arms and is an outstanding choice to fill Justice Scalia’s seat,” concluded Cox.

We will need the NRA going all in for Judge Gorsuch as the battle lines were being drawn in minutes. The NY Times had an editorial out within minutes calling it a “stolen seat” and Merrick Garland “better qualified”. I’m sorry but mere tenure on the bench does not make you a better judge or better legal mind. It only means you are older.

New SSA Regulation May Be Overturned

The recently adopted Social Security Administration regulation that would report some seniors and disability recipients as mentally deficient to the NICS system will come under review by Congress. That regulation deemed that anyone who required a trustee or custodian to manage their monies to be mentally deficient. The NRA reports that Congress will now review this regulation under the Congressional Review Act with the aim to overturn it.

This is good news and I would hope that they review the similar policy or regulation at the Department of Veterans Affairs.

Cox, executive director, NRA-ILA. “The NRA has been fighting this unconstitutional government overreach since it was first discussed and we look forward to swift congressional action.”

Last year, the Social Security Administration finalized a proposed rule to ban certain recipients who use a representative payee from owning firearms. This ill-conceived action affected the most vulnerable in America and stripped them of their right to keep and bear arms without due process.

The NRA immediately opposed the Obama administration’s efforts when the proposal was first announced in summer of 2015. The NRA has fought every step of the way to ensure that social security recipients are not stripped of their rights without due process of law.

Today, we learned that Congress will review the Obama administration’s unconstitutional ban under the Congressional Review Act (CRA). CRA allows Congress to dispose of any actions an outgoing administration initiates in its last six months. This final rule falls under that time frame, and the review process is expected to move forward in the House and receive a vote as early as next week.

Imminent revocation of this egregious government action marks the culmination of the NRA’s diligent efforts on behalf of its members and law-abiding gun owners.

“This is a new era for freedom-loving Americans and the NRA is excited to begin work with our pro-Second Amendment president and Congress to ensure that law-abiding Americans’ constitutional rights are respected,” concluded Cox.

NRA And NSSF Praise Introduction Of HR 38

The National Rifle Association and the National Shooting Sports Foundation have issued releases praising the introduction of HR 38 – Concealed Carry Reciprocity Act of 2017.

Fairfax, Va. – On behalf of its five-million members, the National Rifle Association’s Institute for Legislative Action (NRA-ILA) applauded the introduction of H.R. 38, The Concealed Carry Reciprocity Act of 2017, authored by Congressman Richard Hudson (NC-8). This legislation would eliminate the confusing patchwork of state carry laws by allowing individuals who possess concealed carry permits from their home state or who are not prohibited from carrying concealed in their home state to exercise those rights in any other state that does not prohibit concealed carry.

“The current patchwork of state and local laws is confusing for even the most conscientious and well-informed concealed carry permit holders. This confusion often leads to law-abiding gun owners running afoul of the law when they exercise their right to self-protection while traveling or temporarily living away from home,” said Chris W. Cox, executive director of the NRA-ILA. “Congressman Hudson’s legislation provides a much needed solution to a real problem for law-abiding gun owners.”

This legislation would not override state laws governing the time, place or manner of carriage or establish national standards for concealed carry. Individual state gun laws would still be respected. If under federal law a person is prohibited from carrying a firearm, they will continue to be prohibited from doing so under this bill.

“Law-abiding citizens should be able to exercise their fundamental right to self-defense while traveling across state lines,” continued Cox. “This is an extremely important issue to our members and we thank Congressman Hudson for leading the fight to protect our rights,” concluded Cox.

U.S. Rep. Hudson Introduces NSSF-Backed
National Concealed Carry Reciprocity Bill

NEWTOWN, Conn.-U.S. Rep. Richard Hudson (R-NC) introduced the NSSF-supported Concealed Carry Reciprocity Act of 2017 (H.R. 38) on the first day of the 115th Congress. The proposed legislation, with 63 co-sponsors, would compel states to recognize concealed carry permits issued from other states that have concealed carry laws within their own borders – much in the same way a driver’s license is recognized. The bill aims to eliminate the confusion of varying state-by-state laws and provide protection for Second Amendment rights for permit holders.

“Our Second Amendment right doesn’t disappear when we cross state lines, and this legislation guarantees that,” Hudson said. “The Concealed Carry Reciprocity Act of 2017 is a common sense solution to a problem too many Americans face. It will provide law-abiding citizens the right to conceal carry and travel freely between states without worrying about conflicting state codes or onerous civil suits.”

In addition to interstate recognition of concealed carry permits, the bill would also allow concealed carry in the National Park System, National Wildlife Refuge System, and on lands administered by the Bureau of Land Management, Army Corps of Engineers and Bureau of Reclamation, as well as provide greater legal protections in both civil and criminal cases for permit holders.

“This legislation provides an answer to the confusing patchwork of concealed carry permits, particularly with regard to states where laws make unwitting criminals out of legal permit holders for a simple mistake of a wrong traffic turn,” said Lawrence Keane, NSSF senior vice president and general counsel. “It safeguards a state’s right to determine their own laws while protecting the Second Amendment rights of all Americans. We thank Rep. Hudson for his leadership on behalf of America’s hunters and recreational shooters.”

In 2015, Rep. Hudson sponsored similar legislation with 216 co-sponsors.

Rep. Ryan Zinke’s Nomination For Interior Secretary Garners Approval

Rep. Ryan Zinke (R-MT) was selected by President-elect Donald Trump to be his Secretary of the Interior. Zinke, a former Navy SEAL, is the lone Congressman from Montana and was rumored to have been a potential candidate to take on Sen. Jon Tester (D-MT) in 2018. Zinke’s selection has garnered approval from the NRA, the NSSF, and other organizations.

The Boone and Crockett Club, the oldest wildlife conservation group in the U.S., founded by Theodore Roosevelt, praises President-Elect Donald Trump’s announcement of U.S. Representative Ryan Zinke (R-Mont.) to become Secretary of the Department of the Interior.

He announced his support for the Sportsmen’s Conservation and Outdoor Recreation Enhancement Act, which contained seven provisions to reauthorize or implement ways to fund conservation programs on federal and private lands.

“Zinke is a sportsman just like the members of DSC,” said Carter. “His heart lies in the same place as ours and we feel he is the perfect person to direct management of our lands and wildlife. Finally, in what I consider the greatest endorsement of Zinke yet, is this statement from the Center for Biological Diversity. They have been consistently a thorn in the side to hunters, anglers, and shooters with their constant lawsuits against lead-based ammunition and professional wildlife conservation management efforts.

TUCSON, Ariz.— Freshman congressman Ryan Zinke (R-Mont.) has reportedly been picked by Donald Trump to serve as secretary of the Interior to oversee endangered species, the U.S. Fish and Wildlife Service, hundreds of millions of acres of public land including the national parks, Bureau of Land Management lands and national wildlife refuges and the Bureau of Indian Affairs. Zinke was a staunch, early and controversial supporter of Trump throughout the presidential campaign. Trump has picked his wife Lola Zinke to oversee the transition of the Veteran’s Administration.

“Ryan Zinke has a dismal 3 percent lifetime environmental voting record. His brief political career has been substantially devoted to attacking endangered species and the Endangered Species Act. He led efforts to strip federal protections for endangered wolves, lynx and sage grouse, voted to exempt massive agribusiness and water developers from Endangered Species Act limitations, and opposed efforts to crack down on the international black market ivory trade.”


“Zinke consistently votes for the interests of oil and gas companies, which is not surprising since Oasis Petroleum is his largest campaign contributor and the oil and gas industry is his third-largest sector contributor. He has also voted against and attacked the establishment of protective national monuments on public lands.”


“On the bright side, Zinke has spoken and voted against the outright transfer of federal public lands to states and corporations. This is in keeping with positions taken by Donald Trump and his son Donald, Jr. Unfortunately Zinke has championed the same result — greatly increased logging, mining and oil drilling, greatly reduced environmental protections, elimination of federal control, and weakening of environmental standards — by turning over public land management to industry-dominated panels appointed by state governors. In Zinke’s scheme, industry and state interests get all the environmental destruction and profit they want, with the federal government being made to pay for it through nominal retention of land title.”


“Zinke’s cynically named ‘Resilient Federal Forests Act of 2015’ was one of several schemes he led to turn control of public land to industry-dominated panels. It was widely opposed by conservationists, sportsmen, businesses and even some timber companies for dispensing with environmental laws and public involvement in order to ramp up unsustainable logging levels.”


“Disturbingly, in 2012 Zinke contradicted his recent stance when he signed the extremist Montana Constitutional Governance Pledge promising to ‘legally and administratively oppose the multitude of bureaucracies that have sprung up to enforce the unlawful seizure of our native land and its resources including, but not limited to: the Bureau of Land Management, the United States Park Service, the various bureaus of Wildlife and Fisheries, etc., and restore the rightful powers over the land to the State and private ownership.’ During confirmation hearings, the Senate needs to grill Zinke on this contradiction and ensure he truly supports keeping public lands in public hands.”

New NRA Ad Coming To A Battleground State Near You

The NRA is releasing another ad urging voters to defeat Hillary Clinton. According to the news release below, they will be spending upwards of $5 million airing their message.

I fully expect to see it on the airwaves here in North Carolina shortly. We are one of the few key states that very close and that must be won on the way to 270 electoral votes. Our early voting started yesterday across the state.

Fairfax, Va.— The National Rifle Association has launched a new ad using Hillary Clinton’s own words to expose her repeated lies regarding her views on the Second Amendment. The new ad, entitled “Classified,” began airing last night on national cable and on broadcast in key battleground states. The $5 million ad buy will run through Oct. 31.

The ad played out in real time on the debate stage last night when Clinton once again lied to the American people by saying she respects the Second Amendment, but then totally mischaracterized and confirmed her opposition to the Supreme Court’s landmark decision in District of Columbia v. Heller. The Heller ruling guaranteed the right of an individual to keep a firearm in the home for self-defense.

“Hillary Clinton cannot tell the truth when it comes to the Second Amendment,” said Chris W. Cox, executive director, NRA-ILA. “It is clear from the debate last night that Hillary Clinton lies about her support of the Second Amendment and believes Americans do not have a right to keep a firearm at home for self-protection. Her argument that the Heller decision was just about protecting toddlers was ridiculous.”

Last night was the second time Clinton has publicly said she opposes Heller. At a recent closed door event, Clinton was recorded sayingthe Supreme Court “is wrong on the Second Amendment.” If elected president, Clinton will nominate at least one anti-gun Supreme Court justice who will vote to overturn the right of a law-abiding citizen to have a firearm in the home for self-protection.

“We cannot trust Hillary Clinton. Hillary Clinton has lied about her emails, she has lied about Benghazi, and she lies about the Second Amendment. She will say whatever it takes to get elected, but the NRA remains committed to exposing her lies. Defeating Hillary Clinton is critical to protecting the rights of America’s law-abiding gun owners,” concluded Cox.

“Heartless Hillary”

I listened to Donald Trump’s speech at the NRA-ILA Leadership Forum yesterday. Two things stood out for me. First, and most important, I really do believe that Trump understands the issues surrounding the Second Amendment and gun rights. In his speech he referenced the makeup of the Supreme Court, judges, concealed carry permits, the threats to the Second Amendment, self-defense, and gun free zones.

The latter two, self-defense and gun free zones, are two areas that he really highlighted. Noting the Paris Massacre in a gun free zone, Trump said he doubted that it would have gone on long if held at the Annual Meeting due to the number of armed citizens. (As a sidebar, due to the Secret Service and their protective rules, Trump *was* speaking in a gun free zone.) Trump spoke of single moms in Florida and grandmothers in Ohio that would be left defenseless if Hillary was elected. That lead to his newest nickname for Clinton as “Heartless Hillary”. Though, he admits, he still really likes “Crooked Hillary.”

Second, listening to a Trump speech is an exercise in patience. This is not because of what he says but how he says it. The man has a severe case of attention deficit disorder when it comes to public speaking. He’d start out on a topic and then …SQUIRREL! and he’d be off on a tangent. He makes some good points but he can be damn hard to follow.

I read some discussion yesterday on Sebastian’s blog on whether or not the NRA should have endorsed Trump. In my opinion, the NRA did not have much of a choice. They deal in realpolitik. Their avowed foe Hillary Clinton has doubled down and made gun control, the Second Amendment, and the NRA her number one target.

This is a two-person race unless Bernie decides to run as an independent which Trump encouraged in his speech. The NRA has to pull conservatives who supported other candidates and gun owners who don’t trust Trump back into the fold. Without them, Hillary most likely will win and the Second Amendment will be lost as an actual civil right. It will become a historical artifact. That is something the NRA can’t live with and I certainly won’t live with.

NRA Response To Obama’s Executive Actions

While the gun prohibitionists are declaring victory due to President Obama’s Executive Actions – and who knew it would take so little to satisfy their demands – gun rights groups have also responded. They don’t have such sanguine expectations that these “tweaks” will do much to combat either terrorism or crime.

Below is the response of NRA-ILA Executive Director Chris Cox which is followed by a just released video of Wayne LaPierre speaking on background checks.

Fairfax, Va. – The executive director of the National Rifle Association’s Institute for Legislative Action, Chris W. Cox, released the following statement on Tuesday regarding President Barack Obama’s Executive Gun Control Order:

Once again, President Obama has chosen to engage in political rhetoric, instead of offering meaningful solutions to our nation’s pressing problems. Today’s event also represents an ongoing attempt to distract attention away from his lack of a coherent strategy to keep the American people safe from terrorist attack.

The American people do not need more emotional, condescending lectures that are completely devoid of facts. The men and women of the National Rifle Association take a back seat to no one when it comes to keeping our communities safe. But the fact is that President Obama’s proposals would not have prevented any of the horrific events he mentioned. The timing of this announcement, in the eighth and final year of his presidency, demonstrates not only political exploitation but a fundamental lack of seriousness.

The proposed executive actions are ripe for abuse by the Obama Administration, which has made no secret of its contempt for the Second Amendment. The NRA will continue to fight to protect the fundamental, individual Right to Keep and Bear Arms as guaranteed under our Constitution. We will not allow law-abiding gun owners to be harassed or intimidated for engaging in lawful, constitutionally-protected activity – nor will we allow them to become scapegoats for President Obama’s failed policies.

NRA News released this video of Wayne LaPierre speaking about the deficiencies of the current background checks. As he says, you don’t need to cast a bigger net – just one with smaller holes.

New Year’s Resolutions

Given that Hillary Clinton thinks the National Rifle Association is one of the enemies that she is most proud of, it is good to see the NRA punching back twice as hard.  Their New Year’s video pokes fun at her support from Bloomberg as well as her obvious disdain for the Second Amendment and by extension the US Constitution.

I think it is smart for the NRA to start switching their focus from Obama to Clinton. While Obama can still make mischief as he is signaling with his weekly address, he is a lame duck. Short of appointing another Supreme Court justice, he can’t hurt us too badly. Hillary, on the other hand, given four years in office would be a disaster for gun owners.

UPDATE: Interestingly enough, the NRA’s video is catching some traction with the news media. In our local station’s (WLOS Asheville) reports on the gun control moves by Obama, this video is mentioned each and every time. I heard about it at 5pm, 5:30pm, 6pm, and 11pm.

NRA Response To Social Security Proposal

The NRA-ILA issued an alert on Saturday after the story broke about the proposal to include 4.2 million Social Security recipients in the NICS database as prohibited persons. This proposal from the Social Security Administration has been traced back to a Presidential Memorandum issued in 2013. That memorandum, issued post-Newtown, ordered Federal agencies to improve the availability of relevant records for inclusion into the NICS database.

The alert does not explain why it took the SSA over two and a half years to come forward with this proposal. Moreover, the alert notes that other Federal agencies were named in the memorandum and might be expected to add even more names to the prohibited list.

As the L.A. Times reported on July 18, the Social Security Administration (SSA) is currently developing a program to strip the Second Amendment Rights of over four million Americans currently receiving SSA benefits through a “representative payee.”  Not only would this amount to the largest gun grab in American history, but according to the published report, would take place without any due process protections for recipients, amounting to a nullification of Second Amendment rights for millions of Americans who don’t pose a threat to themselves or anyone else.
This new program appears to have been instigated by the SSA in response to a memorandum issued by Obama in January of 2013 which directed all federal agency executives to “improve the availability of records to the National Instant Criminal Background Check System (NICS).” This memorandum required all agency heads to submit to the Department of Justice (DOJ) a plan for “sharing all relevant Federal records” for submission to the NICS.

Take Action Now to Stop the Largest Gun Grab in American History

Are you a prohibited person? A new, unconstitutional Social Security Administration program will add over 4 million Americans to the prohibited persons list without due process. Contact your lawmakers today. Ask if you’re one of the 4 million.
Evidently, Obama’s SSA bureaucrats read “all relevant Federal records” to mean all Social Security recipients who have a “representative payee” assigned to their accounts to help them manage their payments and receipts. Obviously, many individuals swept up in this egregious case of bureaucratic over-reach would not otherwise be prohibited from owning, possessing, or acquiring firearms under federal law.
The federal prohibitions against acquiring or possessing firearms apply to those “adjudicated as a mental defective,” among others. The term “adjudication,” however, refers to a determination made after a judicial-type process that includes various due process protections. In no case does the federal law describe or contemplate the type of prohibition by bureaucratic fiat exercised by the SSA in developing its guidelines for those with “representative payees” assigned to their accounts.
But SSA is not alone in this directive. The memorandum names several agencies, including the Departments of Defense, Health and Human Services, Homeland Security, Transportation, and “such other agencies or offices as the Chair may designate.” Potentially, bureaucrats in all these agencies could be working hard to identify and forward “all relevant Federal records,” to the NICS pursuant to the Obama mandate.
In total, this program could easily grow to include many more millions of Americans who have any connection to the Federal government through the various agencies named in the memorandum.
Unfortunately, this fits a pattern of abuse within the Obama Administration which is clearly hell-bent on destroying the Second Amendment in any way possible. As we reported previously (here and here), the Veterans Administration (VA) has already implemented a similar program to designate veterans as “prohibited persons”  when they have a fiduciary assigned to administer their VA benefits. Like the SSA program described above, the VA procedures are also devoid of significant due process protections or any requirement that the beneficiary be found a danger to self or others. According to the L.A Times article, 177,000 vets have been swept into NICS with the bureaucratic short-cut.
The implications of this policy are too far reaching to fathom at present. Social Security is one of the more prolific and relied upon Federal programs in American history. That Obama’s directive could so easily be implemented within the SSA suggests that bureaucrats could effectively cloak such a program in any agency within the growing leviathan that is the federal government.

The NRA On BATFE Waving The White Flag

The NRA-ILA released this statement in response to the announcement from the BATFE that they will not be seeking a final framework at this time.

Fairfax, Va. – The National Rifle Association (NRA) was instrumental in stalling the Obama Administration’s initial attempt to ban commonly used ammunition for the most popular rifle in America, the AR-15. The announcement that the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) will suspend its proposed framework to ban M855 ammunition validates the NRA’s assertion that this effort was nothing more than a political maneuver to bypass Congress and impose gun control on the American people.

“Today’s announcement proves what we have said all along — this was 100% political. President Obama failed to pass gun control through Congress, so he tried to impose his political agenda through executive fiat. But every gun owner in America needs to understand Barack Obama’s hatred of the Second Amendment has not changed,” said Wayne La Pierre, Executive Vice President of the National Rifle Association.

Chris Cox, Executive Director of NRA-ILA criticized the dishonest campaign to ban this common ammunition: “The lies used to justify the ban were shameful. This proposal was never about law enforcement safety – it was about the Obama Administration’s desire to pander to billionaire Michael Bloomberg and his gun control groups. Since they haven’t been able to ban America’s most popular rifle, they are trying to ban the ammunition instead.”

Since the BATFE announced its plan to ban commonly used ammunition less than a month ago, the NRA rallied its five million members and tens of millions of supporters across the country in strong opposition. In addition, the NRA worked with congressional leaders in both the U.S. House and Senate to oppose this misguided proposal.

“The NRA would like to thank House Judiciary Committee Chairman Bob Goodlatte, Senate Judiciary Committee Chairman Chuck Grassley and House Commerce, Justice, Science Appropriations Subcommittee Chairman John Culberson for leading the fight against this unconstitutional attack on our Second Amendment freedoms,” continued Cox. “This was a significant victory for our five million members and tens of millions of supporters across the country.

“Make no mistake, this fight is not over. We will remain vigilant and continue to fight against President Obama’s attempt to dismantle the Second Amendment,” concluded LaPierre.
