The screen cap below is from Google cache thanks to <a href=\"http:\/\/www.ar15.com\/forums\/t_1_5\/1824386_Obama_administration_modifies_HIPAA_to_strengthen_the_firearm_background_check_system.html\" target=\"_blank\" rel=\"noopener noreferrer\">a post on Arfcom<\/a>. It was put up and then taken down soon after posting.<\/p>\n<div class=\"separator\" style=\"clear: both; text-align: center;\">\n<a href=\"https:\/\/onlygunsandmoney.com\/wp-content\/uploads\/2016\/01\/HIPAA.png\" imageanchor=\"1\" style=\"margin-left: 1em; margin-right: 1em;\"><img decoding=\"async\" border=\"0\" src=\"https:\/\/onlygunsandmoney.com\/wp-content\/uploads\/2016\/01\/HIPAA.png\" \/><\/a><\/div>\n<p>\nThe final rule is scheduled to be published in the Federal Register on Wednesday, January 6th. The full 56 page rule is now online and <a href=\"https:\/\/s3.amazonaws.com\/public-inspection.federalregister.gov\/2015-33181.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">can be examined here<\/a>.<\/p>\n<p>The rule summary states that the following are persons subject to the GCA 68 mental illness prohibition.<\/p>\n<blockquote class=\"tr_bq\"><p>\n<i>Among the persons<br \/>\nsubject to the Federal mental health prohibitor<br \/>\nestablished under the Gun Control Act of<br \/>\n1968 and implementing<br \/>\nregulations issued by the Department of Justice<br \/>\n(DOJ)<br \/>\nare<br \/>\nindividuals who have been involuntarily committed to a mental institution; found<br \/>\nincompetent to stand trial or not guilty by reason of insanity; or otherwise have been<br \/>\ndetermined by a court, board, commission, or other lawful authority to be a danger to<br \/>\nthemselves or others or to lack the mental capacity to contract or manage their own<br \/>\naffairs, as a result of marked subnormal intelligence or mental illness, incompetency,<br \/>\ncondition, or disease.<\/i><\/p><\/blockquote>\n<p>This seems to me to expand the 18 U.S. Code \u00a7 922(d)(4) prohibition which only states &#8220;has been adjudicated as a mental defective or has been committed to any mental institution&#8221;. Other lawful authority is very broad and does not seem to take due process into account. If they are indeed expanding the legal definition, I fully expect that this will be challenged in the courts as it well should.
