Notice I said conservation and not preservation. Preservation is for artworks; conservation is for land and animals. Locking up a forest makes it susceptible to disease and fire. Likewise, legitimate hunting of elephants and other ivory bearing animals gives them an economic value. With an economic value comes protection and anti-poaching initiatives. I may never hunt an elephant but I recognize that both the numbers and herd health will be helped by hunting.<\/p>\n<p>Banning the trade in ivory legitimately brought into the United States in the 20th century will do nothing to stop current poachers. If anything, it will increase the economic reward to poachers. It is akin to the so-called war on drugs. Efforts to dry up supply just increase the street price of cocaine, meth, etc. and increase the incentive to the cartels to try and smuggle it into the country.<\/p>\n<p>The comments on the Fish and Wildlife Service proposal close on Monday. I sent my comment in today. The proven solution is to<br \/>\nattack poaching at the source, not punish lawful ivory owners in the<br \/>\nU.S. who cannot have any effect on poaching in Africa. Successful<br \/>\nanti-poaching programs in Africa have demonstrated that an integrated<br \/>\ncomprehensive approach that encourages the locals to fight poaching does<br \/>\n work to save elephants.<\/p>\n<div>\n<span style=\"color: red;\"><strong>Stealing<br \/>\n the investments of millions of Americans will not save a single<br \/>\nelephant in Africa. This is the worst kind of &#8220;Feel Good &#8211; Do Bad&#8221;<br \/>\ngovernment action.<\/strong><\/span><\/div>\n<p>As of Wednesday, Sept.<br \/>\n23, over 1,500 comments have been submitted. Too many are from people<br \/>\nwho make simplistic and emotional statements about saving elephants or<br \/>\nrepeat factually unsupported slogans from non-profit organizations<br \/>\nmaking millions of dollars off this campaign to ban ivory.&nbsp; However,<br \/>\nmany others are thoughtful comments explaining why the proposed rule<br \/>\npunishes innocent Americans without doing anything to stop poaching in<br \/>\nAfrica. <strong>We need you to add your voice of reason to those opposing this absurd, abusive and illegal ivory ban.<\/strong><\/p>\n<div>\n<strong><span style=\"color: red;\">Ideally, your comment should be personal and specific, but comment regardless.<\/span>&nbsp;<br \/>\n Form letter comments are not as effective as individual comments, but<br \/>\nregardless, please comment because every comment in opposition counts!<br \/>\nUse the information below to develop your comment.<\/strong><\/div>\n<p><strong>*<br \/>\n The Proposed Rule Change is arbitrary and capricious.&nbsp; It punishes<br \/>\npeople who have invested in ivory, including ivory-handled knives and<br \/>\nknives with ivory embellishment, that was legally imported decades ago<br \/>\nwhich has nothing to do with recent African elephant poaching.<\/strong><br \/>\nThe government should focus resources on stopping poachers in Africa and<br \/>\n prosecuting criminals who smuggle ivory to Asia if it wants to stop<br \/>\nelephant poaching.&nbsp; Punishing innocent Americans who own or trade ivory<br \/>\nthat was legally brought to this country before the poaching crisis has<br \/>\nno rational relationship to poaching African elephants, so the Proposed<br \/>\nRule Change seriously violates the federal Administrative Procedure Act.<\/p>\n<p><strong>*<br \/>\n FWS misrepresented data and studies about ivory in the United States.&nbsp;<br \/>\nCITES data shows that hundreds of tons of illegal ivory flows to China<br \/>\nand Asia, but almost none of it comes to the United States.<\/strong>&nbsp;<br \/>\nEven Dr. Daniel Stiles, an expert FWS relied upon in the Proposed Rule<br \/>\nChange, submitted a comment pointing out how FWS has misrepresented his<br \/>\nresearch.<br \/>\nhttp:\/\/www.regulations.gov\/#!documentDetail;D=FWS-HQ-IA-2013-0091-0415<br \/>\nThe legal ivory import control system in place before February 2014 was<br \/>\nworking in the United States, and government prosecutions show that they<br \/>\n were certainly capable of investigating and successfully prosecuting<br \/>\nthe very few people who break the law.&nbsp; Creating a new class of<br \/>\ncriminals from people who need to sell or trade in otherwise legal ivory<br \/>\n will waste resources, distract from enforcement efforts against actual<br \/>\npoachers and smugglers, and unfairly persecute people who abided by<br \/>\ninternational trade bans that were already in place. Along with creating<br \/>\n bad policy, FWS&#8217;s misuse and misrepresentation of data is an egregious<br \/>\nviolation of the federal Information Quality Act. (<a alt=\"http:\/\/www.kniferights.org\/index.php?option=com_content&amp;task=view&amp;id=345&amp;Itemid=1\" href=\"http:\/\/r20.rs6.net\/tn.jsp?f=001ezXFbel6Kd4BjNktosmC6M1VhJNj3wILfDPgVWpxFgKP3ltFN48eVN7oGc-KHKK6aoMfg0PqZ4vqHuNsVI2YyUfAE-iYs9pvHji_h3JmufMQ8Uis6Ozihy1_p7MLtsdMhfDpHnd0eyXlFRVT8Z3jBWCEveztK_hN05y6ggbXZxZelO1Eqo4sDy9mEMMQg-Zcsjqs_PlcAH9TPvH1CVOSHn2eZYRF68UuKIfJaP1VwtkYhhxQdIGC1wLdwcLLrcDebYZ99kh_3c0=&amp;c=disY5T95Mn7mi52_jGKnIrkufnppN8hgUJqlk_H-52isv4QESNEfLg==&amp;ch=qfrI-E3tR3QuWuBjPyKNwojSgVzQG95BTplgt78e_XqDJwOff-kzgw==\" linktype=\"1\" shape=\"rect\" style=\"color: blue;\" target=\"_blank\" track=\"on\" rel=\"noopener noreferrer\">Click here for more background on this blatant violation of the law<\/a>) <\/p>\n<p><strong>*<\/strong> <strong>FWS&#8217;s claim that less than 2% of ivory sales will be impacted by this ban is nonsense.&nbsp; <span style=\"color: red;\">(Here you should describe how the ban would impact your business or collection individually, where applicable.)&nbsp;<\/span><\/strong><br \/>\n Conclude by stating that this ban falls almost entirely on small<br \/>\nbusinesses, so the FWS certification in the proposed rule that it would<br \/>\nnot have a significant economic effect on a substantial number of small<br \/>\nentities as defined under the Regulatory Flexibility Act is false.&nbsp; As<br \/>\nis their finding under the Small Business Regulatory Enforcement<br \/>\nFairness Act that there is not a disproportionate impact for small or<br \/>\nlarge businesses.<\/p>\n<p><strong>* The exceptions in the Proposed Rule<br \/>\nare useless and do not adequately allow legal and legitimate commerce as<br \/>\n directed in Executive Order 13648 on Combating Wildlife Trafficking in<br \/>\nJuly 2013.<\/strong>&nbsp; To qualify for any exception, a person would need<br \/>\nto provide documentation about import, sales and transfers that was not<br \/>\nrequired in the past, so it was never created.&nbsp; FWS undermines all of<br \/>\nthe exceptions, which are irrational, vague and arbitrary in any case,<br \/>\nby placing an unachievable burden on legal ivory owners.&nbsp; The agency<br \/>\nalso fails to describe specific documentation burdens with specificity,<br \/>\nso even if an owner or business has some documentation about an ivory<br \/>\nitem, he or she cannot be certain whether documentation is adequate.<br \/>\nThese failures are serious violations of the federal Administrative<br \/>\nProcedure Act. <\/p>\n<p><strong>* Add any additional personal objections<br \/>\nto this irrational and abusive rule that is unfair, un-American and will<br \/>\n not save a single elephant in Africa.
