Arms et al v. Soto et al<\/em> is at the US Supreme Court on appeal from the Connecticut Supreme Court. <a href=\"https:\/\/onlygunsandmoney.com\/2019\/04\/09\/remington-plans-to-appeal-connecticu.html\">Remington is asking<\/a> for a<a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/19-168.html\" target=\"_blank\" rel=\"noopener\"> writ of certiorari<\/a> and is seeking to overturn the horrendous ruling out of Connecticut. <a href=\"https:\/\/onlygunsandmoney.com\/2019\/03\/14\/connecticut-supreme-court-rules.html\">That 4-3 ruling stretched state law<\/a> to cover acts that should have been precluded from suit by the Protection of Lawful Commerce in Arms Act.<\/p>\n\n\n\n<p>This past Friday the respondents (aka the anti-PLCAA side) filed their reply <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-168\/118198\/20191004151558181_19-168BriefInOpposition.pdf\" target=\"_blank\" rel=\"noopener\">brief<\/a>. The brief itself is not the story here. Rather it is who the ambulance chasing Joshua Koskoff with his novel legal theories corralled to be the counsel of record and to argue the case before the Supreme Court.<\/p>\n\n\n\n<p>The counsel of record is <a href=\"https:\/\/en.wikipedia.org\/wiki\/Donald_B._Verrilli_Jr.\" target=\"_blank\" rel=\"noopener\">Donald B. Verrilli, Jr.<\/a> who served as Obama&#8217;s Solicitor General from 2011 until 2016. He is now a partner is the high powered California-DC law firm of <a href=\"https:\/\/www.mto.com\/\" target=\"_blank\" rel=\"noopener\">Munger, Tolles, and Olson<\/a>. That firm was co-founded by Warren Buffet&#8217;s investment partner <a href=\"https:\/\/en.wikipedia.org\/wiki\/Charlie_Munger\" target=\"_blank\" rel=\"noopener\">Charlie Munger<\/a>. <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img loading=\"lazy\" decoding=\"async\" width=\"185\" height=\"278\" src=\"https:\/\/onlygunsandmoney.com\/wp-content\/uploads\/2019\/10\/Verrilli_Don_MTO_bio1.jpg\" alt=\"Donald Verrilli attorney for Soto\" class=\"wp-image-12211\"\/><\/figure><\/div>\n\n\n\n<p><a href=\"https:\/\/www.law.com\/supremecourtbrief\/2019\/10\/08\/atlanta-firm-advocating-for-lgbt-protections-rare-intervention-grant-verrilli-leads-for-sandy-hook-victims-big-law-arbitration-clauses\/\" target=\"_blank\" rel=\"noopener\">The National Law Journal&#8217;s Supreme Court Brief<\/a> has this to say about his appointment.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p> The families of victims of the Sandy Hook school shooting <a href=\"https:\/\/link.law.com\/click\/18263095.4554\/aHR0cHM6Ly93d3cubGF3LmNvbS9uYXRpb25hbGxhd2pvdXJuYWwvMjAxOS8xMC8wNC9zYW5keS1ob29rLWZhbWlsaWVzLWhpcmUtZXgtc29saWNpdG9yLWdlbmVyYWwtdmVycmlsbGktZm9yLWZpZ2h0LXdpdGgtZ3VubWFrZXItcmVtaW5ndG9uLz91dG1fc291cmNlPWVtYWlsJnV0bV9tZWRpdW09ZW5sJnV0bV9jYW1wYWlnbj1zdXByZW1lY291cnRicmllZiZ1dG1fY29udGVudD0yMDE5MTAwOCZ1dG1fdGVybT1ubGo\/516335e534b9b0a8048c8631B86a28cbb\" target=\"_blank\" rel=\"noopener\">have retained<\/a> former U.S. Solicitor General <strong>Donald Verrilli Jr.<\/strong> to represent them in their U.S. Supreme Court fight with gunmaker Remington Arms Co. LLC.<br><br>Verrilli, now a partner at <strong>Munger, Tolles &amp; Olson<\/strong>, was counsel of record for the plaintiffs, according to new filings in the U.S. Supreme Court. He <a href=\"https:\/\/link.law.com\/external\/18263095.4554\/aHR0cHM6Ly93d3cuc3VwcmVtZWNvdXJ0Lmdvdi9Eb2NrZXRQREYvMTkvMTktMTY4LzExODE5OC8yMDE5MTAwNDE1MTU1ODE4MV8xOS0xNjhCcmllZkluT3Bwb3NpdGlvbi5wZGY_dXRtX3NvdXJjZT1lbWFpbCZ1dG1fbWVkaXVtPWVubCZ1dG1fY2FtcGFpZ249c3VwcmVtZWNvdXJ0YnJpZWYmdXRtX2NvbnRlbnQ9MjAxOTEwMDgmdXRtX3Rlcm09bmxq\/516335e534b9b0a8048c8631B7cfbf6bb\" target=\"_blank\" rel=\"noopener\">filed a brief<\/a>  on their behalf Friday to oppose Remington\u2019s attempt to have the U.S.  Supreme Court rule that a federal law shields it from liability in the  Sandy Hook case&#8230;.<\/p><p>&#8220;The Sandy Hook victims were slain in a commando-style assault on the  school. Their killer\u2019s weapon of choice was a Bushmaster XM15-E2S rifle,  manufactured and marketed by petitioners,&#8221; the Munger Tolles team said  in their opposition brief. &#8220;The XM15-E2S was designed for military  combat, specifically to inflict maximum lethal harm on the enemy.  Petitioners\u2019 marketing emphasized precisely those characteristics of the  firearm. In words and images, petitioners touted the XM15-E2S as a  combat-tested weapon that would bestow the power to &#8216;perform under  pressure&#8217; and &#8216;single-handedly&#8217; conquer &#8216;forces of opposition.'&#8221; <\/p><\/blockquote>\n\n\n\n<p>If I had to hazard a guess, I would say Verrilli and the rest of the Munger, Tolles team are doing this case <em>pro bono<\/em>. The <a href=\"https:\/\/www.mto.com\/pro-bono\/pro-bono-activities\" target=\"_blank\" rel=\"noopener\">firm takes great pride<\/a> in their <em>pro bono<\/em> activities. <\/p>\n\n\n\n<p>This case is all about the supremacy of Federal law. Thus, it takes a bit of chutzpah (or hypocrisy) for Verrilli to argue against PLCAA when one of his <a href=\"https:\/\/www.mto.com\/lawyers\/donald-b-verrilli-jr\" target=\"_blank\" rel=\"noopener\">self-identified<\/a> landmark wins (<a href=\"https:\/\/www.oyez.org\/cases\/2011\/11-182\" target=\"_blank\" rel=\"noopener\">Arizona v.
