The split decision allowed the case to go back to the trial court level for adjudication. Given the strong dissent in the case and the way the majority made up a rationale out of whole cloth to support their decision, it was only a matter of time before an appeal was filed with the United States Supreme Court.<\/p>\n<p>Remington filed a <a href=\"http:\/\/appellateinquiry.jud.ct.gov\/DocumentDisplayer.aspx?AppId=2&amp;DocId=FgYS4zD4ocJdJHIFegz%2fOg%3d%3d\" target=\"_blank\" rel=\"noopener\">motion <\/a>with the Connecticut Supreme Court yesterday requesting a stay in the decision as they plan to appeal to the SCOTUS.<\/p>\n<blockquote class=\"tr_bq\"><p>\n<i><b>Remington is filing a Petition for Certiorari<\/b> in the United States Supreme Court in<br \/>\naccordance with the applicable Rules of the United States Supreme Court. The basis<br \/>\nfor jurisdiction in the Supreme Court is this Court\u2019s decision on an important federal<br \/>\nquestion that conflicts with a decision of a United States court of appeals. U.S. Sup. Ct.<br \/>\nR. 10. Specifically, Remington will ask the United States Supreme Court to consider<br \/>\nand decide whether CUTPA is the type of statute Congress intended to serve as a \u201cpredicate statute\u201d under \u00a7 7903(5)(A)(iii) of the PLCAA, a violation of which may<br \/>\ndeprive firearm manufacturers and sellers threshold immunity against being sued. See<br \/>\n15 U.S.C. \u00a7 7902(a) (\u201cA qualified civil liability action may not be brought in any Federal<br \/>\nor State court.\u201d). As this Court recognized, \u201ccourts that have construed the predicate<br \/>\nexception are divided\u201d on whether Congress intended for violation of statutes, like<br \/>\nCUTPA, to serve as an exception to PLCAA immunity. Soto, 331 Conn. at 136.<\/i><\/p><\/blockquote>\n<p>The motion goes on to give a legal rationale for the issuance of a stay.<\/p>\n<blockquote class=\"tr_bq\"><p>\n<i>The Court should stay proceedings pending the United States Supreme Court\u2019s<br \/>\ndecision to either deny Remington\u2019s Petition for Certiorari or its decision on the merits of<br \/>\nthe case. Practice Book \u00a7 71-7 provides:<\/i><\/p>\n<blockquote><p>\n<i>When a case has gone to judgment in the state Supreme Court and<br \/>\na party to the action wishes to obtain a stay of execution pending a<br \/>\ndecision in the case by the United States Supreme Court, that party<br \/>\nshall, within twenty days of the judgment, file a motion for stay with<br \/>\nthe appellate clerk directed to the state Supreme Court. The filing of<br \/>\nthe motion shall operate as a stay pending the state Supreme<br \/>\nCourt&#8217;s decision thereon.<\/i><\/p><\/blockquote>\n<p><i>If proceedings are not stayed and Remington is required to undergo the costly<br \/>\nand time-consuming burdens of litigation, including further discovery, motion practice<br \/>\nand possibly trial, it will irreparably lose the intended benefit of threshold PLCAA<br \/>\nimmunity from suit. The United States Supreme Court has consistently recognized that<br \/>\n\u201c[u]ntil \u2026 threshold immunity is resolved, discovery should not be allowed.\u201d Harlow v.<br \/>\nFitzgerald, 457 U.S. 800, 818 (1982).<\/i><\/p><\/blockquote>\n<p><a href=\"https:\/\/www.uticaod.com\/news\/20190409\/remington-to-ask-supreme-court-to-hear-sandy-hook-appeal?fbclid=IwAR0UUJQ_xHuY48PQJZbbx8SyYRIKCer-5lEY27bRI74ktTLck0rkXZsGnAg\" target=\"_blank\" rel=\"noopener\">According to the Associated Press<\/a>, Remington has until June to file the actual petition for a writ of certiorari. The same article quotes the attorney for the plaintiffs as saying, &#8220;is a matter of law for the state of Connecticut.\u201d Given that the case revolved around the supremacy of Federal law in what is arguably a Federal matter, this is a case that should be heard by the SCOTUS.
