BATFE and Codrea v. Barr a stay in the bump stock ban rule and referred the request back to the Circuit Court for the DC Circuit.<\/p>\n<blockquote class=\"tr_bq\"><p>\n<i>18A1019 GUEDES, DAMIEN, ET AL. V. BUREAU OF ALCOHOL, ET AL.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>The application for stay, presented to The Chief Justice<br \/>\nand by him referred to the Court, is denied.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>Applicants request that if we deny this application we<br \/>\ngrant a limited stay of 120 hours to allow them to come into<br \/>\ncompliance with the Final Rule. We refer the issue of such a<br \/>\nstay to the D.C. Circuit for its consideration.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>Justice Thomas and Justice Gorsuch would grant the<br \/>\napplication.<\/i><\/p><\/blockquote>\n<p>So where does this leave the case now?<\/p>\n<p>The Firearms Policy Foundation released a statement by email along with the response of the Circuit Court on Sunday evening. The D.C. BATFE, et al., has suggested that<br \/>\nindividuals who wish to comply with the ATF\u2019s Final Rule by<br \/>\nsurrendering their device to the ATF do so <u>under protest<\/u>.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>As you may be aware, both <a href=\"https:\/\/www.firearmsfoundation.org\/r?u=0x2WDlZidCkJ9GIinFiRwhurajvJ9uCki-JeoQUx3AG3pX2q6Ssl0Jkg16C8mFDPQiDLMYhOSSN3bczY-xuj6g&amp;e=afd2393aa0bda99823c556f3eb0ea98d&amp;utm_source=firearmspolicyfoundation&amp;utm_medium=email&amp;utm_campaign=0407bumpstockalert&amp;n=10\" target=\"_blank\" rel=\"noopener\">ATF\u2019s<br \/>\nwebsite relating to bump-stock devices<\/a> and the <a href=\"https:\/\/www.firearmsfoundation.org\/r?u=SIYvdMAe2JZCJWr6VZ7lOrtdWZI5NQnn47B6pss4ZqwZ-lM8_7bK0pMLFNzsPYjfdLFSs2QiyvukIES0dlxPGcEwdT1U3Q1Ji4yzZWN7KC0&amp;e=afd2393aa0bda99823c556f3eb0ea98d&amp;utm_source=firearmspolicyfoundation&amp;utm_medium=email&amp;utm_campaign=0407bumpstockalert&amp;n=11\" target=\"_blank\" rel=\"noopener\">Final<br \/>\nRule<\/a>, 83 Fed.Reg. 66530, declare that \u201ccurrent possessors also<br \/>\nhave the option to abandon bump-stock-type devices at the nearest ATF<br \/>\noffice.\u201d In spite of that, however, some <a href=\"https:\/\/www.firearmsfoundation.org\/r?u=GjwzQmjoNJNKZ7-eUAZR_AOiBvgimoL-pmPeBTCxyFtdRkbE9BDb6L5bqGQ__NdN72pSnPqHOID8-euw802r548xHUndBtEUEXV5cpjj0enqLlWP_eGG7-rctLTS8kC7_Sa0orxcewtHWd2dJphjzg&amp;e=afd2393aa0bda99823c556f3eb0ea98d&amp;utm_source=firearmspolicyfoundation&amp;utm_medium=email&amp;utm_campaign=0407bumpstockalert&amp;n=12\" target=\"_blank\" rel=\"noopener\">reports<\/a><br \/>\n(and our own experience) suggest that not all ATF local offices are<br \/>\naccepting bump-stock devices. Thus, you should call the local ATF<br \/>\noffice before you travel there to confirm that they are, indeed,<br \/>\naccepting affected devices.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>If they are accepting such devices, then make them aware that you<br \/>\nintend to visit their office to surrender your bump-stock device(s)<br \/>\nunder protest and inquire as to whether they have any specific<br \/>\nprocedures for your entry into the building.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>Before you go, you will want to take pictures of your bump-stock<br \/>\ndevice(s), in case there is ever a question as to the condition, make,<br \/>\nand model of it\/them. And you should also consider preparing a letter,<br \/>\nsuch as the Sample Letter provided below, to advise the ATF that you<br \/>\nare providing them your bump-stock device(s) under protest.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>When you go, provide the ATF agent handling your matter with a copy<br \/>\nof the letter and demand that they provide you with a property receipt<br \/>\nthat reflects their receipt of your bump-stock device(s) and specifies<br \/>\nthe make and model of the device(s). Be aware that they may attempt to<br \/>\nhave you sign an ATF 3400.1 Form \u2013 Consent to Forfeiture or<br \/>\nDestruction of Property and Waiver of Notice \u2013 which <strong>you<br \/>\nshould NOT sign under ANY circumstance<\/strong>. In the event that<br \/>\nthey ask you to sign an ATF 3400.1, inform them that the<br \/>\n<strong><u>only<\/u><\/strong> ATF form you are willing to sign is an<br \/>\nATF 3400.23 \u2013 Receipt of Property and Other Items. If they argue at<br \/>\nall with you, politely tell them to review the internal memo that ATF<br \/>\ncirculated regarding the right of individuals to surrender<br \/>\nbump-stock-type devices under protest and those individual\u2019s right to<br \/>\nrefuse to sign an ATF 3400.1 form.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>It would also be prudent to separately document your experience of<br \/>\nthe encounter in writing \u2013 such as the date and time of your visit,<br \/>\nthe location of the ATF office you went to, the names or other<br \/>\nidentifying information (ID #, etc.) of all ATF agents or persons you<br \/>\nspoke with, the details of all discussions, and any other information<br \/>\nthey told or provided you \u2013 and keep it in a safe place.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>You can also let our team know if the ATF in any way refuses or<br \/>\nrejects your attempt to comply with the Final Rule. You can submit a<br \/>\nreport of your issue to <a href=\"mailto:hotline@fpchq.org\">hotline@fpchq.org<\/a> and\/or contact<br \/>\nyour attorney for specific legal advice.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>In the event that ATF elects to institute a forfeiture action<br \/>\nagainst your property, they are required to serve you with a copy. If<br \/>\nthat happens, you should immediately contact an attorney, preferably<br \/>\none who specializes in federal firearms law, if you wish to challenge<br \/>\nATF\u2019s ability to forfeit your property.
