The bill will be HR 8 which has been <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/8?q=%7B%22search%22%3A%5B%22hr+8%22%5D%7D&amp;s=1&amp;r=1\" target=\"_blank\" rel=\"noopener\">reserved for the Speaker<\/a>&nbsp;and which number was <a href=\"http:\/\/onlygunsandmoney.blogspot.com\/2019\/01\/democrats-love-symbolismwhen-abridging.html\" target=\"_blank\" rel=\"noopener\">chosen to represent the day that then-Rep. Gabby Giffords (D-AZ) was shot<\/a>. I think Rep. Mike Thompson (D-CA) will be the official sponsor of the bill and I presume most Democrats will be on board as co-sponsors. Gotta get that Bloomberg money, ya know.<\/p>\n<p>As to the &#8220;Bipartisan&#8221; part of the title, I presume that is because Rep. Peter King (R-NY) and maybe a few others will be co-sponsors of the bill. One Republican or 20 really doesn&#8217;t make it &#8220;bipartisan&#8221; any more than a Republican bill that has one or two Democrats as sponsors.<\/p>\n<p>Here is the <a href=\"https:\/\/mikethompson.house.gov\/sites\/mikethompson.house.gov\/files\/THOMCA_001_xml%20(002).pdf?fbclid=IwAR1VUvE6T9XDM_TswO5oI7QOZEkwjbaC9fipg1KKOIUWskT4lfRUn4A8xiE\" target=\"_blank\" rel=\"noopener\">text <\/a>of the bill:<\/p>\n<blockquote class=\"tr_bq\"><p>\n<i>IN THE HOUSE OF REPRESENTATIVES<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>Mr. THOMPSON of California introduced the following bill; which was referred<br \/>\nto the Committee on January 8, 2019.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>A BILL<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>To require a background check for every firearm sale.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>SECTION 1. SHORT TITLE.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>This Act may be cited as the \u2018\u2018Bipartisan Background Checks Act of 2019\u2019\u2019.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>SEC. 2. PURPOSE.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>The purpose of this Act is to utilize the current background checks process in the United States to ensure individuals prohibited from gun possession are not able to obtain firearms. <\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>SEC. 3. FIREARMS TRANSFERS.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>Section 922 of title 18, United States Code, is<br \/>\namended\u2014<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>(1) by striking subsection (s);<\/i><br \/>\n<i>(2) by redesignating subsection (t) as subsection (s); and<\/i><br \/>\n<i>(3) by inserting after subsection (s), as redesignated, the following:<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>\u2018\u2018(t)(1)(A) It shall be unlawful for any person who<br \/>\nis not a licensed importer, licensed manufacturer, or licensed dealer to transfer a firearm to any other person<br \/>\nwho is not so licensed, unless a licensed importer, licensed<br \/>\nmanufacturer, or licensed dealer has first taken possession<br \/>\nof the firearm for the purpose of complying with subsection (s).<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>\u2018\u2018(B) Upon taking possession of a firearm under subparagraph (A), a licensee shall comply with all requirements of this chapter as if the licensee were transferring<br \/>\nthe firearm from the inventory of the licensee to the unlicensed transferee.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>\u2018\u2018(C) If a transfer of a firearm described in subparagraph (A) will not be completed for any reason after a<br \/>\nlicensee takes possession of the firearm (including because<br \/>\nthe transfer of the firearm to, or receipt of the firearm<br \/>\nby, the transferee would violate this chapter), the return<br \/>\nof the firearm to the transferor by the licensee shall not<br \/>\nconstitute the transfer of a firearm for purposes of this chapter.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>\u2018\u2018(2) Paragraph (1) shall not apply to\u2014<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>\u2018\u2018(A) a law enforcement agency or any law enforcement officer, armed private security professional, or member of the armed forces, to the extent<br \/>\nthe officer, professional, or member is acting within<br \/>\nthe course and scope of employment and official duties;<\/i><br \/>\n<i>\u2018\u2018(B) a transfer that is a loan or bona fide gift<br \/>\nbetween spouses, between domestic partners, between parents and their children, between siblings,<br \/>\nbetween aunts or uncles and their nieces or nephews,<br \/>\n1or between grandparents and their grandchildren;<\/i><br \/>\n<i>\u2018\u2018(C) a transfer to an executor, administrator,<br \/>\ntrustee, or personal representative of an estate or a<br \/>\ntrust that occurs by operation of law upon the death<br \/>\nof another person;<\/i><br \/>\n<i>\u2018\u2018(D) a temporary transfer that is necessary to<br \/>\nprevent imminent death or great bodily harm, if the<br \/>\npossession by the transferee lasts only as long as immediately necessary to prevent the imminent death<br \/>\nor great bodily harm;<\/i><br \/>\n<i>\u2018\u2018(E) a transfer that is approved by the Attorney General under section 5812 of the Internal Revenue Code of 1986; or<\/i><br \/>\n<i>\u2018\u2018(F) a temporary transfer if the transferor has<br \/>\nno reason to believe that the transferee will use or<br \/>\nintends to use the firearm in a crime or is prohibited<br \/>\nfrom possessing firearms under State or Federal<br \/>\nlaw, and the transfer takes place and the transferee\u2019s possession of the firearm is exclusively\u2014&nbsp;<\/i><\/p><\/blockquote>\n<blockquote class=\"tr_bq\"><p>\n<i>\u2018\u2018(i) at a shooting range or in a shooting<br \/>\ngallery or other area designated for the purpose<br \/>\nof target shooting;<\/i><br \/>\n<i>\u2018\u2018(ii) while reasonably necessary for the<br \/>\npurposes of hunting, trapping, or fishing, if the<br \/>\ntransferor\u2014<\/i><br \/>\n<i>\u2018\u2018(I) has no reason to believe that the<br \/>\ntransferee intends to use the firearm in a<br \/>\nplace where it is illegal; and<\/i><br \/>\n<i>\u2018\u2018(II) has reason to believe that the<br \/>\ntransferee will comply with all licensing<br \/>\nand permit requirements for such hunting,<br \/>\ntrapping, or fishing; or<\/i><br \/>\n<i>\u2018\u2018(iii) while in the presence of the transferor.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>&#8216;\u2018(3)(A) Notwithstanding any other provision of this<br \/>\nchapter, the Attorney General may implement this subsection with regulations.<\/i><br \/>\n<i>\u2018\u2018(B) Regulations promulgated under this paragraph<br \/>\nmay not include any provision requiring licensees to facilitate transfers in accordance with paragraph (1).<\/i><br \/>\n<i>\u2018\u2018(C) Regulations promulgated under this paragraph<br \/>\nmay not include any provision requiring persons not licensed under this chapter to keep records of background<br \/>\nchecks or firearms transfers.<\/i><br \/>\n<i>\u2018\u2018(D) Regulations promulgated under this paragraph<br \/>\nmay not include any provision placing a cap on the fee<br \/>\nlicensees may charge to facilitate transfers in accordance<br \/>\nwith paragraph (1).<\/i><br \/>\n<i>\u2018\u2018(4) It shall be unlawful for a licensed importer, licensed manufacturer, or licensed dealer to transfer possession of, or title to, a firearm to another person who is<br \/>\nnot so licensed unless the importer, manufacturer, or dealer has provided such other person with a notice of the<br \/>\nprohibition under paragraph (1), and such other person<br \/>\nhas certified that such other person has been provided<br \/>\nwith this notice on a form prescribed by the Attorney General.\u2019\u2019.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>SEC. 4. TECHNICAL AND CONFORMING AMENDMENTS.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>(a) SECTION 922.\u2014Section 922(y)(2) of title 18,<br \/>\nUnited States Code, is amended in the matter preceding<br \/>\nsubparagraph (A) by striking \u2018\u2018, (g)(5)(B), and<br \/>\n(s)(3)(B)(v)(II)\u2019\u2019 and inserting \u2018\u2018and (g)(5)(B)\u2019\u2019.<\/i><br \/>\n<i>(b) CONSOLIDATED AND FURTHER CONTINUING APPROPRIATIONS ACT, 2012.\u2014Section 511 of title V of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (18 U.S.C. 922 note) is amended by<br \/>\nstriking \u2018\u2018subsection 922(t)\u2019\u2019 each place it appears and inserting \u2018\u2018subsection (s) or (t) of section 922\u2019\u2019.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>SEC. 5. RULE OF CONSTRUCTION.<\/i><br \/>\n<i>Nothing in this Act, or any amendment made by this<br \/>\nAct, shall be construed to\u2014<\/i><br \/>\n<i>(1) authorize the establishment, directly or indirectly, of a national firearms registry; or<\/i><br \/>\n<i>(2) interfere with the authority of a State,<br \/>\nunder section 927 of title 18, United States Code,<br \/>\nto enact a law on the same subject matter as this<br \/>\nAct.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>SEC. 6. EFFECTIVE DATE.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>The amendments made by this Act shall take effect<br \/>\n180 days after the date of the enactment of this Act. <\/i><\/p><\/blockquote>\n<p>&nbsp; <br \/>\n<b>UPDATE:<\/b> Sebastian at Shall Not Be Questioned <a href=\"https:\/\/www.pagunblog.com\/2019\/01\/10\/pelosis-background-check-bill-eliminates-cr-transfers\/\" target=\"_blank\" rel=\"noopener\">notes <\/a>that those of us who have Curios &amp; Relics licenses would have to go through a licensed dealer for our transfers. Notice that the wording in the bill makes no mention of &#8220;licensed collectors&#8221; but only importers, manufacturers, and dealers.<\/p>\n<p><b>UPDATE II:<\/b> Attorney and scholar David Kopel has a<a href=\"https:\/\/reason.com\/volokh\/2019\/01\/09\/textual-analysis-of-hr8-bill-to-to-requi\" target=\"_blank\" rel=\"noopener\"> textual analysis of the bill<\/a> on the Volokh Conspiracy. Dave notes that it would also ban the transfer of a handgun to those 18-20 years old which is now legal in many states in private sales.
