The case centers around common folding knives that have been the target of enforcement by the NYPD and the Manhattan District Attorney. The victims of this unjust definition have usually been trades people and minorities.<\/p>\n<p>From Knife Rights on their plan to appeal:<\/p>\n<blockquote class=\"tr_bq\">\n<div align=\"center\" class=\"ArticleHeadline\" style=\"font-family: &quot;Arial Black&quot;, &quot;Avant Garde&quot;; font-size: 10pt; text-align: center;\">\n<span style=\"color: red; font-family: Arial,Helvetica,sans-serif; font-size: 26pt;\"><\/p>\n<div>\n<div align=\"left\" style=\"text-align: left;\">\n<span style=\"color: black; font-size: 14pt;\"><strong><\/p>\n<div align=\"center\" style=\"text-align: center;\">\nKnife Rights&#8217; NYC Gravity Knife Case Appeal Headed To U.S. Supreme Court<\/div>\n<p><\/strong><\/span><\/div>\n<\/div>\n<p><\/span><\/div>\n<div style=\"font-size: 11pt;\">\n<div>\n<div align=\"left\">\n<div>\n<strong><img loading=\"lazy\" decoding=\"async\" align=\"right\" border=\"0\" height=\"201\" hspace=\"5\" name=\"ACCOUNT.IMAGE.452\" shrinktofit=\"true\" src=\"http:\/\/files.constantcontact.com\/8945fb0f001\/b8cfe74b-b1ee-459c-89b1-7433e4828cbe.jpg\" vspace=\"5\" width=\"300\" \/>Knife<br \/>\n Rights is going forward with an appeal to the Supreme Court of the<br \/>\nUnited States of the Second Circuit&#8217;s decision in favor of New York City<br \/>\n and District Attorney Cyrus Vance, Jr. in our long running civil rights<br \/>\n lawsuit over their persecution of pocket knife owners.<\/strong><\/p>\n<p> Justice Ruth Bader Ginsberg last week granted us a 60-day extension<br \/>\nuntil January 13th, 2019, for submission of our petition for a writ of<br \/>\ncertiorari asking the Court to hear our appeal.<\/p>\n<p> While our<br \/>\nlawsuit against New York City and DA Vance centers on their  abusive<br \/>\nenforcement of New York State&#8217;s gravity knife ban against owners  of<br \/>\ncommon pocket knives, the focus changes somewhat as it moves to the<br \/>\nSupreme Court. Keep in mind that the Supreme Court does not generally<br \/>\nagree to hear a case just because any particular decision in a case is<br \/>\nunjust, irrational or just plain terrible, all of which describe this<br \/>\nruling in spades.<\/p>\n<p> Beyond settling major constitutional issues,<br \/>\nthe Court will sometimes choose to resolve differences in the<br \/>\napplication of Federal law among different Federal circuit courts when<br \/>\nits decisions are not applied the same throughout the U.S. The Second<br \/>\nCircuit panel&#8217;s ruling regarding our constitutional vagueness claim in<br \/>\nthis case opens up that possibility with starkly split decisions between<br \/>\n it and other circuits, as well as splits between a number of state<br \/>\ncourts. The writ explains why this case is important and worthy of the<br \/>\nCourt&#8217;s limited time.<\/p>\n<p> A Supreme Court decision to hear the case<br \/>\ncould affect the implementation and enforcement of a wide spectrum of<br \/>\nlaws to persons throughout the U.S. It is no longer just about these<br \/>\ncommon folding knives. New York City&#8217;s enforcement of the state&#8217;s<br \/>\ngravity knife law against common folding knives is now the vehicle to<br \/>\nanswer the bigger constitutional question at issue. Only if the Supreme<br \/>\nCourt accepts the case do we get to argue the merits of our particular<br \/>\ncase as it reflects this bigger issue.<\/p>\n<p> It&#8217;s always long odds for<br \/>\n any case to be accepted by the Supreme Court. However, not making the<br \/>\nattempt ensures we lose. And, that would allow very bad precedent to be<br \/>\nset in stone.<\/p>\n<p> Taking a case to Supreme Court is an expensive<br \/>\nproposition, more so for a small organization like Knife Rights.
