It is either <a href=\"http:\/\/assembly.state.ny.us\/leg\/?default_fld=&amp;bn=A02388&amp;term=2013&amp;Summary=Y&amp;Text=Y\" target=\"_blank\" rel=\"noopener\">a Class B or Class A misdemeanor<\/a> depending on whether it is a first or subsequent offense and whether it was possessed inside or outside the home.
