Carolyn McCarthy introduced HR 138<\/a> &#8211; the Large Capacity Feeding Device Act &#8211; as expected on January 3rd. <a href=\"http:\/\/onlygunsandmoney.blogspot.com\/2011\/01\/hr-308-large-capacity-ammunition.html\" target=\"_blank\" rel=\"noopener\">It is a word-for-word repeat of her HR 308<\/a> introduced in the 112th Congress. It is a straight up magazine ban of all magazines with a greater than 10 round capacity or the ability to be converted or adapted to that size. Unlike the Clinton-era assault weapon (sic) ban, this bill will not allow you to transfer a pre-ban magazine. Of course, all governmental agencies and current or retired law enforcement officers are exempted from it.<\/p>\n<p><a href=\"http:\/\/thomas.loc.gov\/cgi-bin\/query\/C?c113:.\/temp\/~c1132RUjOp\" target=\"_blank\" rel=\"noopener\">The text of the bill is below<\/a>:<\/p>\n<blockquote class=\"tr_bq\"><p>\n<i>HR 138 IH<br \/>\n<\/i><\/p>\n<p><i>113th CONGRESS<\/i><\/p>\n<p><i>1st Session<\/i><\/p>\n<p><i><b> H. R. 138<\/b><\/i><br \/>\n<i>To prohibit the transfer or possession of large capacity ammunition feeding devices, and for other purposes.<\/i><br \/>\n<\/p>\n<p><i><b>IN THE HOUSE OF REPRESENTATIVES<\/b><\/i><\/p>\n<h3>\n<p><i>January 3, 2013<\/i><br \/>\n<\/h3>\n<p><i>Mrs. MCCARTHY of New York (for herself and Ms. DEGETTE) introduced<br \/>\nthe following bill; which was referred to the Committee on the Judiciary<br \/>\n   <\/i><\/p>\n<p><i><b>A BILL<\/b><\/i><br \/>\n<i>To prohibit the transfer or possession of large capacity ammunition feeding devices, and for other purposes.<\/i><br \/>\n<\/p>\n<ul><i>  Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,<\/i><\/ul>\n<h3>\n<i>SECTION 1. SHORT TITLE.<\/i><\/h3>\n<ul><i>  This Act may be cited as the `Large Capacity Ammunition Feeding Device Act&#8217;.<\/i><\/ul>\n<h3>\n<i>SEC. 2. PROHIBITION ON TRANSFER OR POSSESSION OF LARGE CAPACITY AMMUNITION FEEDING DEVICES.<\/i><\/h3>\n<ul><i>  (a) Definition- Section 921(a) of title 18, United States Code, is amended by inserting after paragraph (29) the following:<\/i><\/ul>\n<ul>\n<ul><i>  `(30) The term `large capacity ammunition feeding device&#8217;&#8211;<\/i><\/ul>\n<\/ul>\n<ul>\n<ul>\n<ul><i>  `(A) means a magazine, belt, drum, feed strip, or<br \/>\nsimilar device that has a capacity of, or that can be readily restored<br \/>\nor converted to accept, more than 10 rounds of ammunition; but<\/i><\/ul>\n<\/ul>\n<\/ul>\n<ul>\n<ul>\n<ul><i>  `(B) does not include an attached tubular device<br \/>\ndesigned to accept, and capable of operating only with, .22 caliber<br \/>\nrimfire ammunition.&#8217;.<\/i><\/ul>\n<\/ul>\n<\/ul>\n<ul><i>  (b) Prohibitions- Section 922 of such title is amended by inserting after subsection (u) the following:<\/i><\/ul>\n<ul><i>  `(v)(1)(A)(i) Except as provided in clause (ii), it shall<br \/>\nbe unlawful for a person to transfer or possess a large capacity<br \/>\nammunition feeding device.<\/i><\/ul>\n<ul><i>  `(ii) Clause (i) shall not apply to the possession of a<br \/>\nlarge capacity ammunition feeding device otherwise lawfully possessed<br \/>\nwithin the United States on or before the date of the enactment of this<br \/>\nsubsection.<\/i><\/ul>\n<ul><i>  `(B) It shall be unlawful for any person to import or bring into the United States a large capacity ammunition feeding device.<\/i><\/ul>\n<ul><i>  `(2) Paragraph (1) shall not apply to&#8211;<\/i><\/ul>\n<ul>\n<ul><i>  `(A) a manufacture for, transfer to, or possession by<br \/>\nthe United States or a department or agency of the United States or a<br \/>\nState or a department, agency, or political subdivision of a State, or a<br \/>\n transfer to or possession by a law enforcement officer employed by such<br \/>\n an entity for purposes of law enforcement (whether on or off duty);<\/i><\/ul>\n<\/ul>\n<ul>\n<ul><i>  `(B) a transfer to a licensee under title I of the<br \/>\nAtomic Energy Act of 1954 for purposes of establishing and maintaining<br \/>\nan on-site physical protection system and security organization required<br \/>\n by Federal law, or possession by an employee or contractor of such a<br \/>\nlicensee on-site for such purposes or off-site for purposes of<br \/>\nlicensee-authorized training or transportation of nuclear materials;<\/i><\/ul>\n<\/ul>\n<ul>\n<ul><i>  `(C) the possession, by an individual who is retired<br \/>\nfrom service with a law enforcement agency and is not otherwise<br \/>\nprohibited from receiving ammunition, of a large capacity ammunition<br \/>\nfeeding device transferred to the individual by the agency upon that<br \/>\nretirement; or<\/i><\/ul>\n<\/ul>\n<ul>\n<ul><i>  `(D) a manufacture, transfer, or possession of a large<br \/>\ncapacity ammunition feeding device by a licensed manufacturer or<br \/>\nlicensed importer for the purposes of testing or experimentation<br \/>\nauthorized by the Attorney General.&#8217;.<\/i><\/ul>\n<\/ul>\n<ul><i>  (c) Penalties- Section 924(a) of such title is amended by adding at the end the following:<\/i><\/ul>\n<ul><i>  `(8) Whoever knowingly violates section 922(v) shall be fined under this title, imprisoned not more than 10 years, or both.&#8217;.<\/i><\/ul>\n<ul><i>  (d) Identification Markings- Section 923(i) of such title<br \/>\nis amended by adding at the end the following: `A large capacity<br \/>\nammunition feeding device manufactured after the date of the enactment<br \/>\nof this sentence shall be identified by a serial number that clearly<br \/>\nshows that the device was manufactured after such date of enactment, and<br \/>\n such other identification as the Attorney General may by regulation<br \/>\nprescribe.&#8217;.<\/i><\/ul>\n<\/blockquote>\n<p>\nThis bill has 39 co-sponsors as of today and I&#8217;m sure more anti-gun representatives will be flocking to sign on after Obama&#8217;s unveiling of his proposals tomorrow.
