Current applications will continue to be processed.<\/p>\n\n\n\n<p>From the <a href=\"https:\/\/www.newsobserver.com\/news\/coronavirus\/article241467601.html\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">News and Observer:<\/a><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>The Wake County Sheriff\u2019s Office will suspend pistol and concealed-carry permit applications until April 30 as demand surges amid the coronavirus outbreak, Sheriff Gerald Baker announced Tuesday.<\/p><p>Applications that have already been submitted will continue to be processed, Baker said during a press briefing.<\/p><p>Pistol permit applications last week averaged 290 per day, or more than three times the roughly 90 applications per day during the same time period a year ago, according to the Sheriff\u2019s Office.<\/p><p>Baker said his office needs time to manage the backlog.<\/p><\/blockquote>\n\n\n\n<p><a href=\"https:\/\/www.wral.com\/wake-sheriff-discusses-virus-response\/19027028\/\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">WRAL <\/a>covered the press briefing and you can see it below. Sheriff Baker&#8217;s statement regarding pistol purchase permits and NC CHPs begins at the 5:15 mark.<\/p>\n\n\n\n<iframe id=\"19027028-iframe\" src=\"https:\/\/www.wral.com\/wake-sheriff-discusses-virus-response\/19027028\/?version=embedded_v2&#038;player_options=%257B%2522embedded_autoplay_next%2522%253Atrue%257D\" allowfullscreen webkitallowfullscreen mozallowfullscreen class=\"wral-embedded-player\" style=\"width: 576px; height: 324px; background-color: transparent; border: 0px none transparent; padding: 0px; overflow: hidden;\"><\/iframe>\n\n\n\n<p>Sheriff Baker has the gall to say that &#8220;it is not an emergency situation.&#8221; Gov. Roy Cooper (D-NC) declared a state of emergency days ago. Tons of businesses have been ordered to stay closed. The <a href=\"https:\/\/www.stltoday.com\/news\/national\/govt-and-politics\/north-carolina-s-largest-county-issues-stay-at-home-order\/article_12686261-2a31-54e4-a226-99721b13b366.html\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">largest county in North Carolina just issued a shelter in place order<\/a> and the sheriff of the second largest county says it isn&#8217;t an emergency situation. Protecting yourself and your family during a time of crisis is always an emergency situation if you don&#8217;t have the means to do it.<\/p>\n\n\n\n<p>While Sheriff Baker may think he has the power to unilaterally suspend taking applications, state law says otherwise.<\/p>\n\n\n\n<p> <a href=\"https:\/\/www.ncleg.gov\/EnactedLegislation\/Statutes\/PDF\/BySection\/Chapter_14\/GS_14-403.pdf\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">\u00a7 14-403 of the NC General Statutes<\/a> says in part:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p> The sheriffs of any and all counties of this State <strong>shall issue<\/strong> to any person, firm, or corporation in any county a permit to purchase or receive any weapon mentioned in this Article from any person, firm, or corporation offering to sell or dispose of the weapon.  <\/p><\/blockquote>\n\n\n\n<p> <a href=\"https:\/\/www.ncleg.gov\/EnactedLegislation\/Statutes\/PDF\/BySection\/Chapter_14\/GS_14-404.pdf\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">\u00a7 14-404. f<\/a>. goes on to say that the sheriff after doing the requisite background check has a limited time to deny or issue the permit.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p> Each applicant for a license or permit shall be informed by the sheriff <strong>within 14 days of the date of the application<\/strong> whether the license or permit will be granted or denied and, if granted, the license or permit <strong>shall be immediately issued<\/strong> to the applicant. <\/p><\/blockquote>\n\n\n\n<p>Nothing says a sheriff can suspend taking applications because &#8220;we are too busy.&#8221;<\/p>\n\n\n\n<p>State Senators Warren Daniel (R-Burke) and Danny Britt (R-Robeson) issued <a href=\"https:\/\/www.facebook.com\/maggie.sandrock\/posts\/3185348131497774\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">a statement<\/a> condemning Baker&#8217;s actions.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>State law requires a sheriff to approve or reject a pistol permit within 14 days.<\/p><p>Sheriff Baker must immediately rescind his illegal decision to halt the sale of pistols in Wake County<\/p><p>People are already suspicious and on edge. It\u2019s reckless to illegally suspend their Second Amendment rights just when they need assurance that they can trust government.<\/p><p>We will also be urging our colleagues in the legislature to take action during the short session to address this illegal behavior.<\/p><\/blockquote>\n\n\n\n<p><a href=\"https:\/\/www.supremecourt.gov\/opinions\/07pdf\/07-290.pdf\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">Justice Scalia in the <em>Heller <\/em>decision noted<\/a> that &#8220;the American people have considered the handgun to be the quintessential self-defense weapon.&#8221; Sheriff Baker&#8217;s unilateral decision runs afoul of court precedent as well as of black letter North Carolina law.<\/p>\n\n\n\n<p>The NRA-ILA was quick off the mark with an alert about Sheriff Baker&#8217;s actions.
