That&#8217;s because three of my favorite groups &#8211; Grass Roots North Carolina, the Second Amendment Foundation, and the Firearms Policy Coalition &#8211; have come together to file suit against Baker&#8217;s refusal to even take applications for the <a href=\"https:\/\/onlygunsandmoney.com\/2015\/06\/03\/an-act-to-regulate-sale-of-concealed.html\" class=\"rank-math-link\">Jim Crow<\/a>-era pistol purchase permit.<\/p>\n\n\n\n<p>For those that don&#8217;t know, in North Carolina, you need a pistol purchase permit to purchase a handgun regardless of whether it is from a dealer or a private individual unless you possess a NC Concealed Handgun Permit. As I&#8217;ve written about it many a time, <a href=\"https:\/\/onlygunsandmoney.com\/2015\/05\/19\/an-act-to-regulate-sale-of-concealed-2.html\" class=\"rank-math-link\">the law was passed in 1919<\/a> in an unspoken but well understood effort to keep African-Americans, Populists, and union backers disarmed.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.scribd.com\/document\/453578534\/Stafford-et-al-v-Baker\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">suit <\/a>has been filed in US District Court for the Eastern District of North Carolina. The individual plaintiff is Kerry Stafford who decided a handgun was the proper firearm with which to defend herself and her family. After calling the Wake County sheriff&#8217;s department for an PPP application, she was refused.<\/p>\n\n\n\n<p>The complaint alleges that Sheriff Baker has exceeded his discretion and has violated the Second and Fourteenth Amendments depriving Ms. Stafford and others of their constitutional rights under color of law. It asks that either an injunction be issued or that the requirement for a pistol purchase permit be waived until April 30th.<\/p>\n\n\n\n<p>It is great to see these groups working together. For GRNC and SAF, it is a reprise of the joint efforts that led to the <a href=\"https:\/\/onlygunsandmoney.com\/2012\/03\/29\/grass-roots-north-carolina-on-their-win.html\" class=\"rank-math-link\">win <\/a>in <a href=\"https:\/\/www.leagle.com\/decision\/inadvfdco130327000262\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\"><em>Bateman v. Perdue<\/em><\/a>.<\/p>\n\n\n\n<p>They <a class=\"rank-math-link\" href=\"https:\/\/www.saf.org\/saf-grass-roots-n-c-and-fpc-sue-n-c-sheriff-over-pistol-permit-holds\/\" target=\"_blank\" rel=\"noopener\">issued <\/a>a <a class=\"rank-math-link\" href=\"https:\/\/www.firearmspolicy.org\/nc-wake-county-stafford-vs-baker-lawsuit-filed\" target=\"_blank\" rel=\"noopener\">joint<\/a> <a href=\"https:\/\/www.grnc.org\/defend-your-rights\/press-releases\/1149-grnc-saf-fpc-file-federal-lawsuit-against-wake-county-nc-sheriff-over-constitutional-violations\" class=\"rank-math-link\" target=\"_blank\" rel=\"noopener\">release <\/a>which I have copied below:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><strong>GRNC, SAF, FPC File Federal Lawsuit Against Wake County, NC Sheriff Over Constitutional Violations<\/strong><\/p><p>RALEIGH, NC (March 27, 2020) \u00ad\u2014 Today, attorneys for an individual Wake County, North Carolina resident, Grass Roots North Carolina, Second Amendment Foundation (SAF), and Firearms Policy Coalition filed a federal lawsuit challenging Wake County Sheriff Gerald M. Baker\u2019s recent actions infringing on Second and Fourteenth Amendment rights he announced as a response to the COVID-19 coronavirus pandemic. Perdue<\/em>, also led by plaintiffs Second Amendment Foundation and Grass Roots North Carolina, which successfully challenged North Carolina statutes restricting firearms during states of emergency.<\/p><p>\u201cAlthough Sheriff Gerald Baker claims his refusal to accept applications for pistol purchase permits and concealed handgun permits doesn\u2019t infringe on individual rights, nothing could be further from the truth,\u201d said GRNC president Paul Valone. \u201cDuring this emergency, as always, GRNC intends to ensure that lawful North Carolinians have the means to protect themselves and their families.\u201d<\/p><p>\u201cSheriff Baker is implementing by fiat what the Supreme Court struck down in <em>Heller<\/em> \u2013 a ban on a citizen\u2019s right to purchase a handgun for the defense of hearth and home. This action cannot be allowed to stand,\u201d said GRNC Director of Legal Affairs Ed Green.<\/p><p>\u201cTimes of emergency is when you need the ability to obtain the means of self-defense the most. Suspending that right is not acceptable.
