Supreme Court has their conference on Fridays to examine which cases they wish to take and the ones they don&#8217;t. They announce the results on Monday in the Orders of the Court. Not all pending cases are sent to conference but those that are can be denied certiorari (or mandamus), accepted, or passed on to another week&#8217;s conference.<\/p>\n\n\n\n<p><a class=\"rank-math-link rank-math-link\" href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/051820zor_5he6.pdf\" target=\"_blank\" rel=\"noopener\"><strong>The Orders of the Court released this morning<\/strong><\/a> indicate that they punted all <a class=\"rank-math-link rank-math-link\" href=\"https:\/\/airtable.com\/shrcrC5FsedZqIi3T\/tblMclNyymYiklOOg\/viwM47ZZsFWQo69Vf\" target=\"_blank\" rel=\"noopener\"><strong>the major Second Amendment cases<\/strong><\/a> to the next week. The exception was <em><a class=\"rank-math-link rank-math-link\" href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/19-864.html\" target=\"_blank\" rel=\"noopener\"><strong>Bradley Beers v. Barr<\/strong><\/a><\/em> which dealt with the denial of Second Amendment rights to those who had been involuntarily committed no matter how long ago.<\/p>\n\n\n\n<p>In that case, the Supreme Court granted certiorari, vacated the judgment, and sent it back to the 3rd Circuit to dismiss as moot.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>The petition for a writ of certiorari is granted. The judgment is vacated, and the case is remanded to the United States Court of Appeals for the Third Circuit with instructions to dismiss the case as moot. See United States v. Munsingwear, Inc., 340 U. S. 36 (1950).<\/p><\/blockquote>\n\n\n\n<p>Unfortunately, I don&#8217;t know enough about the Beers case to say why the Supreme Court said it was moot.<\/p>\n\n\n\n<p>The Polite Society Podcast will have attorney <a class=\"rank-math-link rank-math-link\" href=\"https:\/\/mslegal.org\/staff\/cody-j-wisniewski-2-2\/\" target=\"_blank\" rel=\"noopener\"><strong>Cody Wisniewski<\/strong><\/a> of the <a class=\"rank-math-link rank-math-link\" href=\"https:\/\/mslegal.org\/\" target=\"_blank\" rel=\"noopener\"><strong>Mountain States Legal Foundation<\/strong><\/a> as our guest tonight. He will be discussing these potential cases and why he <a class=\"rank-math-link rank-math-link\" href=\"https:\/\/legalinsurrection.com\/2020\/05\/a-loss-or-a-win-reassessing-new-york-state-rifle-pistol-assn-v-city-of-new-york\/\" target=\"_blank\" rel=\"noopener\"><strong>considered the finding of moot in NYSRPA v City of New York<\/strong><\/a> was not the end of the world for 2A cases. Michelle Lujan Grisham (D-NM) to <a class=\"rank-math-link rank-math-link\" href=\"https:\/\/cv.nmhealth.org\/2020\/05\/15\/stay-at-home-order-extended\/\" target=\"_blank\" rel=\"noopener\"><strong>reopen <\/strong><\/a>some gun stores in that state.<\/p>\n\n\n\n<p><strong>UPDATE<\/strong>: Thanks to Rob at 2A Updates I have an answer as to why the Beers case was considered moot.
