There were a number of indictments including that of a captain in the Santa Clara Sheriff&#8217;s Office. However, Sheriff Smith herself was never charged. That has changed.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"450\" src=\"https:\/\/onlygunsandmoney.com\/wp-content\/uploads\/2021\/12\/SheriffLaurieSmith-300-4-stars.jpg\" alt=\"\" class=\"wp-image-31773\" srcset=\"https:\/\/onlygunsandmoney.com\/wp-content\/uploads\/2021\/12\/SheriffLaurieSmith-300-4-stars.jpg 300w, https:\/\/onlygunsandmoney.com\/wp-content\/uploads\/2021\/12\/SheriffLaurieSmith-300-4-stars-200x300.jpg 200w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/figure><\/div>\n\n\n\n<p>Yesterday, a civil grand jury in Santa Clara County returns seven indictments against Sheriff Smith. This is the <strong><a href=\"https:\/\/www.nbcbayarea.com\/investigations\/civil-grand-jury-accuses-santa-clara-county-sheriff-laurie-smith-of-corruption\/2756009\/\" target=\"_blank\" rel=\"noreferrer noopener\">California equivalent of an impeachment proceeding for a local official<\/a><\/strong>. She must appear in court to answer the indictments. If she wishes to contest them, a trial will be held. However, the only penalty she will face if found guilty is removal from office.<\/p>\n\n\n\n<p>As per custom, the local DA has recused himself from the case. Taking his place will be the <strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Chesa_Boudin\" target=\"_blank\" rel=\"noreferrer noopener\">infamous Soros-sponsored San Francisco DA Chesa Boudin<\/a><\/strong> who will handle the prosecution. Boudin is not fan of <strong><a href=\"https:\/\/apnews.com\/article\/31213873f5dbe43397c50982a46d3fbc\" target=\"_blank\" rel=\"noreferrer noopener\">law enforcement<\/a><\/strong>.<\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.kron4.com\/news\/bay-area\/santa-clara-county-civil-grand-jury-indicts-sheriff-laurie-smith-over-misconduct\/\" target=\"_blank\" rel=\"noreferrer noopener\">KRON reports<\/a><\/strong> the charges against Smith as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Count 1: Illegally issuing concealed carry weapon permits (CCW) to VIP\u2019s<\/em><\/li><li><em>Count 2: Failing to properly investigate whether non-VIP\u2019s should receive CCW permits<\/em><\/li><li><em>Count 3: Keeping non-VIP CCW applications pending indefinitely<\/em><\/li><li><em>Count 4: Illegally accepting suite tickets, food, and drinks at Sharks game<\/em><\/li><li><em>Count 5: Failing to report Sharks game gifts on financial documents<\/em><\/li><li><em>Count 6: Committing perjury by failing to disclose Sharks game gifts<\/em><\/li><li><em>Count 7: Failing to cooperate with internal affairs investigation surrounding treatment of Andrew Hogan<\/em><\/li><\/ul>\n\n\n\n<p>Note that Counts 1 to 3 all involve the issuance of concealed carry permits. Her behavior makes the case that may-issue concealed carry permits and their issuance are ripe for corruption. <strong><a href=\"https:\/\/www.nbcbayarea.com\/news\/local\/donors-to-sheriffs-political-campaigns-far-more-likely-to-get-concealed-gun-permits\/2309812\/\" target=\"_blank\" rel=\"noreferrer noopener\">As reported last year<\/a><\/strong>, if you were a big donor to Sheriff Smith, you had a 79% chance of getting your permit. If, however, you did not contribute to her campaign, you success rate was a mere 5.5%. While this is better than San Francisco, it is still abysmal. <\/p>\n\n\n\n<p>Sheriff Smith has been in office since December 1998. While California sheriff&#8217;s elections are <strong><a href=\"https:\/\/www.sheriffs.org\/sites\/default\/files\/uploads\/documents\/GovAffairs\/State-by-State%20Election%20Chart%20updated%2008.13.15.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">officially non-partisan<\/a><\/strong>, it is reported that she is a <strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Laurie_Smith\" target=\"_blank\" rel=\"noreferrer noopener\">Republican<\/a><\/strong>. <\/p>\n\n\n\n<p>Under California law, even if she is booted from office, Smith would not lose her pension. Public officials can <strong><a href=\"https:\/\/www.calpers.ca.gov\/page\/about\/laws-legislation-regulations\/public-employees-pension-reform-act\" target=\"_blank\" rel=\"noreferrer noopener\">only lose their pension benefits if convicted of a felony<\/a><\/strong> and only from the date of the commission of the felony. A rough estimate of her pension is $266,000 annually based upon her <strong><a href=\"https:\/\/transparentcalifornia.com\/salaries\/search\/?a=santa-clara-county&amp;q=laurie+smith&amp;y=2019\" target=\"_blank\" rel=\"noreferrer noopener\">last reported salary<\/a><\/strong> of $296,000. As I said this is a rough estimate and her actual retirement pay is probably considerably more. Other than avoiding the public shame of being removed from office, she has nothing really to lose by continuing in office.
