NAPERVILLE, IL., ET AL.<br>The application for a writ of injunction pending appeal<br>presented to Justice Barrett and by her referred to the Court is<br>denied.<\/p><\/blockquote>\n\n\n\n<p>While Judge Stephen McGlynn of the Southern District of Illinois <strong><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ilsd.94369\/gov.uscourts.ilsd.94369.45.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">had issued a preliminary injunction<\/a><\/strong>, the state of Illinois immediately appealed to the 7th Circuit Court of Appeals asking for a <strong><a href=\"https:\/\/illinoisattorneygeneral.gov\/Page-Attachments\/As-Filed_Barnett_Motion_To_Stay.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">stay <\/a><\/strong>of his injunction. Normally, the judge who had issued the injunction is given the opportunity to study whether a stay is warranted when the losing party appeals. This was not done in this case as <strong><a href=\"https:\/\/assets.nationbuilder.com\/firearmspolicycoalition\/pages\/6708\/attachments\/original\/1683670917\/Barnett_v_Raoul_FFL-IL_Opposition_to_Motion_to_Stay.pdf?1683670917\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a><\/strong> by <strong><a href=\"https:\/\/assets.nationbuilder.com\/firearmspolicycoalition\/pages\/6708\/attachments\/original\/1683674313\/Barnett_v_Raoul_Plaintiffs-Appellees&#039;_Response_to_Motion_to_Stay.pdf?1683674313\" target=\"_blank\" rel=\"noreferrer noopener\">attorneys<\/a><\/strong> for the <strong><a href=\"https:\/\/assets.nationbuilder.com\/firearmspolicycoalition\/pages\/6708\/attachments\/original\/1683687924\/Barnett_v_Raoul_Langley_Opposition_to_Motion_to_Stay.pdf?1683687924\" target=\"_blank\" rel=\"noreferrer noopener\">plaintiffs<\/a><\/strong> in their responses opposing the motion to stay. Unfortunately, Judge Frank Easterbrook of the 7th Circuit did grant their <strong><a href=\"https:\/\/assets.nationbuilder.com\/firearmspolicycoalition\/pages\/6708\/attachments\/original\/1683233454\/Barnett_v_Raoul_5-4_Order.pdf?1683233454\" target=\"_blank\" rel=\"noreferrer noopener\">stay <\/a><\/strong>meaning the law remains in effect. His order was then <strong><a href=\"https:\/\/cookcountyrecord.com\/stories\/642133288-seventh-circuit-il-assault-weapons-ban-to-remain-in-place-for-at-least-two-months\" target=\"_blank\" rel=\"noreferrer noopener\">confirmed <\/a><\/strong>by a panel of three judges (including himself) from the 7th Circuit.<\/p>\n\n\n\n<p>In the <strong><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ilnd.418943\/gov.uscourts.ilnd.418943.1.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">NAGR case<\/a><\/strong> filed in the Northern District of Illinois, Judge Virginia Kendall had <strong><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ilnd.418943\/gov.uscourts.ilnd.418943.73.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a><\/strong> their request for a preliminary motion and their request for a motion to stay while they appealed. Attorneys for NAGR had appealed and the plaintiffs in the other cases from the Southern District had filed amicus briefs in support of their appeal.<\/p>\n\n\n\n<p>I am thinking that the Supreme Court did not want to intervene until such time as decisions were final in the lower courts and the cases had been fully briefed and argued. In the meantime, the plaintiffs in the cases from the Southern District where an injunction had been issued could request an <em>en banc<\/em> hearing of the stay.
