Vullo. The court&#8217;s opinion was written by Justice Sonia Sotomayor. The full 31-page opinion is <strong><a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-842_6kg7.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a><\/strong>. Justices Gorsuch and Jackson had concurring opinions. The SCOTUS vacated the 2nd Circuit&#8217;s decision and remanded for further proceedings.<\/p>\n\n\n\n<p>From the opinion:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Six decades ago, this Court held that a government entity\u2019s \u201cthreat of invoking legal sanctions and other means of coercion\u201d against a third party \u201cto achieve the suppression\u201d of disfavored speech violates the First Amendment. Bantam Books, Inc. v. Sullivan, 372 U. S. 58, 67 (1963). Today, the Court reaffirms what it said then: Government officials cannot attempt to coerce private parties in order to punish or suppress views that the government disfavors. Petitioner National Rifle Association (NRA) plausibly alleges that respondent Maria Vullo did just that. As superintendent of the New York Department of Financial Services,<br>Vullo allegedly pressured regulated entities to help her stifle the NRA\u2019s pro-gun advocacy by threatening enforcement actions against those entities that refused to disassociate from the NRA and other gun-promotion advocacy groups. Those allegations, if true, state a First Amendment claim.<\/p>\n<\/blockquote>\n\n\n\n<p>I would see also <strong><a href=\"https:\/\/thereload.com\/supreme-court-unanimously-rules-new-york-violated-nras-first-amendment-rights\/\" target=\"_blank\" rel=\"noopener\">Stephen Gutowski&#8217;s report<\/a><\/strong> on this as it will be updated. Vista Outdoor <strong><a href=\"https:\/\/news.vistaoutdoor.com\/newsroom\/press-releases\/press-release-details\/2024\/Vista-Outdoor-Rejects-Unsolicited-Indication-of-Interest-from-MNC-Capital-b1e865a51\/default.aspx\" target=\"_blank\" rel=\"noopener\">rejected the revised offer from MNC Capital<\/a><\/strong> while <strong><a href=\"https:\/\/news.vistaoutdoor.com\/newsroom\/press-releases\/press-release-details\/2024\/Vista-Outdoor-Confirms-CSG-Increases-Purchase-Price-for-The-Kinetic-Group-Business-by-50-Million-to-1.96-Billion\/default.aspx\" target=\"_blank\" rel=\"noopener\">confirming their acceptance of the offer from Czechoslovak Group (CSG) for the Kinetic Group<\/a><\/strong> aka Vista&#8217;s ammo business. CSG has also increased their offer by $50 million which makes it a total of $1.96 billion. Assuming that the shareholders approve it and the Committee on Foreign Investment in the United States\u00a0allows the transaction to continue, Vista shareholders will receive one common share of Revelyst stock and a cash payment of $16 for every current share of Vista Outdoor owned.<\/p>\n\n\n\n<p>The <strong><a href=\"https:\/\/www.wsj.com\/politics\/national-security\/foreign-purchase-of-u-s-ammo-maker-sparks-national-security-battle-db31490d?st=2oeletshqcye8i2&amp;reflink=desktopwebshare_permalink\" target=\"_blank\" rel=\"noopener\">Wall Street Journal had a long article<\/a><\/strong> on this transaction on May 22nd. It paid particular attention to the objections of Sen. J. D. Vance (R-OH) and former Sec. of State Mike Pompeo.
