Raoul <\/em>on Tuesday. The case involves the ban by the State of Illinois on certain semi-automatic firearms as well as standard capacity magazines. The US District Court for the Southern District of Illinois had<strong><a href=\"https:\/\/michellawyers.com\/wp-content\/uploads\/2024\/12\/2024-12-09-Permanent-Injunction.pdf\" target=\"_blank\" rel=\"noopener\"> issued a permanent injunction <\/a><\/strong>against the enforcement of this ban and the state appealed against this judgment. Barnett is the lead case and is the amalgam of four different challenges to the state&#8217;s Protect Illinois Communities Act.<\/p>\n\n\n\n<p>What makes this case even more interesting than a usual AWB and mag ban case is that the US <strong><a href=\"https:\/\/www.justice.gov\/crt\/media\/1404361\/dl?inline\" target=\"_blank\" rel=\"noopener\">Department of Justice filed an amicus brief<\/a><\/strong> in support of the plaintiffs and was <strong><a href=\"https:\/\/michellawyers.com\/wp-content\/uploads\/2025\/09\/2025-09-05-Order-Granting-Mtn-of-US-to-Participate-in-Oral-Argument.pdf\" target=\"_blank\" rel=\"noopener\">given time<\/a><\/strong> in the oral arguments. <strong><a href=\"https:\/\/www.justice.gov\/crt\/staff-profile\/assistant-attorney-general\" target=\"_blank\" rel=\"noopener\">Harmeet Dhillon, Assistant Attorney General for Civil Rights<\/a><\/strong>, argued on behalf of the DOJ. <\/p>\n\n\n\n<p>The full oral arguments can be found <strong><a href=\"https:\/\/media.ca7.uscourts.gov\/sound\/external\/sk.24-3060.24-3060_09_22_2025.mp3\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/strong> The three judge panel consisted of Judges <strong><a href=\"https:\/\/www.fjc.gov\/history\/judges\/easterbrook-frank-hoover\" target=\"_blank\" rel=\"noopener\">Frank Easterbrook<\/a><\/strong>, <strong><a href=\"https:\/\/www.fjc.gov\/history\/judges\/brennan-michael-brian\" target=\"_blank\" rel=\"noopener\">Michael Brennan<\/a><\/strong>, and <strong><a href=\"https:\/\/www.fjc.gov\/history\/judges\/st-eve-amy-joan\" target=\"_blank\" rel=\"noopener\">Amy St. Eve<\/a><\/strong>.<\/p>\n\n\n\n<p>Involved in the case(s) since the beginning has been my good friend Todd Vandermyde. He and I had a long conversation about the case and the oral arguments earlier this week as he was in the courtroom. He has since put up an analysis of the case on his Freedom&#8217;s Steel YouTube channel. Most interesting was Todd&#8217;s analysis of what happens next depending on the opinion in the case. It could a win, it could be a win and the state appeals for an en banc hearing, it could be a split decision, or it could be a loss.
