He says that like it is a bad thing &#8211; which, of course, it isn&#8217;t.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The Trace recently updated its\u00a0<strong><a href=\"https:\/\/datahub.thetrace.org\/dataset\/court-decisions-based-on-bruen\/\" target=\"_blank\" rel=\"noreferrer noopener\">database<\/a>\u00a0<\/strong>of post-<em>Bruen<\/em>\u00a0challenges through May 2026, bringing the total to 3,327 rulings. The milestone underscores how thoroughly\u00a0<em>Bruen<\/em>\u00a0has\u00a0<strong><a href=\"https:\/\/www.thetrace.org\/projects\/bruen-tracker-supreme-court-gun-laws\/page\/2\/#:~:text=Law-,How%20the%20Supreme%20Court%20Broadened%20the%20Second%20Amendment,explain%20how%20it%20fundamentally%20changed%20our%20country%E2%80%99s%20approach%20to%20restricting%20guns.,-Chip%20Brownlee\" target=\"_blank\" rel=\"noopener\">reshaped<\/a>\u00a0<\/strong>federal gun litigation and fueled a surge in challenges to firearm restrictions across the country.\u00a0<\/p>\n<\/blockquote>\n\n\n\n<p>The truth of the matter is that most of these cases are criminal cases. While I might wish that they had all been civil cases challenging restrictions on Second Amendment rights, I cannot fault a criminal attorney from using everything at his or her disposal on behalf of a client.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Civil lawsuits have been fewer, but more consequential. Those cases \u2014 often brought by\u00a0<a href=\"https:\/\/www.thetrace.org\/2025\/06\/gun-rights-lawsuits-decline-bruen-trump\/\" target=\"_blank\" rel=\"noopener\"><strong>gun rights groups<\/strong><\/a>\u00a0or individual plaintiffs \u2014 tend to seek broader rulings against gun restrictions as a whole, rather than relief for a single defendant. Civil challenges have also been more successful, with judges invalidating gun regulations in 78 out of 279 rulings, or 28 percent.<\/p>\n\n\n\n<p>The outcomes in civil cases also show a\u00a0<a href=\"https:\/\/www.thetrace.org\/2024\/10\/judges-partisan-gun-cases-bruen-courts\/\" target=\"_blank\" rel=\"noopener\"><strong>sharp partisan divide<\/strong><\/a>. Republican-appointed judges ruled against gun regulations in 61 out of 137 rulings, or 45 percent. Democratic-appointed judges invalidated regulations in 14 out of 113 rulings, or 12 percent<\/p>\n<\/blockquote>\n\n\n\n<p>I did find it interesting that in civil cases challenging gun laws that Democrat-appointed judges overturned laws or regulations only 12 percent of the time. It is really true that they treat the Second Amendment like a second-class right. If it had been abortion, deportation of illegal aliens, or a Trump Administration executive order, that number would have been well over 50%. That said, one of the worst offenders in treating the Second Amendment like a second-class rights is Reagan-appointed Judge J. Harvie Wilkinson III of the 4th Circuit who, to my knowledge, has never rendered a positive ruling on the Second Amendment. He didn&#8217;t like <strong><a href=\"https:\/\/virginialawreview.org\/articles\/guns-abortions-and-unraveling-rule-law\/\" target=\"_blank\" rel=\"noopener\">Heller<\/a><\/strong> and his opinion in <strong><em>Bianchi <\/em><\/strong>was ridiculous.<\/p>\n\n\n\n<p>There are still some <strong><a href=\"https:\/\/www.scotusblog.com\/2026\/06\/the-supreme-court-and-the-right-to-bear-arms-an-explainer\/\" target=\"_blank\" rel=\"noopener\">AWB and magazine cases<\/a><\/strong> pending before the Supreme Court such as <em><strong><a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/25-198.html\" target=\"_blank\" rel=\"noopener\">Duncan v. Bonta<\/a><\/strong><\/em> and <strong><em><a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/25-238.html\" target=\"_blank\" rel=\"noopener\">Viramontes v. Cook County<\/a><\/em><\/strong> both of which were scheduled for conference this past week.
