{"id":5341,"date":"2010-07-15T03:27:00","date_gmt":"2010-07-15T03:27:00","guid":{"rendered":"https:\/\/onlygunsandmoney.com\/2010\/07\/15\/request-for-supplemental-briefing-in\/"},"modified":"2019-08-16T18:11:22","modified_gmt":"2019-08-16T18:11:22","slug":"request-for-supplemental-briefing-in","status":"publish","type":"post","link":"https:\/\/onlygunsandmoney.com\/?p=5341","title":{"rendered":"Request for Supplemental Briefing in Nordyke Case"},"content":{"rendered":"<p>Gene Hoffman of the CalGuns Foundations reports that the attorney for Nordyke, Donald Kilmer, has filed a request with the 9th Circuit for a <a href=\"http:\/\/www.hoffmang.com\/firearms\/Nordyke-v-King\/Motion-for-Supp-Brief-Filed-2010-07-13.pdf\" target=\"_blank\" rel=\"noopener\">supplemental briefing<\/a>.<\/p>\n<p>Kilmer argues in his brief that:<\/p>\n<blockquote><p><i>Among other issues that were resurrected in this case by<br \/>\nMcDonald, the County has never proffered any evidence that the<br \/>\nfairgrounds is a sensitive place. Because the Supreme Court was<br \/>\nunequivocal in its pronouncement that the Second Amendment is a<br \/>\nfundamental right \u2013 that must now be respected by state and local<br \/>\ngovernments \u2013 it is imperative that this Court put the County to its<br \/>\nconstitutional burdens of producing evidence (rather than conclusory<br \/>\nstatements) that they are addressing a compelling government interest<br \/>\nand that the County\u2019s means are narrowly tailored to that interest.<\/i><\/p><\/blockquote>\n<p>\nI don&#8217;t know whether they will allow this supplemental briefs or not.
