(October 26, 2017) \u2014 Today, counsel for civil rights advocacy<br \/>\norganizations Firearms Policy Coalition (FPC), Firearms Policy<br \/>\nFoundation (FPF), Madison Society Foundation (MSF) and Gun Owners of<br \/>\nCalifornia (GOC) filed a \u201cfriends of the court\u201d brief with the U.S.<br \/>\nSupreme Court encouraging their grant of review of a 9th Circuit ruling<br \/>\nthat upheld the state\u2019s 10-day waiting period.&nbsp;<\/i><\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<i>Attorney<br \/>\n Raymond M. DiGuiseppe, a former California deputy attorney general,<br \/>\nauthored the brief which argues, among other things, that Supreme Court<br \/>\nreview is necessary \u201cto reestablish the rule of law and halt the trend<br \/>\nof judicial obstructionism\u201d that is \u201cjeopardizing\u201d the constitutional<br \/>\nprotections of the Second Amendment.&nbsp;<\/i><\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<i>\u201cThis<br \/>\n is not the first time the Ninth Circuit has played \u2018fast and loose\u2019<br \/>\nwith the Court\u2019s Second Amendment jurisprudence to fend off<br \/>\nconstitutional claims \u2013 nor will it be the last if this Court does not<br \/>\nstep in,\u201d the brief said.<\/i><\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<i>\u201cToo<br \/>\n many times we have seen courts like the Ninth Circuit treat the Second<br \/>\nAmendment is if it was an unfortunate afterthought rather than a core<br \/>\npart of the Bill of Rights,\u201d noted Jonathan Jensen, FPF\u2019s vice-chairman.<br \/>\n \u201cThis case exemplifies everything that is wrong with Second Amendment<br \/>\njurisprudence today.\u201d<\/i><\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<i>Said<br \/>\n FPC Vice President Alan Normandy, \u201cThe State did not prove its case,<br \/>\nbut the 9th Circuit jumped through hoops to give them the win anyway.<br \/>\nThat kind of a foul ball undermines the integrity of the court system<br \/>\nitself.\u201d<\/i><\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<\/div>\n<\/div>\n<div>\n<div class=\"MsoNormal\">\n<i>\u201cAs<br \/>\n the Supreme Court has held, the Second Amendment is not a second-class<br \/>\nright,\u201d DiGuiseppe explained. \u201cUnfortunately, some lower courts have<br \/>\nused their relative inaction as a signal for defining it however they<br \/>\nprefer, even in contravention to the Court\u2019s precedents.
