Gov. Andrew Cuomo (D-NY) signed AB 5944 which removed the vague term &#8220;gravity knife&#8221; from the Penal Code. Cuomo had vetoed two previous passed bills which would have changed the law. He signed this bill in the face of both Federal court rulings and the realization that the Supreme Court probably would have changed the law anyway.<\/p>\n<p>From his <a href=\"https:\/\/www.governor.ny.gov\/sites\/governor.ny.gov\/files\/atoms\/files\/2019_Chapter_34.pdf\" target=\"_blank\" rel=\"noopener\">signing message<\/a>:<\/p>\n<blockquote class=\"tr_bq\"><p>\n<i>As I review this bill for a third time, the legal landscape has changed. In March of this<br \/>\nyear, the United States District Court for the Southern District ofNew York declared the State&#8217;s<br \/>\nexisting &#8220;gravity knife&#8221; ban unconstitutional. As argued by many who have advocated for this<br \/>\nchange in law, the court reasoned that the existing law could result in arbitrary and<br \/>\ndiscriminatory enforcement.<\/i><br \/>\n<i><br \/><\/i><br \/>\n<i>While I remain aware of the cautious community voices, I cannot veto a bill passed by<br \/>\nthe Legislature to address a decided constitutional infmnity in existing law, as recently affirmed<br \/>\nby a federal court. I remain confident that our law enforcement community will continue to keep<br \/>\nour communities safe by pursuing anyone who uses, or attempts to use, one of these knives in an<br \/>\nunlawful manner.<\/i><\/p><\/blockquote>\n<p>This is a huge win for Knife Rights who have been fighting in both the courts and in the New York State Assembly and Senate to rectify the injustices caused by the prior knife law. It is also a big loss for New York District Attorney Cyrus Vance Jr. who used the Penal Code to charge way too many honest people with violations of the gravity knife ban and who also used it to shake down a number of businesses.<\/p>\n<p>Knife Rights was assisted in this battle by the New York Legal Aid Society whom they recognized in their <a href=\"https:\/\/kniferights.org\/legislative-update\/a-knife-rights-victory-freedom-finally-wins-in-new-york\/\" target=\"_blank\" rel=\"noopener\">statement <\/a>below. Cuomo previously vetoed<br \/>\ntwo similar bills which Knife Rights Director of Legislative Affairs,<br \/>\nTodd Rathner, also worked on tirelessly in Albany.<\/strong><\/p><\/blockquote>\n<blockquote><p>\n<strong>Although the<br \/>\nbill leaves the definition of a gravity knife intact, the statutory<br \/>\nrepeals make the knives legal, stripping New York City and District<br \/>\nAttorney Cyrus Vance, Jr. of their ability to continue to abuse the<br \/>\ndefinition of a gravity knife and continue to arrest and prosecute<br \/>\npeople by claiming a common lock blade folding knife or utility knife is<br \/>\n an illegal gravity knife<\/strong><\/p><\/blockquote>\n<blockquote><p>\n<strong>The repeal is effective immediately.<\/strong><\/p><\/blockquote>\n<blockquote><p>\nKnife Rights Chairman Doug Ritter said, &#8220;After nine years fighting, it<br \/>\nis a relief to close the book on this extraordinary abuse of authority<br \/>\nby a corrupt system that has terrorized over 70,000 honest, law-abiding<br \/>\npeople, disproportionately minorities, for simply carrying a common tool<br \/>\n used daily in their lives. That possibility was so concerning that even DA Vance, who<br \/>\npreviously steadfastly opposed any reasonable solution and who is a<br \/>\nclose confidant of Gov. But, despite its serious limitations<br \/>\nand the fact that NYC and Vance were working around it, that decision<br \/>\nprovided some public cover for Cuomo and Vance without revealing their<br \/>\nreal fear, losing at the Supreme Court in our case. They hope the<br \/>\nsigning of this bill will moot our case.<\/p><\/blockquote>\n<blockquote><p>\nEven better for Vance,<br \/>\nif they don&#8217;t lose to us in court, Vance won&#8217;t be forced to pay our<br \/>\nmillion dollar legal bills for eight years of Federal litigation, which<br \/>\nhe&#8217;d consider doubly painful on top of the embarrassing loss he&#8217;s<br \/>\nfacing.
