We just interviewed gunsmith Joseph LaJoy of <a href=\"http:\/\/www.lajoyprecision.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">LaJoy Precision<\/a> on Friday night for the <a href=\"http:\/\/politicsandguns.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Polite Society Podcast<\/a> on this very issue. Activities listed as manufacturing and thus subject to ITAR include traditional gunsmithing activities such as threading a barrel or reaming a new chamber. Gunsmiths will now have to pay an annual fee of $2,250 if they do something as simple as that or face massive fines and\/or imprisonment. We concluded the rationale behind this &#8220;guidance&#8221; was to attack the gun culture and to drive gunsmiths out of business.<\/p>\n<p>Joseph LaJoy said in the interview that he wished groups like the National Shooting Sports Foundation would get involved in the issue. Under the<br \/>\nlaw, registration is required even if the manufacturer does not export<br \/>\nand even if the manufacturer makes component parts.<\/span><span style=\"font-family: Arial;\"><\/p>\n<p>DDTC<br \/>\n asserts that the guidance merely restates existing DDTC policy and<br \/>\ninterpretation of the AECA and ITAR manufacturer registration<br \/>\nrequirement.<\/span><span style=\"font-family: Arial;\"><\/p>\n<p>Unfortunately,<br \/>\n DDTC\u2019s \u201cguidance\u201d has created considerable and understandable confusion<br \/>\n and concern among gunsmiths and gun owners. The National Shooting<br \/>\nSports Foundation (NSSF) is reviewing the guidance and will send a<br \/>\nletter of protest to DDTC expressing our strong opposition to the new<br \/>\n\u201cguidance,\u201d the scope of which clearly exceeds their statutory<br \/>\nauthority. The term \u201cmanufacture\u201d as used in the AECA and ITAR is its<br \/>\nordinary dictionary definition. Clearly, many of the activities DDTC<br \/>\nclaims require registration constitutes gun smithing and is not<br \/>\nmanufacturing under any reasonable dictionary definition of the term.<br \/>\nDDTC\u2019s position is similar to claiming an auto mechanic who fixes your<br \/>\ncar is a car manufacturer.<\/span><span style=\"font-family: Arial;\"><\/p>\n<p>NSSF<br \/>\n has been working diligently for many years to eliminate, or at least<br \/>\nsignificantly lower, the excessive and burdensome registration fee<br \/>\nespecially for non-exporting manufacturers and non-essential component<br \/>\nparts manufacturers. Simply put, forcing small manufacturer to pay<br \/>\n$2,250 annually to register when they are not utilizing the DDTC export<br \/>\nlicensing system to export products is an unfair and onerous regulatory<br \/>\nburden. This is even more outrageous when one considers that DDTC is<br \/>\nsitting on at least $140 million dollars of previously paid registration<br \/>\n fees collected over many years from exporters from many industries<br \/>\nincluding ours.<\/span><span style=\"font-family: Arial;\"><\/p>\n<p>Additionally,<br \/>\n we have been working with allies in Congress to pressure the Obama<br \/>\nadministration to complete the Export Control Reform (ECR) initiative,<br \/>\nwhich would with limited exceptions do away with the AECA and ITAR<br \/>\nmanufacturer registration requirement and onerous fee for commercial and<br \/>\n sporting firearms.<\/span><span style=\"font-family: Arial;\"><\/p>\n<p>To<br \/>\n date, the Obama Administration has refused to publish and implement the<br \/>\n regulatory changes necessary to transfer for export licensing of<br \/>\ncommercial and sporting firearms and ammunition products to the<br \/>\nDepartment of Commerce from the Department of State.&nbsp;<\/span><span style=\"font-family: Arial;\"><b><a href=\"http:\/\/r20.rs6.net\/tn.jsp?f=001PMZmo3ldbPO1sMiSup_LngEjAgLpRKCkWfth-jI1F4ncqumi_FjHqEUQjI6oYywrou48b2DJ48YwRAITQM4tcoNJm5D91r8zKE27nDJedB5VymZEg-3_kPIyV1E3ZqqvePqCK5AF6qDtUBaoDCY7KUkdRUKwg98GVoh3ttAFAZlRoL0gEPAI75uZjrXOx1OD96LMBq8bdNU=&amp;c=bcrG-8Q9q5gujVSsQswoOK7I0ufxon_M4Ymfih2IFo6TmJgFoBB4WQ==&amp;ch=6niBR6-cosUpgOHkjCQ35gZv800b-8cctjJscntJm8Vbq0W8HIu_LQ==\" target=\"_blank\" rel=\"noopener\">Read more<\/a><\/b><\/span><span style=\"font-family: Arial;\">&nbsp;on<br \/>\n Export Control Reform. Yet, the proposed rules have been drafted and<br \/>\nready for publication since December 2012. Inaction persists despite<br \/>\ncongressional testimony and letters to members of the U.S. House and the<br \/>\n Senate that they would publish the rules.<\/span><span style=\"font-family: Arial;\"><\/p>\n<p>Why<br \/>\n has the Obama administration refused to move ECR forward for our<br \/>\nindustry? It is really very simple. The Obama Administration is singling<br \/>\n out our industry for different treatment under the ECR because of its<br \/>\ngun control politics. It is time to force Congress to step in and stop<br \/>\nthe Obama Administration\u2019s gun control agenda from stopping this needed<br \/>\nreform.
