I imagine most people by now have heard about President Biden’s speech where he said you needed F-15s and nukes to take on the US government. Of course there are always those naysayers ranging from the Viet Cong to the Taliban to just about everyone in the gun culture.

The memes have abounded as social media has shown.

Palmetto State Armory is going one step beyond the memes. They are now offering “Tyranny-15” stripped AR lowers for pre-sale.

It is a pre-order item going for $79.99 with about a 12 week lead time.

I have to hand it to them. This is about as in your face as it gets from its name to the engravings. Even the serial number string of TJEFFERSON xxxx recalls Thomas Jefferson’s 1787 “Tree of Liberty” letter where he said the “the tree of liberty must be refreshed from time to time with the blood of patriots and tyrants.” This was the quotation that Biden mangled in his speech.

Now to a serious comment. I do sincerely believe that Joe Biden is showing age-related cognitive decline. I see similar behaviors to what I saw in my own mother who suffered from dementia for years before she passed away. However, while we can laugh and make fun of Biden’s speech, we need to realize that it will be his authoritarian administration using the jack-booted thugs of BATFE (potentially led by Chipman) and other agencies carrying out these anti-self defense policies. They are not demented and they are evil and they will use lawfare. If lawfare fails, they will use deadly force backed by false narratives parroted by a compliant media. Biden’s speech was the side-show; the implementation of these evil policies will be the main event.

Judiciary Committee To Vote On Chipman Thursday

The Senate Judiciary Committee’s agenda for Thursday, June 17th, includes a vote of a number of nominees. Key among these will be David Chipman to be director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives.

If it goes as expected, the Judiciary Committee will have a tie vote with all Democrats voting for him and all Republicans voting against him. A tie vote would not normally result in a nominee being discharged from the committee. However, under the power sharing arrangement of the 117th Senate, Sen. Dick Durbin (D-IL) as committee chair will report the tie vote to Sen. Chuck Schumer (D-NY) and Sen. Mitch McConnell (R-KY). Either of those two after consulting both Durbin and Ranking Member Chuck Grassley (R-IA) can then make a discharge motion to bring the nomination to the floor of the Senate for a vote.

This makes it all the more important that pressure be put on any wavering Republican such as Collins and Murkowski as well as on Democrats such as Sen. Joe Manchin (D-WV), Sen. Jon Tester (D-MT), and Sen. Krysten Sinema (D-AZ) to vote no on Chipman.

The US Senate’s switchboard can forward your call to any Senator’s office. That number is 202-224-3121. I would call the DC offices of my senators as well as the local offices in their home states. If you plan to call any of the wavering senators, I’m not saying to make up an address but if you have relatives in that state, I’d use it.

DOJ Pushes Red Flag Laws Plus Pistol Brace Rule

We knew something was coming out on pistol braces as it has been signaled for a while now. The Department of Justice just released their notice of proposed rulemaking on pistol braces and have also said they will provide states with model “extreme violence protection order” legislation. The rule, if adopted, would make AR pistols with pistol braces an NRA item. I guess those who need a brace to shoot an AR pistol due to war wounds or other disabilities need to cough up $200. Evidently, DOJ doesn’t consider that the Americans with Disabilities Act applies to the BATFE nor to wounded veterans.

Justice Department Issues Proposed Rule and Model Legislation to Reduce Gun Violence

New Steps Would Enhance Enforcement of the National Firearms Act and Aid States in Drafting “Extreme Risk Protection Order” Laws

Today, the Department of Justice announced two new steps to help address the continuing epidemic of gun violence affecting communities across the country. First, the department issued a notice of proposed rulemaking that makes clear that when individuals use accessories to convert pistols into short-barreled rifles, they must comply with the heightened regulations on those dangerous and easily concealable weapons. Second, the department published model legislation to help states craft their own “extreme risk protection order” laws, sometimes called “red flag” laws. By sending the proposed rule to the Federal Register and publishing the model legislation today, the department has met the deadlines that the Attorney General announced alongside President Biden in April. 

“The Justice Department is determined to take concrete steps to reduce the tragic toll of gun violence in our communities,” said Attorney General Merrick B. Garland. “Today we continue to deliver on our promise to help save lives while protecting the rights of law-abiding Americans. We welcome the opportunity to work with communities in the weeks and months ahead in our shared commitment to end gun violence.”

The department issued a notice of proposed rulemaking that would make clear that the statutory restrictions on short-barreled rifles apply to pistols that are equipped with certain stabilizing braces and intended to be fired from the shoulder. The National Firearms Act imposes heightened regulations on short-barreled rifles because they are easily concealable, can cause great damage, and are more likely to be used to commit crimes. But companies now sell accessories that make it easy for people to convert pistols into these more dangerous weapons without going through the statute’s background check and registration requirements. These requirements are important public safety measures because they regulate the transfer of these dangerous weapons and help ensure they do not end up in the wrong hands. The proposed rule would clarify when these attached accessories convert pistols into weapons covered by these heightened regulations.

The department also published model legislation and detailed commentary that will make it easier for states to craft “extreme risk protection orders” authorizing courts to temporarily bar people in crisis from accessing firearms. By allowing family members or law enforcement to intervene and to petition for these orders before warning signs turn into tragedy, “extreme risk protection orders” can save lives. They are also an evidence-based approach to the problem. The model legislation, developed after consultation with a broad range of stakeholders, provides a framework that will help more states enact these sensible laws.

There is so much bull shit in the paragraph on pistol braces that it would keep most farms fertilized for generations.

As to the legality of it, I really don’t see how they can square it with the 6th Circuit’s ruling in GOA v. Garland in which that court found that only Congress can change definitions like this when a criminal penalty is involved. Trump really screwed up things when he pushed DOJ to ban bump stocks.

As to Merrick Garland, I owe Sen. Mitch McConnell (R-KY) a big thanks for keeping him off the US Supreme Court.

David Chipman Nomination Hearing Today

The Senate Judiciary Committee will hold a hearing today on the nomination of David Chipman, Joe Biden’s slap in the face to gun owners, to be the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives. As he is lumped in with a few other nominees for various positions, I’m not sure what time his nomination hearing will actually be held but the live stream starts at 10 am.

I expect Chipman to be asked fawning questions by Democrats such as Sen. Dianne Feinstein (D-CA) and Sen. Richard Blumenthal (D-CT) and equally tough questions by Sen. Ted Cruz (R-TX) and Sen. Tom Cotton (R-AR). I think the final outcome will be a split vote with all Democrats voting to pass his nomination to the floor and every Republican voting against it.

It goes without saying that you should have contacted your own senators before today to voice your opposition to Chipman. I have sent both personal emails and the auto-generated emails in opposition to Chipman whose nomination to head BATFE is the equivalent of nominating an avowed vegan to head the meat inspection division of the Ag Department.

If you live the states of West Virginia or Arizona, I hope you have been putting a lot of pressure on Sen. Joe Manchin (D-WV) and Sen. Krysten Sinema (D-AZ) to oppose the nomination. The Democrats haven’t done away with the filibuster yet but even if they go to the “nuclear option” there is some hope that one or both of these senators would vote against Chipman.

In the meantime, it is now time to start making the calls.

Grass Roots North Carolina released an alert aimed at North Carolinians which also suggests contacting Sen. Mitch McConnell. It includes a way to get around McConnell’s web form’s rejection of out-of-state comments.

He didn’t care about the children burned to death at Waco, no doubt he doesn’t care about your safety either. What kind of a nut would confirm someone who is against YOUR right to keep and bear firearms to head up the ATF?

A stronger deadbolt is a road bump to disaster if you have no means to protect yourself from the criminal kicking in your door-or breaking your window.

A Tale In Three Pictures

Do you recognize either the man or the location of the remnants of this fire?

Here let me give you a hint on the location.

Yes, that is the Branch Davidian compound in Mount Carmel outside of Waco, Texas as it is going up in flames. 76 men, women, and children died in that fire. The siege began when agents from the Bureau of Alcohol, Tobacco, and Firearms raided the compound on February 28, 1993. 12 surviving members of the Branch Davidians were later tried on a variety of firearm offenses. The young man standing in the ashes holding what appears to be a M16 M14 was the ATF case officer for the trial.

The White House just posted the proposed Executive Actions along with their intent to nominate David Chipman to head BATFE.

It has all the stuff we’ve been expecting.

“Ghost guns” (sic). Check.

Pistol braces under NFA. Check.

Red flag law. Check.

Infrastructure monies to “community violence intervention.” Check.

So you don’t have to go and pull it up, here is it in its entirety.

Today, the Biden-Harris Administration is announcing six initial actions to address the gun violence public health epidemic. The recent high-profile mass shootings in Boulder – taking the lives of 10 individuals – and Atlanta – taking the lives of eight individuals, including six Asian American women – underscored the relentlessness of this epidemic. Gun violence takes lives and leaves a lasting legacy of trauma in communities every single day in this country, even when it is not on the nightly news. In fact, cities across the country are in the midst of a historic spike in homicides, violence that disproportionately impacts Black and brown Americans. The President is committed to taking action to reduce all forms of gun violence – community violence, mass shootings, domestic violence, and suicide by firearm.

President Biden is reiterating his call for Congress to pass legislation to reduce gun violence. Last month, a bipartisan coalition in the House passed two bills to close loopholes in the gun background check system. Congress should close those loopholes and go further, including by closing “boyfriend” and stalking loopholes that currently allow people found by the courts to be abusers to possess firearms, banning assault weapons and high capacity magazines, repealing gun manufacturers’ immunity from liability, and investing in evidence-based community violence interventions. Congress should also pass an appropriate national “red flag” law, as well as legislation incentivizing states to pass “red flag” laws of their own.

But this Administration will not wait for Congress to act to take its own steps – fully within the Administration’s authority and the Second Amendment – to save lives. Today, the Administration is announcing the following six initial actions:

The Justice Department, within 30 days, will issue a proposed rule to help stop the proliferation of “ghost guns.” We are experiencing a growing problem: criminals are buying kits containing nearly all of the components and directions for finishing a firearm within as little as 30 minutes and using these firearms to commit crimes. When these firearms turn up at crime scenes, they often cannot be traced by law enforcement due to the lack of a serial number. The Justice Department will issue a proposed rule to help stop the proliferation of these firearms.

The Justice Department, within 60 days, will issue a proposed rule to make clear when a device marketed as a stabilizing brace effectively turns a pistol into a short-barreled rifle subject to the requirements of the National Firearms Act. The alleged shooter in the Boulder tragedy last month appears to have used a pistol with an arm brace, which can make a firearm more stable and accurate while still being concealable.

The Justice Department, within 60 days, will publish model “red flag” legislation for states. Red flag laws allow family members or law enforcement to petition for a court order temporarily barring people in crisis from accessing firearms if they present a danger to themselves or others. The President urges Congress to pass an appropriate national “red flag” law, as well as legislation incentivizing states to pass “red flag” laws of their own. In the interim, the Justice Department’s published model legislation will make it easier for states that want to adopt red flag laws to do so.

The Administration is investing in evidence-based community violence interventions. Community violence interventions are proven strategies for reducing gun violence in urban communities through tools other than incarceration. Because cities across the country are experiencing a historic spike in homicides, the Biden-Harris Administration is taking a number of steps to prioritize investment in community violence interventions.

* The American Jobs Plan proposes a $5 billion investment over eight years to support community violence intervention programs. A key part of community violence intervention strategies is to help connect individuals to job training and job opportunities.

* The U.S. Department of Health and Human Services is organizing a webinar and toolkit to educate states on how they can use Medicaid to reimburse certain community violence intervention programs, like Hospital-Based Violence Interventions.

* Five federal agencies are making changes to 26 different programs to direct vital support to community violence intervention programs as quickly as possible. These changes mean we can start increasing investments in community violence interventions as we wait on Congress to appropriate additional funds.

The Justice Department will issue an annual report on firearms trafficking. In 2000, the Bureau of Alcohol, Tobacco, and Firearms (ATF) issued a report summarizing information regarding its investigations into firearms trafficking, which is one way firearms are diverted into the illegal market where they can easily end up in the hands of dangerous individuals. Since the report’s publication, states, local, and federal policymakers have relied on its data to better thwart the common channels of firearms trafficking. But there is good reason to believe that firearms trafficking channels have changed since 2000, for example due to the emergence of online sales and proliferation of “ghost guns.” The Justice Department will issue a new, comprehensive report on firearms trafficking and annual updates necessary to give policymakers the information they need to help address firearms trafficking today.

The President will nominate David Chipman to serve as Director of the Bureau of Alcohol, Tobacco, and Firearms. ATF is the key agency enforcing our gun laws, and it needs a confirmed director in order to do the job to the best of its ability. But ATF has not had a confirmed director since 2015. Chipman served at ATF for 25 years and now works to advance commonsense gun safety laws.

I’m surprised that they didn’t add a PS saying, “Fuck you, all you bitter clingers.”

I fully expect each and every one of these proposals to be fought in the courts. If it was good enough for President Trump’s immigration Executive Actions, it is good enough for this.

As to Chipman, you damn well better start calling your senators. Filibuster or no filibuster, he must be stopped.

David Chipman As Head Of ATF? WTF!

President Joe Biden is reportedly going to nominate David Chipman to be the next Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives. For those who are unaware of Chipman, he is a senior policy advisor for the Cult of Personality known as Giffords. He retired nine years ago as a Special Agent with BATFE. He has since become like a trained seal that the gun prohibitionists trot out anytime there is a hearing on gun control.

According to LinkedIn, Chipman’s last position was as Chief of the Liaison Division, Office of Public and Governmental Affairs. He was there for all of six months. The liaison division for the uninitiated is the lobbying arm of BATFE. So Slow Joe is planning on nominating a lobbyist to head BATFE. It figures.

Here is his self-reported history with BATFE. As you can see, he spent a good part of his career in administrative support or policy roles.

Within a couple of months of retiring from BATFE, Chipman had secured a position with Michael Bloomberg’s Everytown.

You may remember Andrew Traver. He was President Obama’s first pick to head BATFE. His nomination went nowhere and his nomination was eventually withdrawn. When he was nominated, Traver was Special Agent in Charge of the Chicago Field Division. Unlike Chipman, Traver’s gun control bonafides were only suspected and not confirmed.

Chipman’s nomination to head BATFE is not only bad but it is a slap in the face to every one of America’s gun owners. I rarely resort to profanity on this blog but Chipman’s presumed nomination has me saying, “Are you fucking kidding me?” There is no way in hell that a BATFE with Chipman in charge will be a responsible law enforcement agency upholding both the law and the Constitution.

One last thing about Chipman that I always found strange. Rarely, if ever, do you see a person’s high school listed on schools attended on a professional LinkedIn profile. Chipman, however, not only lists his high school but wants you to know that he went to the uber-connected and prestigious Phillips Exeter Academy.

Is That Like Double Secret Probation?

Not wasting any time in not letting a tragedy go to waste, there have been renewed calls for more gun control after the murders in Boulder, Colorado. The usual suspects have weighed in as has President Biden.

President Biden is calling on the Senate to pass both so-called universal background checks and an assault weapons (sic).

President Biden on Tuesday implored the Senate to pass new gun control measures in the wake of a mass shooting that left 10 dead in Boulder, Colorado, this week.

Biden said he didn’t “want to wait another minute, let alone an hour,” to act on gun violence.

He urged the House and Senate to ban “assault weapons,” as he said he did as a senator.

“I got that done as a senator. It brought down mass shootings, we can do it again,” Biden said. “We can ban assault weapons and high-capacity magazines in this country once again.”…

The president also called on the Senate to pass two House bills that closed loopholes on background checks, including the Charleston loophole.

“These are bills that received votes with both Republicans and Democrats in the House. This is not and should not be a partisan issue. This is an American issue that will save lives, American lives. And we have to act. We should also ban assault weapons in the process,” Biden said. 

So if I understand Biden and the gun control cabal correctly, if only there was a ban on high capacity magazines and guns with cosmetics they don’t like as well as a background check on every gun transfer then we would not have another mass murder?

Sounds great until you take into account two facts that completely blow away their arguments.

Fact 1: Colorado has background checks on all firearms transfers, both public and private.

Fact 2: Colorado passed a 15-round limit on magazines back in 2013. Now it is my understanding that the Colorado Supreme Court may have invalidated that ban.

We don’t know yet how the murderer obtained the firearm at this time. Even with a ban in place, an angry, paranoid person such as this murderer is reputed to be would not let violating a gun control law stand in the way of something doing something heinous.

One last thing. I’m not a conspiracy theorist but sometimes life feels like a Matt Bracken novel where the killer is merely a pawn for more government control.

The Next Battle Has Begun – Salvo Two

The next salvo in this battle came yesterday from Joe Biden. After bemoaning the lives lost to “gun violence” (sic), he lists a number of “commonsense” items that will solve the issue and “make us safer.”

Three years ago today, a lone gunman took the lives of 14 students and three educators at Marjory Stoneman Douglas High School in Parkland, Florida. In seconds, the lives of dozens of families, and the life of an American community, were changed forever.

For three years now, the Parkland families have spent birthdays and holidays without their loved ones. They’ve missed out on the experience of sending their children off to college or seeing them on their first job after high school. Like far too many families, they’ve had to bury pieces of their soul deep within the Earth. Like far too many families — and, indeed, like our nation — they’ve been left to wonder whether things would ever be okay.

These families are not alone. In big cities and small towns. In schools and shopping malls. In churches, mosques, synagogues, and temples. In movie theaters and concert halls. On city street corners that will never get a mention on the evening news. All across our nation, parents, spouses, children, siblings, and friends have known the pain of losing a loved one to gun violence. And in this season of so much loss, last year’s historic increase in homicides across America, including the gun violence disproportionately devastating Black and Brown individuals in our cities, has added to the number of empty seats at our kitchen tables. Today, as we mourn with the Parkland community, we mourn for all who have lost loved ones to gun violence.

Over these three years, the Parkland families have taught all of us something profound. Time and again, they have showed us how we can turn our grief into purpose – to march, organize, and build a strong, inclusive, and durable movement for change.

The Parkland students and so many other young people across the country who have experienced gun violence are carrying forward the history of the American journey. It is a history written by young people in each generation who challenged prevailing dogma to demand a simple truth: we can do better. And we will.

This Administration will not wait for the next mass shooting to heed that call. We will take action to end our epidemic of gun violence and make our schools and communities safer. Today, I am calling on Congress to enact commonsense gun law reforms, including requiring background checks on all gun sales, banning assault weapons and high-capacity magazines, and eliminating immunity for gun manufacturers who knowingly put weapons of war on our streets. We owe it to all those we’ve lost and to all those left behind to grieve to make a change. The time to act is now.

Here is an inconvenient truth that Mr. Biden will never acknowledge. It was the policies of the Obama-Biden Administration that created the circumstances that allowed a troubled, angry, and violent young man to stay off the radar and pass a NICS check.

And since we are talking about the deaths of those with brown skin, it was also the policies of the Obama-Biden Administration with Operation Fast and Furious aka Project Gunwalker that sent thousands of weapons south of the border which led to the deaths of at least 300 Mexican nationals.
