NC Republicans Waffle on Pistol Purchase Permit Fix

In a year in which we saw the state of Iowa ditch their requirement for a pistol purchase permit, the Republicans in the North Carolina General Assembly still are kowtowing to the NC Sheriffs Association. Certain sheriffs in North Carolina have been obstructing the issuance of pistol purchase permits since the beginning of the pandemic.

A simple bill, HB 398, would provide citizens of a county an alternative where their sheriff has been one of these obstructionists. It simply allows them to apply for a permit in an adjoining county. So, for example, a citizen of Wake County, where Sheriff Gerald Baker has been such an obstructionist that he is being sued in US District court, could apply for a permit in one of the seven adjoining counties. This bill is a mere tweak to a Jim Crow law that should have been ditched years ago. Notwithstanding that the sheriffs of the seven largest counties in the state are all African-American who you would think would want such a racist law abolished, the NC Sheriffs Association seems to be objecting to such a fix. That has the GOP in the General Assembly – or some of them – caving.

Grass Roots North Carolina has fought the issue for over 20 years. They just issued an alert after HB 398 was removed from a hearing calendar.

NC SHERIFFS EFFECTIVELY SAY ‘POUND SAND’
In the early months of the pandemic, GRNC began receiving complaints of abuse of the NC pistol purchase permit system by sheriffs in Wake and Mecklenburg counties and elsewhere. Wake County Sheriff Gerald Baker even tried to stop issuing permits altogether…until GRNC and two other organizations sued him. Yet despite even this, purchase permit and concealed handgun applicants are reporting multi-month delays in scheduling appointments for permits.

NC Sheriffs effectively say ‘pound sand’ GRNC has been trying to repeal the Jim Crow-era purchase permit law for 20+ years, even getting a repeal through the NC Senate in 2014. Unfortunately, each time we have encountered opposition from the powerful NC Sheriffs Association (NCSA).

In the interest of getting permits into the hands of applicants until we can fully repeal the law, Representative Jay Adams (R-Catawba, GRNC ****) introduced HB 398, a simple bill to at least allow applicants to apply in counties adjoining their county of residence if their own sheriff is being obstructionist. 

The bill was calendared for a hearing last Wednesday…until, apparently, the Sheriffs’ association objected to even that minor change. Then Judiciary 4 Committee Chair Hugh Blackwell (R-Burke) pulled it from the calendar at the last minute, claiming leadership planned to “improve” the bill, but not telling anyone what the “improvements” might be, suggesting that Republicans might once again be caving to the NCSA

You must stop obstruction of NC pistol purchase permits and the resulting denial of citizens’ rights by returning House Bill 398 to the House calendar for immediate action.

Using COVID-19 and increased permit applications as an excuse, sheriffs in Wake and Mecklenburg counties, among others, are obstructing pistol purchase permits and concealed handgun permits, often taking months to schedule appointments for applications, even in the face of multiple lawsuits filed by Grass Roots North Carolina and others.
For years, sheriffs have objected to repealing our Jim Crow-era pistol purchase permit law – a racist law passed to prevent minorities from buying guns for self-protection. Now we are encountering resistance even to a small and simple change which would allow permit applicants to bypass obstructionist sheriffs by applying in adjacent counties.

Enough is enough. Citizens have been denied their right to purchase handguns for self-protection for entirely too long. In the 2020 elections, gun voters supported you because they expect you to protect and defend the Second Amendment. 

It is now time for you to do what we elected you to do by passing House Bill 398. Additionally, please advise me of your position on this issue. I will be monitoring your actions through Grass Roots North Carolina legislative alerts.

Sheriff Gerald Baker Allowed To Slow Walk Permits

Wake County Superior Court Judge Bryan Collins has denied Grass Roots North Carolina’s lawsuit motion for temporary restraining order against Wake Sheriff Gerald Baker over dragging his feet on the processing of pistol purchase and concealed handgun permits. The law states that the sheriff must issue pistol purchase permits within 14 days but Baker’s office has been taking much longer.

From CBS17 in Raleigh:

Superior Court Judge Bryan Collins wrote that the sheriff’s office continues to insure that permits are properly processed to prevent convicted felons and other non-qualified persons from obtaining handguns, while also complying with Gov. Roy Cooper’s executive orders concerning the pandemic, a release from the sheriff’s office said.

The court also said that the manner in which the sheriff’s office processes applications for the permits was not unreasonable.

“I’m very pleased with ruling rendered by Judge Collins,” Baker said in the release. “As I’ve stated before, I will continue to ensure and protect the Second Amendment rights of all qualified citizens, while continuing to protect the safety and welfare of my staff, Wake County citizens and the jail residents housed in the Wake County Public Safety Center, during this pandemic.”

If this judge rings a bell in your memory, it is because he is the same judge who tried to strike down voter-passed amendments to the North Carolina constitution that mandated voter-ID and capped the income tax. Collins argument was that both constitutional amendments were invalid because the General Assembly was gerrymandered. Interestingly, he did not declare that every other law passed by the General Assembly was similarly invalid.

The North Carolina Court of Appeals overturned this ruling in September. That decision concluded:

We conclude that the superior court erred in holding that our General
Assembly lost its power granted by our state constitution, while retaining other powers, simply because a federal court had determined that the maps contained too many majority-minority districts, such that some members elected to that body were from districts that were illegally gerrymandered based on race. It is simply beyond our power to thwart the otherwise lawful exercise of constitutional power by our legislative branch to pass bills proposing amendments. Accordingly, we reverse the order of the superior court and declare the challenged constitutional amendments duly ratified by the people to be valid.

One other note here – Judge Bryan Collins is the husband of NC Appeals Court Judge Allegra Collins who was elected in 2018. I would presume the judicial ethics would force her to recuse herself from any case decided by her husband.

Are You Registered To Vote?

If you are a gun owner and are not registered to vote, why the hell not? The rest of us can only do so much to preserve your rights while you freeload.

I can’t speak for other states but tomorrow is the last regular day to register to vote in North Carolina. You can also do it in person if you early vote. If you live here and aren’t registered to vote, do it! It is so damn easy to register now that not being registered to vote is downright pathetic. Unlike when I marched myself down to the Guilford County Courthouse on my 18th birthday in 1975, you can do it online at the DMV!

They didn’t make a recommendation in Commissioner of Agriculture race so I’ll do it – Steve Troxler (R-NC) is the incumbent and is running against Jenna Wadsworth (D-NC). Wadsworth, you may remember, posted a TikTok where she smirked about President Trump contracting COVID-19. She took it down but it went viral anyway. I believe she passed it off as a spur of the moment thing but, as someone noted on Twitter, the lighting was perfect and she had her “warpaint” on.

U.S. PRESIDENT
GRNC-PVF recommends DONALD TRUMP (GRNC ***) for U.S. President. Under the Trump administration, the BATFE has rescinded restrictions on use of AR-15-type pistols, Trump added two conservative justices to the U.S. Supreme Court, and the U.S. pulled small arms out of the potentially disastrous restrictions of ITAR (International Traffic in Arms Regulations). Despite Trump making sympathetic remarks on “red flag” gun confiscation, he withdrew support for proposed legislation when gun rights supporters objected. Trump’s only disappointing action was to direct the BATFE to regulate “bump stocks” as restricted Title II firearms. By contrast, challenger Joe Biden (GRNC 0-star) has a long history of supporting gun control (despite his claims to the contrary), including voting for the 1994 “assault weapon” ban and recently saying he would delegate his gun policy to virulently anti-gun Beto (“Hell yes, we’re going to take your AR-15”) O’Rourke. This race is critical for your Second Amendment rights, and any vote for a third party candidate is effectively a vote for Joe Biden. Although some may object that we didn’t recommend Libertarian Jo Jorgensen (survey 100%, ****), the reality is that Jorgensen has no chance of winning, and may siphon off votes from Trump, which only helps Biden.
U.S. SENATE
GRNC-PVF recommends Thom Tillis (GRNC ***) for U.S. Senate. So you hate Senator Thom Tillis? Stand in line. You probably don’t hate him as much as we do. But the upcoming Senate race isn’t about Thom Tillis; it is about potential left-wing control of the U.S. Senate which, right now, Las Vegas odds-makers are favoring Democrats to win. This is one of four pivotal races for control of the U.S. Senate. If we lose the Senate, rabidly anti-gun Sen. Chuck Schumer will be Senate Majority Leader, and the filibuster (which has been used to kill numerous gun control proposals) will end, ensuring leftist control of the chamber. Democrat challenger Cal Cunningham (GRNC 0-star) studiously avoided putting himself on record on gun issues while in the NC Senate, has repeatedly refused GRNC’s candidate survey, and is no friend of gun owners. Again, a protest vote against Tillis (however much he deserves it) will only serve to give Schumer and the Democrats an opportunity to end private gun ownership as we know it.
U.S. HOUSE
District 1: With only a 25% pro-gun voting record, incumbent Democrat GK Butterfield is a consistent opponent of gun rights, earning only GRNC’s lowest 0-star evaluation. Republican challenger Sandy Smith returned GRNC’s candidate survey with a perfect 100%, earning GRNC’s highest 4-star (****) evaluation. GRNC-PVF recommends Republican challenger SANDY SMITH.
District 2: The redrawing of this district was forced by leftist-initiated legislation and now unfortunately favors perennially anti-gun Democrat Deborah Ross (GRNC 0-star), who consistently opposed gun ownership while in the NC House. Unfortunately, neither Libertarian Jeff Matemu or Republican Alan Swain returned GRNC’s survey, giving them 0-star evaluations as well. There are no good options in this district, but GRNC-PVF recommends you vote for anybody BUT Deborah Ross. If it’s any help, Swain has on his website, “Alan proudly supports our Second Amendment. In Washington, Alan will fight to insure that the Constitutional rights of our citizens to bear arms are never infringed upon.”
District 3: In this race, incumbent Republican Greg Murphy (GRNC ****) garnered a respectable 88% pro-gun voting record while in the NC House. By contrast, Democrat Daryl Farrow refused to answer GRNC’s survey, indicating he doesn’t want you to know where he stands on guns and earning only GRNC’s lowest 0-star (0) evaluation. GRNC-PVF recommends GREG MURPHY.
District 4: GRNC-PVF recommends Republican challenger ROBERT THOMAS (survey: 98%, GRNC ****) over virulently anti-gun incumbent Democrat David Price (voting record: 0%, GRNC 0-star).
District 5: Incumbent Republican Virginia Foxx scored 100% on GRNC’s candidate survey and garnered an overall 96% pro-gun voting record earning a GRNC 3-star (***) evaluation. Democrat challenger David Brown refused to return GRNC’s survey, indicating he doesn’t want you to know where he stands on guns and earning only GRNC’s lowest 0-star (0) evaluation. GRNC–PVF recommends VIRGINIA FOXX.
District 6: In a race for an open seat creating by forced redistricting, Republican Lee Haywood scored 95% on GRNC’s candidate survey, earning GRNC’s highest 4-star (****) evaluation while Democrat Kathy Manning refused to return GRNC’s survey, indicating she doesn’t want you to know where she stands on guns and earning only GRNC’s lowest 0-star (0) evaluation. GRNC–PVF recommends LEE HAYWOOD.
District 7: Incumbent Republican David Rouzer continues his 100% pro-gun voting record (GRNC ***). By contrast, Democrat Kyle Horton and Constitution Party challenger Christopher Ward both failed to return GRNC’s survey, earning the lowest 0-star evaluation. GRNC-PVF recommends DAVID ROUZER.
District 8: With a 100% survey score and 100% bill sponsorship (for national concealed handgun reciprocity), incumbent Republican Richard Hudson earned a GRNC 3-star evaluation (***). Challenging Democrat Patricia Timmons-Goodson refused to return GRNC’s survey, indicating she doesn’t want you to know where she stands on guns and earning only GRNC’s lowest 0-star (0) evaluation. GRNC–PVF recommends RICHARD HUDSON.
District 9: Incumbent Republican Congressman Dan Bishop (100% pro-gun voting record, GRNC ****) won his seat in a special election just last year and needs our help. Challenging Democrat Cynthia Wallace refused to return GRNC’s candidate survey, indicating she doesn’t want you to know where she stands on guns and earning only GRNC’s lowest 0-star (0) evaluation. GRNC-PVF recommends DAN BISHOP.
District 10: Incumbent Republican Patrick McHenry (93% pro-gun voting record, GRNC ***) has long supported gun rights. Challenging Democrat David Parker refused to return GRNC’s survey, indicating he doesn’t want you to know where he stands on guns and earning only GRNC’s lowest 0-star (0) evaluation. GRNC–PVF recommends PATRICK McHENRY.
District 11: In this open seat, left vacant when incumbent Mark Meadows became Donald Trump’s chief of staff, Republican Madison Cawthorn (GRNC survey 100%, ****) has distinguished himself as a conservative and gun rights supporter. Challenging Democrat Moe Davis refused to return GRNC’s survey, indicating he doesn’t want you to know where he stands on guns and earning only GRNC’s lowest 0-star (0) evaluation, while Libertarian Tracey DeBruhl  scored only 74%, earning only two stars (**). GRNC–PVF recommends MADISON CAWTHORN.
District 13: As not only a congressman but also a gun shop owner, incumbent Republican Ted Budd is a gun rights stalwart whose 100% survey and  100% pro-gun voting record has earned GRNC’s highest 4-star (****) evaluation. But that means he is being targeted by national leftists. Challenging Democrat Scott Huffman refused to return GRNC’s survey, indicating he doesn’t want you to know where he stands on guns and earning only GRNC’s lowest 0-star (0) evaluation. GRNC-PVF strongly recommends TED BUDD.

GRNC-PVF strongly recommends Republican challenger DAN FOREST (survey: 96%, GRNC ****) over anti-gun Democrat incumbent Roy Cooper (voting rate: 58%, GRNC 0-star). Over decades, Cooper has been a consistent enemy of gun rights, most recently vetoing HB 652, which would have expanded concealed carry into churches co-located with educational property. By contrast, Forest has consistently stood tall for the Second Amendment. Any vote for a third party candidate in this race should effectively be considered a vote for Cooper and against gun rights.
N.C. LT. GOVERNOR
GRNC-PVF strongly recommends Republican MARK ROBINSON (survey 100%, GRNC ****) over Democrat Yvonne Lewis Holley (NC House voting record: 7%, GRNC 0-star). After Robinson’s impassioned speech against gun control to the Greensboro City Council went viral, GRNC awarded him an Honorary Life Membership. He currently serves as on the board of directors for the NRA and has made gun rights and freedom the centerpiece of his campaign.

GRNC Demonstration In Raleigh Canceled Due To Fears Of Violence

Grass Roots North Carolina President Paul Valone sent out notice within the hour saying that the protest against Sheriff Baker for not doing the job for which he was elected is off. The GRNC office received tons of emails and calls from supporters saying since state law prevented them from being armed in the face of potential violence they just couldn’t be there.

Unfortunately, GRNC is cancelling the demonstration against Sheriff Gerald Baker over his refusal to comply with the law in issuing gun permits which was scheduled for September 26, and here is why.
     Our office has been receiving a regular string of emails and voice messages with variations of, “I’ve been a member and supporter of GRNC for years, but this demonstration is scheduled for a political environment in which crazies from the left are lobbing bricks and Molotov cocktails, and under North Carolina law, I’m not allowed to carry a firearm for self-protection at a demonstration.”
     To the thousands of GRNC members who have expressed those sentiments in either words or thoughts, I say: “I hear you.”
     It is a sad day when lawful citizens can’t peacefully assemble for a redress of political grievances without fear of radical Marxists attacking them for simply expressing their views, but unfortunately, that day is upon us.
GRNC will address your inability to protect yourself during a peaceful assembly in the next session of the legislation … if we win the election.
It is increasingly obvious that the only way out of this poisonous environment we face is a decisive victory in the 2020 elections – not just a victory, but an overwhelming victory.
Rigging the election
As I write this, Democrats are busy rigging the election, not just nationally, but right here in North Carolina.
Yesterday, the Democrat-dominated State Board of Elections decided to “help” all those poor voters who fail to properly complete or mail the absentee ballots Democrats insist they must use. In an election rife with voter fraud, this will be “hanging chads” times ten.
The point of all the mail-in ballot nonsense, of course, is to undermine the legitimacy of an election they expect Donald Trump and Republicans to win.
Why we must have overwhelming victory
By claiming a Trump victory “illegitimate” after a narrow win, leftists will look for any excuse to riot, burn and otherwise tear down our society in order to replace it with their “Great Socialist Utopia.”
A narrow victory will give Obama-appointed judges and “deep state” boards of elections an opportunity to manufacture enough “hanging chads” to declare victory.
And don’t forget that North Carolina is one of a handful of critical “battleground states.”

Tell Holly Springs No

The Town of Holly Springs, a suburb town in Wake County, North Carolina, is considering imposing restrictions on open carry. As a reminder, open carry is a constitutional right in the state of North Carolina. That was decided by the NC Supreme Court in 1922 in the case of State v. Kerner.

The Town Council will meet on Tuesday, September 1st to consider the proposal. The Bloomberg-funded North Carolinians Against Gun Violence (sic) is pushing it and they have an alert out on it.

Grass Roots North Carolina has been following this and the previous proposal concerning concealed carry on certain town properties from the start. Unlike NCGV, they were not caught flat-footed on either proposal.

An alert from GRNC was released yesterday asking for support on this. The Town Council will not be allowing speakers from the attendees so email and calls are key.

Gun Rights Supporters, We Won a Partial Victory Last Month in Holly Springs.   Now We Need Your Help to Finish the Job on Tuesday, September 1st.  The Message:   GUNS SAVE LIVES and ‘Gun Free Zones’ DO NOT! 

Last month the Mayor and Town Council of Holly Springs heard loud and clear from the community it serves that Freedom and the 2nd Amendment are alive and well.  According to the Mayor, the level of engagement by the public on this issue exceeded anything he’s ever seen in 19 and a half years of public service.  The comments were overwhelmingly in favor of tabling BOTH of the two proposed town ordinances prohibiting lawful open and concealed carry in the Town of Holly Springs. 

However, while lawful concealed carry restrictions were indeed tabled, three members of the Council chose to delay a final decision on open carry.  Two, if not three, of the five Council Members desperately want to find a way to impose open carry restrictions and, hence, the matter reappears for a vote Tuesday night, September 1st.  

NO FIREARM ZONES are killing fields.

Time and time again, history has shown us that “no firearms allowed” signs DO NOT work. The criminal and the mob are only emboldened by such ignorance on the part of politicians believing these signs work. Law enforcement authorities will arrive in a minute or two of a call? Not likely at all.  In fact, think of ten to fifteen minutes at least.  How many lives could be destroyed in that time frame? The first responders to a tragedy are the people present.  If armed, they may prevent a calamity.  If unarmed, they can run, hide, or die.

As I write this alert, the businesses in Downtown Raleigh who earlier today boarded up their shops in anticipation of violence, rioting, looting, and worse to come Friday and Saturday nights pray that the mobs roaming the streets don’t use the bricks and stones conveniently left on street corners there.  Nowhere in the video are Raleigh Police enforcing the Mayor’s hastily called curfew for tonight. The need to protect ones’ self and loved ones is never more apparent than it is today We live in lawless times where progressive “Woke” political leadership demands law enforcement step down and let havoc wreck its toll.

Despite this rampant lawlessness, Holly Springs, in Southern Wake County and mere miles away from Raleigh, will readdress OPEN CARRY restrictions at a 2nd Town Council meeting on September 1st at 7 pm.  

Please attend the council meeting and email your opposition to banning freedom. One registered “Republican” who is leaning left may join the two Michael Bloomberg robots and pass the ban.  He needs a polite wakeup call and a reminder to back away from gun bans. Posting a prohibition against lawful OPEN CARRY serves no purpose but to advance a gun banning agenda promoted by the left.  It will not save lives.

Is it your opinion that law enforcement will be present during an attack wherever evil might occur?  Two days after the August 18th meeting, a man was assaulted and killed on a Raleigh public greenway.  Speaking of Raleigh, have you watched the videos from Raleigh on Friday night? Do you anticipate a few bucks thrown toward your reelection campaign next year from the deep pockets of Michael Bloomberg or George Soros?  Or more ominously, do you just want to control the lives of others merely because you can?

Do you know that the emails you may have received in support of restrictions were prepared by a Michael Bloomberg funded organization “North Carolinians Against Gun Violence” and that they also demand the defunding of North Carolina Law Enforcement Agencies?  Will your next step be to defund the Holly Springs Police in accordance with their wishes?

Testimony presented at last month’s public hearing on this matter indicates this is merely political posturing presented by your left-leaning peers with no factual basis to claim any accident or incident detrimental to public health and safety in decades of responsible citizen behavior.  They want it banned merely because they want it banned.  Period. 

The reality is Wake County Sheriff Gerald Baker and others unlawfully continue to deny citizens, including residents of Holly Springs, permits to purchase handguns or permits to lawfully conceal carry handguns.  OPEN CARRY remains the ONLY lawful manner some citizens possess to protect themselves and loved ones.  The Right to Keep and Bear Arms is fundamental and must be honored by those who legislate law and order among us.

Give law-abiding citizens at least a fighting chance.  Carving out “exceptions” will do the public no good unless you concurrently propose to spend considerable sums ramping up law enforcement assets and locking down the town with checkpoints, metal detectors, and random search and frisks. 

On the 18th of August, you rightly concluded banning lawful concealed carry in Holly Springs served no purpose and voted against the proposed measure. Now I ask you to vote responsibly one more time and table this equally insane idea carving out open carry exclusion zones in and around Holly Springs.

GRNC Lawsuit Against Sheriff Baker Makes The News

The lawsuit GRNC has brought against Wake County Sheriff Gerald Baker has caught the attention of local news stations. CBS 17 News of Raleigh did a report yesterday on Moore v. Baker and interviewed Marc Erickson of GRNC. The lawsuit is over Sheriff Baker dragging his feet in the processing of pistol purchase permits. It is taking over 2 months to process them when state law only allows 14 days. Sheriff Baker is still using the tired excuse of “it’s the pandemic”.

As Marc made clear, a right delayed is a right denied. The pistol purchase permit is superfluous given the NICS System but North Carolina sheriffs claim they know people in their county better. That might be true in eastern NC’s Tyrrell County – population 4,016. It certainly is not true in Wake County population 1,111,761. Wake, by the way, has now officially surpassed Mecklenburg as the largest county by population in North Carolina.

GRNC Sues Wake County Sheriff Baker…Again

Grass Roots North Carolina is suing Wake County (NC) Sheriff Gerald Baker again for unlawful delays in issuing pistol purchase permits as well as concealed handgun permits. The suit is filed in Wake County Superior Court. GRNC is the institutional plaintiff while Wanda Kaye Moore is the lead plaintiff. The lawsuit seeks an emergency temporary restraining order preventing Sheriff Baker from causing any more delays.

The Wake County Sheriff’s Department is forcing applicants for a pistol purchase permit to make an appointment to submit their mental health release. They refuse to take it by mail or online even though state law mandates application for these permits be online.

[Raleigh] In recent weeks, GRNC’s office has been flooded with complaints from people who want to buy handguns for protection against riots spreading across the country but are unable to do so because Sheriff Gerald Baker refuses to process pistol purchase permits within the 14 days required by law, effectively denying citizens their right to keep and bear arms.

Said Grass Roots North Carolina president Paul Valone: 

“In what is now the third lawsuit filed against Wake County Sheriff Gerald Baker over his refusal to follow state law regarding issuing handgun permits, Grass Roots North Carolina intends to ensure citizens’ rights are respected. Sheriff Baker seems to think he is above the law. Grass Roots North Carolina intends to prove otherwise. Since Baker doesn’t seem to be getting the message, we will deliver it loud and clear. We are also holding Wake County responsible for its refusal to stop Baker’s continued malfeasance.”

In response to GRNC’s notice of non-compliance, sent to Baker’s counsel on July 15, attorney Nick Ellis claimed that Baker is doing an “excellent” job of processing pistol purchase permit applications, despite the fact that:

  • Baker is clearly violating G.S. §14-404(f): The statute requires sheriffs to issue or deny NC pistol purchase permits in 14 days, further stipulating that applications may only be denied or statutorily permissible reasons. In truth, applications, if they are being processed at all, are taking nearly two months
  • Baker is trying to circumvent state law by arguing that the requisite 14 day issuing period doesn’t start until his office decides to allow a citizen to come in to his office to finish the application begun online, effectively claiming the power to deny citizens’ rights indefinitely.
  • North Carolinians are being denied their rights: It is unlawful for citizens to buy handguns without either a pistol purchase permit or concealed handgun permit from their county of residence, meaning that Baker’s actions are denying citizens’ rights not only to keep and bear arms, but to protect their families at a time of national crisis when personal safety is very much in question.
  • Reports indicate the Wake County Sheriff is non-responsive: Email queries on permit applications are reportedly being ignored as phone calls to the department go unanswered. Reports also suggest that Baker has limited the number of hours during which Wake County sheriff’s employees may process applications, as department representatives have become hostile to frustrated applicants.
  • Baker may be thumbing his nose at the law: Despite a consent decree requiring him to issue handgun permits, Baker appears to be dragging his feet in order to issue the minimum possible number of permits, clearly defying the decree.
  • Wake County may be liable: Under the Supreme Court decision in Monell v. Department of Soc. Svcs., Wake County may also be liable for its refusal to stop Baker’s malfeasance.

HB 652 Needs Support In NC

NC House Bill 652 would expand the ability to carry in churches. I hardly need to mention that churches have been the targets of the evil and the deranged. Needless to say but North Carolinians Against Gun Violence (sic) is adamantly against this bill if the emails I’ve received are any indication.

From NCGV:

“We oppose H652. It circumvents state policy outlawing concealed carry of firearms on school grounds and would put school children at more risk of gun violence,” said NCGV Executive Director Becky Ceartas. “State law applies to both public and private school property and makes no exception for schools owned and operated by places of worship for a simple reason: it endangers school children. 

“The fact that weapons would be allowed at the place of worship with schools but not at the associated school itself on the same property practically amounts to a distinction without a difference,” Ceartas added.

According to their email they are also opposed to making it easier for EMTs to legally carry. Don’t EMT lives matter?

Suggested Subject:  Support HOUSE BILL 652   Dear Representative,   I’m writing to urge you to support HOUSE BILL 652 that will expand the ability for ordinary citizens to carry concealed on educational property that is the location of both a school and a place of religious worship.
Recent tragedies have shown that a good guy or gal with a gun are critical in saving lives.   This is true common-sense safety legislation that will protect the public.
Mere signs or rules never deter those of evil intent and mass murder.  These only serve to stop innocent people from ensuring everyone else’s safety. 
I expect you to stand up for everyone’s common sense human rights and support this important step in safety. I will continue to monitor your actions on this important issue through alerts from Grass Roots North Carolina.    Respectfully,  

Durham Capitulated…But Quietly

Last week I wrote that the City of Durham had received a demand from Grass Roots North Carolina and GOA to designate gun stores as essential or face legal action. Greensboro also got one of these letters and folded it quickly.

They did fold but did it very quietly. What the City of Durham did was release an amendment to their original order saying they were merely going to adopt the amended Stay at Home order issued by the county. This new City of Durham order didn’t go into details as to what was or wasn’t an essential business. Mayor Stephen Schewel signed the order on the afternoon of Friday, April 3rd and it went into effect at 5pm on Saturday, April 4th.

Durham County’s order didn’t mention gun dealers or ranges as essential businesses. They just said that any business that was on the Department of Homeland Security’s CISA list was essential. That list did include firearms related businesses. Perhaps it is ironic that the title of the county order was “Second Amendment to the Declaration of a State of Emergency in Durham County, NC to Coordinate Protective Actions to Prevent the Spread of COVID-19.”

As I understand it, GRNC contacted Durham County and convinced them to them to comply. Somehow officials in Durham County convinced Mayor Schewel to comply but noted he refused to make any public statement about it.

IndyWeek is a free newspaper serving the Triangle. In NC-speak, the Triangle are the cities of Chapel Hill, Durham, Raleigh, and the smaller surrounding communities. IndyWeek is virulently anti-gun.

They have their panties in a wad that Durham folded to those “gun nuts” and their demands after Mayor Schewel said he wasn’t backing down. The article notes the original April 2nd deadline and the fact that GRNC and GOA didn’t sue.

In this case, April 2 came and went, and Schewel made no such statement, but the gun groups didn’t sue. So what happened? 

Very quietly, the city rolled over. 

IndyWeek then goes into the details of the Durham County and City of Durham orders which I posted above.

As to why Durham capitulated, IndyWeek has this response from Mayor Schewel.

“Our lawyers said we couldn’t win,” Schewel told the INDY on Tuesday. “And not only that they were gonna win, but that we were gonna have to pay their legal fees. And so that’s why we made the decision—which is, you know, awful. Gun stores are not essential. In fact, they are damaging. It’s terrible to be forced into this position.”

It is good to see the Constitution and some good legal advice trumped the anti-gun feelings of the good mayor. It should be no surprise that Schewel is a member of Mayor Bloomberg’s Illegal Mayors.
