HB 1039 – North Carolina’s School Self-Defense Act Introduced

House Bill 1039 – School Self-Defense Act – has been introduced into the North Carolina House of Representatives. The bill will have a formal unveiling at a press conference to be held this coming Tuesday at 10:30am in the Legislative Building. The authors of this bill include many pro-gun legislators. Moreover, they sought the input of Grass Roots North Carolina in their drafting of the bill.

HB 1039

This bill, sponsored by Representatives Mark Brody, John Blust, George Cleveland, Larry Pittman and Michael Speciale,
would allow certain members of
school faculty or staff to carry a handgun on school grounds to respond
quickly to acts of violence and imminent threats of violence.

Finally, a few
courageous legislators are stepping outside of the circular rhetoric and are proposing a practical and effective solution that
will actually protect the children.

Would A Local TV Station Obfuscate GRNC’s Position On 80% Receivers? Duh!

A volunteer for Grass Roots North Carolina was interviewed by Felicia Bolton of Raleigh’s CBS 17 television station about “ghost guns” for the second part of their two-part story.

If you read what was attributed to Marc Erickson, you’d think GRNC was anti-80% receivers.

Some gun rights advocates like the director of Grass Roots North Carolina Marc Erickson stated these weapons do pose some concerns.

“I represent lawful gun owners. Lawful gun owners don’t have to make their own firearms,” said Marc Erickson.

He also stated that he believes the law should remain the same and the focus should be on prosecuting violent offenders.

“What concerns me is that violent people obtain firearms one way or another and are allowed to pursue their violent actions,” said Erickson.

Of course there is more to the story as the alert from Grass Roots North Carolina below points out. Being quoted out of context or having the meat of your argument edited out is the risk you play when dealing with the media. They want sound bites that make their point. It is why whenever you are being interviewed you should have your own recorder. Even better is to have someone with you taking video of the interview so you won’t be “Couric’ed” as Katie Couric did to the Virginia Citizens Defense League.

In a heavily edited interview on CBS 17 yesterday, a GRNC volunteer’s remarks were taken out of context to imply that Grass Roots North Carolina opposes the sale of 80% lower receivers. That assertion is false. The position which the reporter avoided relaying was as follows:

“If gun ban advocates are worried about 80% lowers, they should be truly alarmed by the prospect of people using 3-D printers to make guns in their basements, because each underscores the fallacy of gun control; namely, that you can somehow control the behavior of violent individuals by restricting their access to potential implements of mayhem. Prohibition didn’t work for alcohol, it isn’t working for drugs, and it won’t work for guns.”

Will NC Republicans Let Permitless Carry Die In The State Senate?

HB 746 passed the North Carolina State House in June of 2017. Entitled the Omnibus Gun Bill, the key feature of HB 746 was permitless concealed carry. As I’ve mentioned before, the North Carolina Supreme Court ruled back in 1922 that it was the right of North Carolinians to carry a firearm openly. Since the passage of HB 746 in the House there has been no action on the bill in the State Senate. It seems the Senate Republicans under the control of Majority Leader Phil Berger want the bill to die from inaction. They did nothing regarding the bill in 2017 and now it seems nothing more will happen regarding the bill in the 2018 short session.

It should be noted that it wasn’t too long ago that both houses of the General Assembly were solidly Democratic. Thanks to the efforts of conservatives and especially gun owners, Republicans hold a super majority in both houses. Grass Roots North Carolina issued an alert this evening asking people to remind Majority Leader Phil Berger and the rest of the Senate Republicans just who brought them to the dance.

Early Voting Starts April 19th For NC Primary

Tomorrow is the first day of early voting for the May Primary in North Carolina. The number of locations in a county will vary by both date and county. For example, in Buncombe County (Asheville area), there will be only one site available for early voting until Saturday, April 28th, when it expands to six locations. You can go to the NC State Board of Elections to find the locations for one-stop early voting in your county.

In anticipation of the opening of the early voting period, Grass Roots North Carolina has released their Remember in November candidate evaluations. They have both a sort by district and a sort by name file. Personally, I find the sort by district to be more helpful. The candidate evaluations are only for the state legislature and for Congress.

As GRNC notes, these are evaluations and not endorsements.

GRNC’s “Remember in November” project estimates candidates’ views on “assault weapons,” concealed handguns, gun storage laws, gun rationing, other gun control and the Second Amendment. THE EVALUATIONS HEREIN ARE NOT ENDORSEMENTS. We issued surveys first to a control group of gun owners and then to candidates. Next, we measured how closely each candidate’s views and voting record (if available) agree with the control group. Pay more attention to voting records than survey results unless, of course, you believe politicians never lie.

Also as a reminder, just because a candidate has “R” after his or her name, it doesn’t mean he or she supports gun rights. I have seen a snippet of a debate between Michelle C. Lexo and Tom McInnis regarding firearm issues. They are running for the Republican nomination in the NC Senate 25th District (Anson, Moore, Richmond, and Scotland Counties). Ms. Lexo says we need to look at “high capacity magazines” because she isn’t sure “they are needed”. “Other than that”, she says she supports the Second Amendment. Her opponent, Sen. Tom McInnis, replied “when guns are outlawed, only outlaws will have guns”.  I’ll let you decide who you’d rather have defending your firearm rights.

GRNC On Weekend Rallies

Grass Roots North Carolina sent out a press release this afternoon regarding the weekend gun rights rallies. They make the point that they are not affiliated with the event nor are sponsoring it. Their goal is not to discourage attendance but to make sure people are aware of the relevant state law in North Carolina about carrying on the grounds of the State Capitol.

You may have heard about the nationwide
pro-gun
rally planned for this weekend. GRNC is not affiliated with this event,
but we have learned that some organizers in various states have
encouraged
attendees to bring firearms to their particular rally location.
While it’s true that they are only encouraging this in states where it is legal to do so, there should be some
concern that people unaware of their state and local laws could inadvertently ensnare themselves in serious legal trouble.

Although
GRNC is not affiliated with this event, we want to serve our supporters who may plan to attend with a helpful warning: it is absolutely illegal to
carry a gun on the State Capital grounds in North Carolina, unloaded or otherwise
.

Carrying a gun at a protest in that
part of the city will most likely land you in
serious legal trouble, and may very well compromise your personal
safety. It would also be counterproductive to the gun rights movement.
GRNC does not
condone breaking any gun laws.

Just In Case You Haven’t Seen This

Mayor Nancy Vaughn of Greensboro, NC announced after the Parkland murders that she would seek to end the Greensboro Gun and Knife Show held semi-annually at the Greensboro Coliseum. The Greensboro City Council was in agreement. The only problem is that they didn’t have the authority to do that.

So they invited citizens to make their voices heard – assuming it would be anti-gun – during the public comment period on the April 3rd meeting. I think they heard more than they expected but not exactly what they wanted. You can see the full hour plus long video of the meeting here.

Andy Stevens of Grass Roots North Carolina spoke. Just as importantly so did Mark Robinson. What the latter had to say has gone viral. You can see both of their comments below.

Mr. Robinson’s comments begin at about the 4:40 mark. His comments have been aired on Fox News, Facebook, and the list goes on. The number of views from various sources now totals in the millions.

In response to the conflicting and confusing messages regarding gun control coming from the White House and @realdonaldtrump’s Twitter account, Grass Roots North Carolina issued an alert yesterday asking for members and supporters to call the White House, email the White House, and email their Senators and Representatives. They want the message delivered loud and clear that no new gun control is acceptable.

“Dance with the One That Brought You”  is always good advice – especially in politics.

The nation’s Left (and now it appears President Trump) is hoping to use the emotion of the moment to to chip away at our rights with the false promise that it will solve the problem.  They will then walk back the promises as being “A good first step”.   After which they will patiently await for the next mass killer to show up and do it all again.

The proposed ‘Bump Stock’ ban has nothing to do with the mass murder in Parkland, Florida but is being pushed under the guise of“Doing Something, anything”.  It could change the meaning of a machine gun from trigger pull to firing rate and be applied to anything that could increase this rate and used to cover every semi-automatic firearm under the odious rules of the National Firearms Act [NFA].

Reminder From GRNC – ATF Comment Period Closes Next Week

Grass Roots North Carolina sent out an alert reminding people that the comment period for the Advanced Notice of Proposed Rulemaking closes on January 25th. They also have a suggested comment. I have sent my comment in and will post it as a separately.

Just a reminder, all comments must reference Docket Number  2017R-22.

PROPOSED RULE TO
STIFLE THE 2ND AMENDMENT

It seems our friends at the
Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE, often referred to
as the ATF) would like to impose “maximum firing rates” on American gun
owners. Apparently, there is even talk that they may classify your
semi-automatic rifle as a “machine gun.”

Reason and legalities tell us that a machine gun fires continuously and
automatically with a single function of the trigger.  But the BATFE is
no longer sure that definition suits them. This is because, since the
definition was established, super high-tech items have been developed, such
as rubber bands, belt loops, shoestrings and Jerry
Miculek
.  The truth is, even with these “high-tech” devices, nothing
has really changed. So-called “bump firing” still requires one trigger action for each
round fired. Yet, the BATFE is looking to “clarify” the NFA
and whether certain devices, commonly known as bump fire stocks, fall within
the definition of machine gun. Absurd.

With the flick of a bureaucrat’s wrist, your lowly non-NFA firearm (read:
semi-automatic) may suddenly be elevated to the status of machine gun. It
will be classified not by trigger action, but by arbitrary firing rate, which
is something that can be altered by any number of things, including something
as nebulous as the skill of its owner. The list of items that can affect rate
of fire also includes innocuous, legal and unrelated things such as: optical
sights, trigger jobs, muzzle compensators, and who knows what else?

I’m writing to day to speak
against the formation of a so-called “Bump Fire” rule.

Clearly, the proposed rule is designed to open a debate about semi-automatic
firing rates, something that is not open to debate in a free country. This is
dangerous territory where ambiguous language, established by unelected
government employees, is sure to infringe on the Second Amendment rights of
The People.

The proposed rule references “devices used with a semiautomatic firearm to
increase the firearm’s cyclic firing rate.” Clearly, that sort of open-ended
language could be used to ban any device that increases the firearm’s cyclic
firing rate regardless of trigger action, e.g. trigger jobs, muzzle
compensators, optical sights, shoestrings, rubber bands, and who knows what
else?

Given that bump stocks do not alter trigger function, firearms remain
semi-automatic, the BATFE has no legitimate authority to impose this
infringement on the American people. Indeed, there is no statutory definition
of “machinegun” in the National Firearms Act of 1934 nor the Gun Control Act
of 1968 that would allow the BATFE to make this stretch.

Any “Bump Fire” rule would be unconstitutional, and any “rule” imposed by
federal bureaucrats is really just a law established without the approval of
the peoples’ representatives. Surely, those at the BATFE have no interest in
circumventing the Constitution of the United States, nor would they want to
disrespect the country’s law-abiding people in such a manner.

For these reasons, I must insist that the BATFE immediately discard any
thoughts of imposing a “Bump Fire” rule.
 

GRNC Reminds Us What Could Have Been

North Carolina is under a declared state of emergency due to snow, ice, and extreme cold. I know those living in the upper Midwest are probably scratching their heads over this but remember North Carolina doesn’t have the infrastructure – plows, etc. – to deal with this as a regular occurrence.

I bring this up as a reminder that before McDonald v. Chicago brought Second Amendment rights to the states it was state law in NC that no one could be armed outside the home during a state of emergency. Moreover, firearm and alcohol sales were also suspended. The win in the case of Bateman v. Perdue changed this as the US District Court for the Eastern District of North Carolina found this to be unconstitutional. Thanks needs to go to Grass Roots North Carolina, the Second Amendment Foundation, and attorney Alan Gura for bringing the case. It was the first case filed after the win in the McDonald case. If you search this blog using “Bateman” or “emergency”, you will find numerous blog posts about the case.

Due to winter weather, on Tuesday, Jaunary 16th, North Carolina Governor Roy Cooper declared a “state of
emergency.” What does that mean to you today, and what could it have meant? Find out below. 

As you may recall, Grass Roots
North Carolina was a plaintiff in Bateman v. Perdue, when we sued
Governor
Beverly Perdue over the State of Emergency gun ban, a ban on law-abiding
citizens carrying guns during a declared state of emergency.

GRNC argued that the ban
constituted an unconstitutional violation of the Second Amendment. We
did so after
the town of King, NC posted the entire town against firearms in advance
of a pending snowstorm, and after Gov. Perdue declared a statewide State
of
Emergency, in response to an advancing hurricane, on the opening day of
dove season, making criminals of thousands of dove hunters. GRNC and
other
plaintiffs won the lawsuit, and the law was struck down as
unconstitutional under the Second Amendment.

GRNC Urges NC Gun Owners To Contact Burr, Tillis, and McConnell

I spent part of Saturday morning working the Grass Roots North Carolina booth at the Asheville Gun and Knife Show. Paul Valone, President of GRNC, was also helping out at the booth and we had a chance to chat. He told me we needed to put pressure on Senators Richard Burr (R-NC) and Thom Tillis (R-NC) over Sen. Dianne Feinstein’s moves to outlaw bump fire stocks. Paul said it was only a first step for Feinstein and having read her bill I agree. The bill itself contains what I consider a Trojan Horse as it would outlaw anything that accelerated a semi-automatic rifle.

The alert that Paul alluded to in our conversation was released late this afternoon. It asks gun rights supporters to call and email Senators Burr and Tillis as well as Majority Leader Mitch McConnell regarding Feinstein’s ban bill.

accessory?




While
our nation continues
to mourn the senseless tragedy in Las Vegas, lawmakers in Washington are
rushing to fix (i.e. exploit) an issue they barely understand. Senator
Dianne Feinstein (D-California) is reportedly proposing legislation that
will eliminate all after-market devices which increase the firing rate
of
legal guns. Of course, this would ban the now infamous “bump stocks”.
But, it would also make illegal many other accessories, such as
systems that enthusiasts use to make semi-automatic versions of belt-fed
machine guns.

Even more troubling, this proposal would NOT grandfather
any of these devices. This would potentially have the chilling effect
of making tens of thousands of otherwise law-abiding citizens, criminals
overnight — just for owning the “wrong” accessory.

If
this dangerous proposal were to become law, nobody knows how far the
government
would go to make sure millions of gun owners have only the “politically
correct” accessories. Nancy Pelosi (D-CA) has even said that
she “certainly hopes” this is will be a slippery slope to more gun
control. This is so much more than a Second Amendment issue — this is
an
attack on our right to own private property, a freedom enshrined in the
Fifth Amendment.
