GRNC Alert On First Citizens Bank

First Citizens Bank is headquartered in North Carolina and has 570 branches in 18 states. The majority of its branches are in the Carolinas and Virginia. First Citizens, while publicly traded, is still controlled by the Holding family. Frank B. Holding, Jr., CEO of First Citzens, is the grandson of the bank’s founder Robert P. Holding. The bank’s Vice Chairman and fellow board member, Hope Holding Bryant, is his sister. Their brother-in-law Peter Bristow is the president of the bank.

Rep. George Holding (R-NC), Frank and Hope’s cousin, represents the 13th Congressional District of North Carolina. He was A-Rated and Endorsed by the NRA-PVF in the 2014 elections and was ranked 4-stars by the GRNC-PVF. According to his last financial disclosure report filed in 2014, he held stock in First Citizens (NC and SC) valued at more than $500,000 and less than $1 million.

The bank’s Board of Directors recently voted to prohibit lawful concealed carry holders from carrying on their premises. As Grass Roots North Carolina notes below in their alert, they did this despite bank robberies being at a 10 year low in North Carolina. Being a non-public entity, they are certainly entitled to do what they want on their own property. However, their customers and potential customers are just as entitled to vote with their feet if they disagree with the board’s action. No state in their markets are lacking in other alternatives.

FCB Risks the Safety of Banking Customers
In a unified show of ignorant disregard for your safety, First Citizens Bank’s Board of Directors recently decided to disallow concealed carry at their branches. This puts all law abiding citizens at risk and should convince current and potential customers of First Citizens Bank (FCB) to reconsider patronizing this, or any bank, that puts customers in harm’s way.
What problem are they trying to solve with the ban? If it’s bank robberies, the N&O reported in this article that bank robberies hit a 10 year low in 2014 of 91 (as of Nov. 30), down from 267 in 2004. The fact that this correlates perfectly with the exponential growth of CCW in NC suggests that CCW is a large part of that fix. Are they trying to fix the non-existent problems they have with CCW permitholders? Where are those reports?
First Citizens Bank has given its customers a false sense of security inside the bank (criminals will not obey a CCW ban) while enhancing the real and present danger that banning concealed carry presents to its patrons outside the branch doors. Criminals know the best place to find people carrying large amounts of cash is in the parking lot of a bank. A concealed weapons ban means customers will be forced to leave their lawfully carried weapon in their car when they walk into, and out of the bank. None of the bank’s elaborate security will do anything to protect people outside of the front doors. In addition, the parking lots of First Citizens Bank will also become fertile hunting grounds for criminals looking to steal guns from cars.
Until First Citizens Bank revokes this counterproductive ban it is imperative that its customers and patrons understand the risks of banking at an institution that jeopardizes its customers’ safety by banning them from lawfully carrying a gun for self defense.

I am writing to voice my strong objection to your Board of Directors’ recent decision to ban lawful concealed carry in the branches of First Citizens Bank. GRNC Responds To Judge Stephens’ Ruling On Carry At The NC State Fair

Grass Roots North Carolina has responded to the denial of a temporary restraining order that would allow those with concealed handgun permits to carry at the North Carolina State Fair. While disappointed, they are weighing their options including whether to appeal.

Judge in State Fair Case Legislates From Bench


Judge Donald Stephens’ decision in the GRNC lawsuit against posting the state fair against concealed carry can best be summarized in his own words: “If I can find a way to interpret the statutes to prohibit concealed handguns in the state fair, I will.”


It was evident to all that Judge Stephens had his mind made up long before the hearing began. When GRNC’s attorney argued, his attitude was nearly contemptuous, and when the Attorney General’s representative argued, Stephens was soothing and supportive as if talking to a pet dog.


The denial today of GRNC’s temporary restraining order was a classic case of legislating from the bench by, perhaps willfully, misinterpreting both the intent of the General Assembly in passing HB 937’s opening of assemblies to concealed carry, and the potential cost to crime victims of not being able to protect themselves against violent predators, as has happened repeatedly in other state fairs, the most recent being last weekend in Arizona.


GRNC is examining our options, including appeal, legislative action, and possibly an open holster demonstration at the fair. Allow me to say what I told conservative talk show host and GRNC supporter Bill LuMaye: “We don’t know yet how we will react to this setback, but I can tell you one thing: Whatever we do will be done to expand the rights of lawful North Carolinians and their ability to protect their families. The left has called it ‘the long march.’ This is our long march.”


GRNC’s operating philosophy: Never give up. Never give in. Never go away.

It is a long march. I’m reminded of a statement that Gene Hoffman of the CalGuns Foundation made at the 2010 Gun Rights Policy Conference. He said we lost our gun rights over a 40-year period of time and it will take time to get them back.

Update On NC State Fair Injunction Request

Grass Roots North Carolina filed suit last week seeking a temporary injunction to keep the North Carolina State Fair from being posted against carry. HB 937 made changes to the law that should have prevented Agriculture Commissioner Steve Troxler (R-NC) from posting the fairgrounds. I say should have.

Wake County Superior Court Judge Donald Stephens refused to grant the temporary injunction in a ruling this afternoon.

Superior Court Judge Donald Stephens said he believed “it would be unwise and imprudent to allow firearms into the State Fair.”

This is truly a case of the law being what the judges say it is despite the clear wording of North Carolina statutes. Given that Judge Stephens was re-elected in 2012, he won’t be coming up for re-election again until 2020 as Superior Court judges in North Carolina serve eight year terms.

Ag Commissioner Troxler is happy about the decision saying, “”for upholding the longstanding policy banning weapons at the State Fair and for issuing his decision so quickly.” Troxler has contended that the changes in the NC General Statutes brought about by HB 937 are “vague”.

Troxler, who says he is a gun owner himself, argued that the law was badly-worded and legislators had not intended to allow guns at the fair. He said they didn’t belong there, citing the huge crowds and the potential for guns to fall out during midway rides during the annual rain of wallets, keys and change, and then go off.


At the press conference Monday, Troxler said that no matter which way the ruling went this week, there will be metal detectors at all the entrance gates. And after the fair, he said, he would go back to the General Assembly to ask legislators to be clear about what they think the law should say about guns at the fair.


“Either the legislature believes there needs to be concealed carry at the fair or not,” he said.

Troxler, it should be noted, is a practicing farmer as required by Chapter 106 of the North Carolina General Statutes. He is not an attorney. Thus, any claims to the law being vague should be taken with a grain of salt.

The State Fair Facebook page is getting lots of feedback on their announcement of the decision in which they said they are glad Judge Stephens didn’t grant the injunction.

So the North Carolina State Fair will be a gun-free zone. As to the reality of gun-free zones, I’d urge you to listen to what Massad Ayoob said about the recent Gun Rights Policy Conference in Chicago. His comments start at the 1:14:45 mark and are well worth a listen.

BOLO

BOLO is an acronym often used by law enforcement to mean “be on the lookout”. It is often used by cops (or cop shows) to mean a stolen car or a criminal suspect. If you are a concealed carry permit holder living or visiting North Carolina, I might suggest another thing to be on the lookout for.

This is all that is required to post a store or restaurant against the carrying of firearms. While other states may require more explicit or more extensive measures to post a premises, North Carolina does not. Carrying a firearm on a posted premises is a Class 1 misdemeanor in North Carolina.

It seems that not only are the gun prohibitionists trying to encourage owners to post their premises but some of their activists are taking it upon themselves to “unofficially” post the business. Sean Sorrentino at An NC Gun Blog has the full story of a business in Greensboro that was “posted” by one of these activists.

Fortunately, the gun owner who was buying dinner at this establishment questioned why they had “posted” their premises. Not only had the business not done this but by going through their security tapes they were able to identify the anti-gun activist who had done it.

My suggestion if you do see one of these decals on the door of your favorite store or restaurant is to ask to speak to the management. It may turn out that they aren’t anti-gun but rather are victims of a hoax perpetrated by gun prohibitionists. If so, I’d suggest contacting Grass Roots North Carolina with the information. What’s Up With Alamance County

Alamance County, North Carolina is considering a ban on all firearms in county buildings. Currently, only concealed weapons are banned. However, they are reacting to two non-incidents where an open carrier went in to pay their tax bills at the Tax Collector’s Office.

These individuals went in, paid their bills, and left. They were not like some open carry protesters carrying a slung shotgun or rifle but merely carrying a pistol on their hip. Open carry has been legal in North Carolina since the early 1920s based  upon the North Carolina Supreme Court case of State v. Kerner.

Grass Roots North Carolina has issued an alert on the moves by county commissioners to consider the ban.

COUNTY TO DISCUSS GUN BAN


The Times-News is reporting that Alamance County Commissioners are considering a comprehensive gun ban in County Buildings. Not known for being an anti-Second Amendment group, it may seem perplexing that Alamance County leaders would consider such a thing. Apparently, the discussion springs from a couple of recent incidents that are only remarkable in the fact that they are not “incidents” at all.


On a couple of occasions, citizens going about their daily business had stopped in to county offices to pay their taxes. While doing so, they happened to be open-carrying firearms. There has been no suggestion that the citizens acted strangely or threateningly in any way, and it’s worth noting that it is perfectly legal to open-carry in Alamance County buildings. To summarize the situation: no incident occurred, and no laws were broken. However, to be fair, it should be noted that some taxes were paid. So, where’s the problem?


It’s reported that some county employees expressed that they were “scared” by the presence of the lawfully armed citizens paying their taxes. So now, based on the feelings of a few individuals, the Commissioners are considering an all-out gun ban. That would be a gun ban on the very property that is funded by the taxes that these citizens came in to pay. The irony is striking.


When asked about the non-incidents, Sheriff Terry Johnson stated:


“I am a believer in a man’s right to bear arms, but you don’t walk into a county building with a gun strapped on the side of you.”

Which is it? Do the people have the right to bear arms, or don’t they? If Sheriff Johnson truly believes in that right, and intends to honor his oath to protect it, you’d think that he would be incensed that the County Commissioners would even consider a gun ban. One might even point out that Sheriff Johnson himself frequents county buildings, presumably with a gun strapped on his side. The irony is snowballing.


Unfortunately, Alamance County buildings are already posted against concealed carry, which means there is only one option left for citizens to legally bear arms if they need to pass through that particular public space. An additional restriction, one on open-carry, would establish a de facto 100% gun ban, and that would surely call into question Sheriff Johnson’s and the Commissioners’ commitment to the rights of the citizens they serve.

However foolish and ineffective it may be, property owners have every right to ban guns from their private lands and structures. Such is the nature of private ownership. However, if there is any place where the Bill of Rights is clearly applicable, and ought to be non-negotiable, it is on public property. County officials are elected and hired to serve the citizens of the county. It is the citizen who has the right to bear arms, and he or she has the right to do so primarily on public property, for the very reason that it is public—the citizens own it. If the County Commissioners claim the authority to infringe on this right, one can only wonder what’s next.


A gentle prompting may be needed to nudge the Alamance County Commissioners in the right direction. Surely, once they hear from their supervisors (the people), they will recall what it is they are charged with protecting, and whom they are charged with serving. GRNC has learned that Davidson College has invited the public to a panel discussion
on “Gun Rights,
Responsibilities, and Regulations,”
on Monday evening, October 7 in the Lilly Family Gallery of Chambers Building.

The
panel will
address questions such as: What are the trends in the use of guns in
murders and other violent crimes in the U.S.? What is the current status
and
scope of our Second Amendment rights? What does federal law require
regarding background checks prior to gun purchases? What concerns do
law-enforcement personnel have about illegally trafficked guns? Are
changes to current gun laws or regulations warranted, either at the
state or
federal level?

The panel will include Chief Rodney Monroe of the
Charlotte-Mecklenburg Police Department, Chief Jeanne Miller of the
Davidson Police Department, Interim Acting Chief/Captain Carolyn
McMackin of Davidson College Public Safety, Lance Stell, Thatcher
Professor of

Using Tax Money To Lobby Against Gun Rights

The North Carolina School Board Action Center is a 501(c)(4) organization funded by individual county school boards. As a 501(c)(4) organization, they are allowed to lobby the General Assembly and take part in political campaigns so long as their “primary activity is the promotion of social welfare” according to the IRS. The NCSBAC is the political action arm of the North Carolina School Boards Association and receives its funding through property taxes allocated to the local school boards.

It seems that one of their primary legislative objectives is the repeal of that part of NC GS 14-269.2 which allows limited campus carry for employees who live on campus and allows concealed carry holders to store a firearm in their locked vehicles while on school property.

Grass Roots North Carolina is taking issue with tax money being used to lobby against our gun rights. They released an alert yesterday about it and ask that people contact their local county commissions and school boards to make their displeasure known.

NC School Boards Assoc Uses YOUR MONEY To Attack Gun Rights

Creates “North Carolina School Board’s Action Center”, a new 501(c)(4) organization designed to divert Education
funds to promote personal anti-gun agenda…

Since Governor Pat McCrory signed HB 937 into law, the North Carolina School Board Association
has been
touting its newly formed North Carolina School Board’s Action Center
(NCSBAC), a new 501(c)(4) organization designed to “strengthen local
school board advocacy efforts”.  The group receives its funding from
individual county school boards through the collection of property
taxes.  Among their stated primary objectives is to advocate for the
repeal of NCGS 14-269.2, which recently granted law-abiding North
Carolinian’s with limited campus carry provisions.

That’s right,
the NCSBAC is devising a scheme to misappropriate tax dollars
collected for education purposes to fund their anti-gun agenda!  The
brainchild of Charlotte-Mecklenburg School Board Vice-Chairman
Tim Morgan and political director Leanne Winner,
who has been crisscrossing the state spewing her
propaganda during district-wide legislative reviews, has made the
organization’s intentions clear:  to attack the limited Campus Carry
provisions which go into effect on October 1st.

Specifically,
she has advised local school board members that “NCGS 14.269.2
is a safety concern for public schools”.  She repeatedly and mockingly
states that the reason for allowing concealed carry permit holders
to retain their guns in a locked car was to provide them with the
opportunity to “save the day” in the event of a school
shooting.   But, in her opinion, the real effect of the legislation was
to create a situation where adults angry over the outcome of a high
school football game could settle their disputes by “shooting it out in
the parking lots”.  Winner goes on to say that NCSBA will use
their 501(c)(4) organization to repeal this provision of  NC GS
14-269.2.

Enough is enough!

While the
continued economic downward turn is forcing teacher layoffs and reduced
funding to schools across the state, the notion that what little funds
remain
be spent on pressing a personal political agenda becomes all the more
incredulous. Our tax dollars can be utilized in a multitude of more
efficient
ways to raise and maintain the educational standards of our children
than to have them diverted into such pet projects filled with outright
anti-gun
propaganda.

they no longer fund the NCBAS until such time as they turn their
attention away
from personal political projects and return to working to better the
educational system in North Carolina in a more meaningful way.

Commissioner:

It has been brought to my attention that the North
Carolina School Board Association has created a 501(c)(4), the North
Carolina School Board’s Action Center, to specifically target positive
pro-gun legislation recently signed into law. As a taxpayer within your
county, I am offended by this scheme and ask you to instruct the school
board that none of our tax dollars be used to
fund the NCSBAC. I adamantly oppose any misuse of education funds.

I
hope that you will represent me by advocating for education and demand
that no money from our county school board be misappropriated by the
NCSBAC. I will be monitoring this situation via alerts issued by Grass
Roots
North Carolina and will remember to vote accordingly.

Safe Restaurants Project

In response to anticipated efforts by the gun prohibitionists, Grass Roots North Carolina is launching the Safe Restaurants Project. As the release below makes clear, it is an effort to encourage restaurant owners to NOT post their restaurants against concealed carry.

Gun Group Targets Restaurants

GRNC ‘Safe Restaurants Project’ will admonish gun rights supporters to report restaurants which post against concealed handguns

Recently signed by Governor Pat McCrory, on October 1st House Bill 937 will expand North Carolina’s concealed handgun law into restaurants. Under the statute, restaurants may still elect to post signs prohibiting firearms.

Although concealed handgun permit-holders will still be prohibited from imbibing alcohol, gun control advocates are already planning to pressure restaurants to prohibit concealed carry.

Accordingly, and with great reluctance, GRNC is responding with its “GRNC Safe Restaurants Project,” to ensure the new law will provide its intended deterrent to violent crime.

The 3 objectives of the “GRNC Safe Restaurants Project”:

  • Provide education for concealed handgun permit-holders to avoid accidental violations;

  • Provide “Protection Preferred” signage enabling supporting restaurants to subtly identify their support to permit-holders and supporters; and

  • Create a “Restaurant “Don’t Buy List” which:

  • Allows thousands of gun owners to report posted restaurants;


  • Sends restaurants notification they have been reported and requests them to remove signs or inform GRNC that a mistake has been made;

  • Provides contact information for posted restaurants, enabling thousands of supporters to contact those restaurants to explain that they will not patronize posted establishments.

GRNC will distribute Restaurant Don’t Buy lists and relevant materials to tens of thousands of gun owners via:

  • GRNC’s email alert network, comprising 87,000 supporters;


  • Gun shows in Asheville, Hickory, Charlotte, Winston-Salem, Lexington, Concord, Greensboro, Raleigh, Fayetteville and Jacksonville;

  • GRNC’s distribution network of nearly 50 gun shops;

  • Concealed handgun permit classes statewide; and

  • GRNC’s highly popular website.

Said GRNC president Paul Valone:

“It’s unfortunate GRNC must counter gun control activists’ attempts to undermine a law intended to deter restaurant crime and save lives. We fully sympathize with restaurant owners caught in the middle of a battle we’d rather not fight, but they should understand that, according to the Pew Research Center, gun rights supporters donate four times more and are more politically involved than gun control advocates. They should ask themselves whether they want to alienate the 399,268 North Carolinians who have applied for concealed handgun permits.”

This brings to mind a suggestion made many times by Tom Gresham when coming across a store or restaurant that is posted against concealed carry. Tom calls the establishment and says to the manager, “I wanted to shop (or eat) at your store (restaurant) but it was unsafe.”  When they ask what you mean, you tell them they have posted against concealed carry and you won’t subject your family to the risk. Then you tell them what you spent at their competitors. To really get the point across, you fax them a copy of your receipt from their competitor. Done often enough, it will get the message across.

GRNC On HB 937 Being Signed Into Law

Grass Roots North Carolina released a statement last night thanking Gov. Pat McCrory (R-NC) for signing HB 937 into law. While they are more generous towards the governor than I was in the last post, it is probably because they are better at this political stuff than I am.

They are also asking people to send a note of thanks to McCrory, Speaker Thom Tillis (R-Mecklenburg), and Senate President Pro-Tem Phil Berger (R-Rockingham). I think that is a smart idea. Politicians too often hear from us when they’ve screwed up or done something to piss us off. They need to hear from us with the attaboys as well. It will help reinforce their “proper behavior” when it comes to gun rights.

HB 937 Finally Becomes Law!

Governor signs HB 937 just minutes ago…

GRNC has learned that Governor McCrory has just signed HB 937 into law. After a long and sometimes hard fight to push HB 937 through the North Carolina General Assembly (NCGA) and onto the Governor’s desk, victory is finally at hand. More information concerning this issue will follow in future GRNC alerts, but for now we can take a collective breath and celebrate by thanking those who have worked hard to move HB 937 from the House and Senate all the way to the Governor’s desk.

Below, you will see contact information for many of the key legislators involved. Please take a moment to thank them for their hard work and dedication. Above all, GRNC would like to thank all of YOU for your tireless efforts through this process! Without your dedication and steadfast resolve, HB 937 would have been left on the shelf or buried in yet another obscure committee to die a low death. Despite efforts to derail HB 937 at several points in its journey, Grass Roots North Carolina worked hard to claim victory and that victory would not have been possible without YOUR help!
