Screwing Up HB 937

It was not bad enough that the North Carolina House didn’t concur with the Senate on the changes to HB 937 but now the House sponsor Rep. Jacqueline Schaffer (R-Mecklenburg) and House chair of the Conference Committee is proposing to make it worse. I could make snide comments about Mecklenburg County politicians such as Tillis, Schaffer, and McCrory screwing up the state for the rest of the 99 counties but I won’t.

Grass Roots North Carolina has the details below in an alert sent out late last night.


A DEAL TO PUNISH GUN OWNERS

HB 937 was making the partial repeal of the current Jim Crow-era pistol permit system look like a reality. Then, the political pressure mounted.

GRNC has learned that the partial repeal of the current, old-fashioned system is in jeopardy, and worse, the current system might become even more complicated and restrictive. The NRA has not “signed off” on the partial repeal of the old permit system, and worse, someone has convinced HB 937 sponsor, Rep. Jacqueline Michelle Schaffer, to modify the language such that NICS checks are to be required for pistols purchased with permits more than 30 days old.

There are two problems with this:

  1. The NCSA has already said that NICS checks are not adequate. So why subject law-abiding gun owners to additional pointless background checks?


  2. According to GRNC President, Paul Valone, “This action would punish innocent gun owners for the malfeasance of the NCSA, and is unacceptable!”

Speaker Tillis, Representative Schaffer and Governor McCrory are poised to bow to the NCSA pressure. This would be a major sellout of North Carolina gun owners. If political pressure pushes these politicians to punish us, GRNC may encourage gun owners to sit out the 2014 midterm elections. The Speaker, Rep. Schaffer, Gov. McCrory and all of the Republicans in Raleigh need to know that they can’t take gun owners for granted, and any anti-gun actions will not be tolerated. Dear Speaker Tillis, Representative Schaffer, and Governor McCrory:

I have recently learned of a compromise being considered regarding HB 937, and I am writing to tell you that making our state’s outdated pistol permit system even worse than it already is will not help your esteem in the eyes of gun owners. Simply leaving the current Jim Crow-era system in place would be bad enough. However, what is being proposed would create a system that is even more difficult for law-abiding citizens to navigate than the current system. The new proposal would add a new thirty-day limit to permit validity, which would then require a point-of-sale NICS check. This is not acceptable.

It is the decades-long malfeasance of the NCSA and their support of a current system that has allowed the “arming felons” loophole to remain in place. Keeping this old-fashioned system, and then making it yet even more complicated and unjust is not an improvement. In fact, if this new restriction to the current permit system is added, I, and surely thousands of other gun owners in North Carolina, may sit out the 2014 midterm elections. Gun owning voters will not be taken for granted.

I strongly urge you to stand firm against the political pressure to compromise at the expense of gun owners. This is not an acceptable compromise by any stretch, and if it happens, the Republicans will be held responsible, and they will feel it at the polls.

GRNC Alert On The HB 937 Conference Committee

Grass Roots North Carolina issued an alert last night regarding the move the NC House to send HB 937 to a Conference Committee. The move, while disappointing, was not unexpected given the staunch opposition by the NC Sheriffs Association to doing away with the Jim Crow-era pistol purchase permit system. There had been rumors that Gov. Pat McCrory (R-NC) would veto the bill if that provision was not removed as a way to placate the sheriffs.

The alert from GRNC encourages gun rights supporters to contact Speaker Thom Tills (R-Mecklenburg), Sen. President Pro-Tem Phil Berger (R-Rockingham), and Gov. McCrory to demand that, with the exception of the pistol purchase permit system, nothing else be dropped from the bill.

House sends bill to conference committee


As expected, the NC House today voted against concurring with Senate changes to HB 937 (“Amend Various Firearms Laws”). The bill contains provisions for concealed carry in restaurants, assemblies of people for which admission is charged, state-controlled parking lots, educational properties (provided guns are kept in locked vehicles) and much more. If passed largely intact, it will represent the largest advance in gun rights in North Carolina history.


At issue is the repeal of North Carolina’s Jim Crow-era pistol purchase permit law, which is opposed by the NC Sheriffs’ Assoc. and Governor Pat McCrory. While GRNC strongly urged that the House concur with Senate strengthening of the bill, leaving the full PP repeal intact, we remain optimistic about resolution of differences because Speaker Thom Tillis’ office has said that:

  1. Other aspects of the bill will not be weakened in committee and will, in fact, likely be strengthened in at least one respect;
  2. Although the PP repeal will not stay in entirety, in a radio interview Tillis has promised a compromise which will at least partially satisfy the concerns of all interested parties, including GRNC; and
  3. The bill will pass THIS YEAR.

While I am disappointed that Republican leaders bowed to demands by the North Carolina Sheriffs’ Association, which seems to oppose repeal of the Jim Crow-era pistol purchase permit law entirely for reasons of power and money, I remain optimistic that leadership will deliver a strong bill to the gun-owning voters who elected them.


It goes without saying that all other aspects of House Bill 937 must remain entirely intact. Beyond that, any “compromise” worked out on the purchase permit repeal must: (1) Not impose additional burdens on gun owners, including (but not limited to) record-keeping on firearm transfers and restrictions and limitations on permits; and (2) Close the “arming felons loophole” by repealing at least the portion of the law dealing with dealer transfers.


Realizing that conferees will be acting only on the approval of leadership, I will hold you responsible for the HB 937 conference committee report. I hope to tell other gun-owning voters, in future elections, that you supported their rights. I will closely monitor this issue via Grass Roots North Carolina legislative alerts.

Sean Meets Gabby And Mark

Actually that is a misleading headline as Sean Sorrentino wasn’t one of the 14 hand-picked “gun owners” chosen to sit down for a “discussion” with Gabby Giffords and Mark Kelly in a Raleigh BBQ restaurant.

He tells me that he did get to see them…from a distance as they exited the side door of the restaurant surrounded by “a phalanx”. Hmmm.

Sean has an excellent after-action report of the Giffords-Kelly whirlwind visit to Raleigh and the media’s reaction to it. The headlines are not quite what Americans for Responsible Solutions would have liked.

Sean and the rest of his hastily assembled group of friends did a great job yesterday. It shows what real grassroots action looks like.

Guess Who’s Coming To Town! (Updated)

The Tar Heel State will be “graced” tomorrow by a visit by Gabby Giffords and Mark Kelly. They are supposed to be somewhere in the Research Triangle – Raleigh, Durham, and Chapel Hill – area but they seem to be very coy about just where. I guess they don’t want what happened to them in North Dakota to happen to them here.

Grass Roots North Carolina would like to properly welcome them. They are offering a reward of a 100 rounds of either 5.56 or 7.62×39 ammo to the first person to locate them.

Yet they hide their “Rights & Responsibilities” tour’s July 7 Raleigh stop from gun owners they purport to represent!

Former Rep. Gabrielle Giffords and astronaut husband Mark Kelly, who fancy themselves the next Sarah and Jim Brady, having been touring the country to push for what they claim are just “background checks.” In truth, of course, the federal proposals they advocate would criminalize mundane behaviors such as gifting a gun to your mother and would further their hidden agenda to turn the computerized “National Instant Criminal Background Check System” (NICS) into a defacto gun registration system.

To divide and conquer gun owners, they claim to be shooters and have posed for photo ops of Giffords flinching off a few shots in Las Vegas and elsewhere. Gee, whiz, they say, they’re just gun owners like the rest of us and, of course, we all support “background checks,” right?

Gun control carpet-baggers in NC TOMORROW

Although their website lists Raleigh as a tour stop, it is the only stop for which the group refuses to provide a precise time and location, indicating they learned from our counter demonstration to greet “Mayors Against Illegal Guns” two weeks ago, in which GRNC’s counter demonstrators outnumbered MAIG’s participants.

Indeed, they are refusing to release the details to the public, leading one to ask: Why are they hiding from the gun owners they claim to represent? Last night, the Raleigh News & Observer said:
“Details have been withheld until Friday night, and even now the precise location has not been publicly disclosed. Reporters will be given information once they are confirmed.

“All that’s known now is Giffords and Kelly will go shooting at a local sporting clay range in the morning, followed by a roundtable discussion with gun owners, and then a picnic with local members of their gun-control group, Americans for Responsible Solutions. The couple will meet with reporters after the roundtable.”

‘Where’s Gabby?’

Since Rep. Giffords and her hubby say they want a “roundtable discussion with gun owners,” GRNC would like to give it to them. So in a variation of that old child’s game, “Where’s Waldo?” GRNC now asks you to play “Where’s Gabby?”

GRNC has received word that Gabrielle Giffords and her husband Mark Kelly will be hosting an anti-gun roundtable tomorrow morning at Pit Barbeque in Raleigh. The event will take place some time around 11:00 am. We need as many pro-gun people as possible to begin showing up around 10:00 am. This will be an anti-freedom lovefest that the media will use to back their false claims that you want more gun control. It is up to you to stop this from happening. By your showing up and defending your viewpoint, you can steal their thunder and prevent their making a case for taking more of your rights.

UPDATE II:  It appears that you had to be one of the “select” to have met with Giffords and Kelly. According to WRAL, they met with 14 selected individuals who were members of their new gun control organization.

After a trip to a shooting range, they met at The Pit restaurant in downtown Raleigh with 14 hand-picked members of the organization, all of whom are gun owners, to lobby for expanded background checks.

“Gabby and I are both gun owners. I’ve served in the military for 25 years,” Kelly said. “We are strong supporters of the Second Amendment.”

 It is hard for me to see just what they accomplished in their trip around the nation other than gathering a bit of media attention. IF they really wanted to draw major attention to themselves in North Carolina, Giffords and Kelly would have joined the disgruntled progressives in their so-called “Moral Mondays” outside the North Carolina General Assembly. Not that I’m trying to give them ideas but there is a major bill awaiting concurrence before the NC House that significantly advances gun rights.

Raleigh was the last stop on the couple’ seven-city Rights and Responsibilities tour. The ARS is hosting small roundtable discussions with gun owners, victims of violence and others. Giffords is expected to head to Asheville next for more rehabilitation therapy. She has aphasia as a result of her injuries and struggles to speak and walk.

“Hello, Raleigh. Stopping gun (violence) takes courage,” Giffords said, reading from a statement. “The courage to do what’s right. The courage of new ideas. I’ve seen great courage when my life was on the line. Now is the time to come together. Be responsible. Democrats, Republicans, everyone. We must never stop fighting. Fight, fight, fight people. Be courageous. The nation is counting on you. Thank you.”

Fourteen people were invited to be part of the roundtable discussion. About half said they were gun owners and 10 of the 14 knew someone who had been shot or killed by guns.

The best comments on the Giffords-Kelly visit comes from Sean Sorrention of An NC Gun Blog who was interviewed by the N&O reporter.

“(They’re) having a roundtable discussion with gun owners and somehow our invitation got lost in the mail,” said Sean Sorrentino, a representative for Grass Roots North Carolina.

Sorrentino said criminal-background checks violate citizens’ Second Amendment rights.

“It’s saying I have to prove my innocence before I can use my Second Amendment rights,” he said.

Now I’m going to say something that might be considered impolitic or not judicious but it has been at the back of my mind since Giffords has re-emerged in public. I don’t mean to be insensitive or “a meany” though I will be accused of it by the gun prohibitionists. The mention of Giffords coming to Asheville for more rehab makes me wonder just how capable she is of coherent and rational thought. Every time she speaks in public it is from a simple, pre-written statement or with the words being put into her mouth by her husband Mark. She always seems to have some sort of a “handler” at her side. It is as if she is a puppet or wind-up doll being used to promote someone else’s agenda which I find quite sad.

I don’t know enough about traumatic brain injuries to know whether having a bullet travel through the left side of your brain is worse than the concussive force of an IED explosion. One would have to assume it is much worse. I feel for Ms. Giffords for what she has been through. She didn’t ask for a madman who passed a NICS check to shoot her. That said, I have this nagging feeling that just won’t go away that she is just not capable of having an opinion on gun control one way or another and that she is being used by her husband and others. I also wonder if she wrote or could she even compose the comments she read at the event today.

The Push For Concurrence On HB 937 Continues

It appears that NC Speaker of the House Thom Tillis might be going wobbly on HB 937 and is also spreading misinformation on the position of Grass Roots North Carolina. With Tillis now an announced candidate for the US Senate to run for the seat held by Sen. Kay Hagan (D-NC), it is time to ramp up the pressure on both Tillis and the rest of the Republicans in the North Carolina House.

From the latest GRNC alert:

It has come to our attention that the office of NC House Speaker Thom Tillis has told callers that GRNC “supports” removal of the pistol purchase permit repeal from House Bill 937 and the replacement of the measure with a study commission. That is a misstatement of GRNC’s position.

With less than two weeks remaining in the legislative session, it became clear that Speaker Tillis, faced with Governor McCrory’s acquiescence to demands by the NC Sheriffs’ Assoc. to remove the purchase permit repeal, might simply kill the entire bill by bringing it to the floor and re-referring it committee, where it would languish, rather than choosing between gun owners and sheriffs.

HB 937 cannot be ‘amended’

Meanwhile, input we have received suggests that gun owners are of two minds: One faction notes that the purchase permit repeal was not in the original bill, and that the substantial gains of restaurant carry, campus carry, assemblies for which admission is charged and more should not be risked for one provision we might be able to get later. Others want us to stand strong for the repeal because other aspects of the bill primarily benefit concealed handgun permit-holders more than other gun owners.

To those who have suggested we simply “amend” HB 937 to remove the purchase permit language, however, we are compelled to note that bills are not amendable on concurrence votes. The only option is for the House not to concur, in which case the bill goes to a conference committee comprising members of both chambers. Please note: Once the bill is in conference, we have no direct control over what comes out. The single and only alternative if we don’t like what results would be to kill the bill in its entirety. It is for that reason GRNC has opposed sending the bill to conference.

GRNC strongly urges legislators to concur

In the position just sent to the NC House, GRNC continues to admonish legislators to vote for concurrence. Acknowledging that it is critical to keep the bill moving as the end of the session approaches, however, we also advised them that we will not track the vote on concurrence PROVIDED that the bill is not otherwise weakened in the conference committee. Although we cannot speak for other organizations, representatives of both the NRA and NCRPA have expressed support for the position.

Presuming the bill goes to a conference committee, here is what we will push for:

1. Keeping restaurant and campus carry and all other aspects in the bill;
2. Repeal or curtailment of the present purchase permit system; and
3. Inclusion of key legislators whom we can trust on the committee.

What GRNC will not accept

If, however, a weaker bill leaves the conference committee, any legislator who voted to send it to conference will be assessed as having voted against the interests of gun owners, which will be reflected in “Remember in November” candidate evaluations. This is intended to give the less resolute members of the Republican caucus “ownership” in what the committee produces.

In particular, there is one “deal killer” which may cause GRNC to oppose the bill: Shortening the duration for which purchase permits are valid, which is currently five years. Doing so would punish lawful gun owners for the malfeasance of the Sheriff’s Association, which has known about and refused to address the system’s flaws for decades.

It Is Time To Demand Concurrence On HB 937

The North Carolina Senate took the House-passed HB 937 and made a good gun reform bill into a near great one. The North Carolina Sheriffs’ Association in now balking on passage of the bill due to the elimination of the archaic and racist pistol purchase permit system run out of each county’s sheriffs’ department. As the alert below from Grass Roots North Carolina makes clear, what they really object to is a loss of power and a loss of revenue.

News stories about the recent shooting in Greenville, North Carolina are now trumpeting that the Pitt County Sheriffs’ Department had turned down the shooter for a “gun permit” last year. The only problem is that North Carolina doesn’t have a “gun permit.” If what they are saying is that he was turned down for a pistol purchase permit by the sheriff, it certainly didn’t stop the shooter from obtaining the shotgun which he used to wound four people. Nowhere in any of the stories about this shooting is mention made of just how the shooter did obtain the shotgun. He may have owned it for years, he may have stolen it, or he may have legally purchased it after a NICS check. We don’t know but I would wager the reason we are hearing that the shooter was turned down for a “gun permit” is part of the effort to stymie HB 937.

DEMAND CONCURRENCE ON HB 937

In recent days, the North Carolina Sheriffs’ Association (NCSA) has flip flopped on its support for HB 937, a common sense bill that would modernize North Carolina’s gun laws, and allow law-abiding citizens to better defend themselves and their families from predators who do not pay attention to gun laws. The reason for the NCSA’s reversal on this bill clearly revolves around the money the sheriffs collect, and the power they maintain, through our State’s outdated pistol permit system.

Aside from the fees the sheriffs are currently charging in the current system, each county’s sheriff has unlimited power to decide who may or may not purchase a handgun. That means your county’s sheriff can arbitrarily deny anyone their Second Amendment rights, absent any due process. For these reasons: money and power, the NCSA does not want this shameful, Jim Crow-era leftover to be eliminated. But HB 937 would do just that. It would eliminate it, and replace it with the fair and reliable National Instant Criminal Background Check System (NICS). This is a dependable, computerized system that has been tried and tested, and in thirty-six states it is the sole background check system, eliminating old-fashioned pistol permits.

The NCSA has had a lot to say about what it would mean to eliminate the current system, a system in which they hold all the power. Let’s examine their statements, and contrast them with the facts:

The NCSA Says: NICS obtains criminal records from North Carolina only regarding persons who are fingerprinted, which includes felons and some limited categories of misdemeanants. Many misdemeanants, punishable for up to two years in prison, are not fingerprinted and, therefore, are not reported to NICS.
The Fact Is: People convicted of state-level misdemeanors punishable by less than two years are not prohibited from owning firearms under federal law, meaning sheriffs want discretion to deny permits to people who are not prohibited.

The NCSA Says: North Carolina state law only requires the Clerks of Superior Court to report to NICS a limited category of those persons involved in an involuntary mental health commitment.
The Fact Is: According to the FBI, the NICS database encompasses: A person adjudicated mental defective or involuntarily committed to a mental institution or incompetent to handle own affairs, including dispositions to criminal charges of found not guilty by reason of insanity or found incompetent to stand trial.

The NCSA Says: Persons from North Carolina who are prohibited by federal law from possessing a firearm, but who are likely to not be discovered by a NICS check, are persons who: Are under indictment or information in any court for a crime punishable by imprisonment for a term exceeding one year; Have been convicted of a crime punishable by imprisonment for a term exceeding one year; are fugitives from justice; are unlawful users of or addicted to any controlled substance; have been adjudicated as mentally defective or have been committed to any mental institution; Who are subject to a court order restraining them from harassing, stalking, or threatening an intimate partner or child of the intimate partner; or Who have been convicted of a misdemeanor crime of domestic violence.
The Fact Is: The FBI says otherwise. Their description of the contents of NICS cover all of the situations that the NCSA mentions above.

The NCSA Says: The pistol purchase permitting process in North Carolina is currently far superior to the NICS check and provides increased public safety for our citizens.
The Fact Is: For rifles and shotguns, the NICS is already used in North Carolina, and without objection from the NCSA. If NCSA considers NICS to be an inadequate means of background check, why has it not objected to its use as the sole background check system for long guns?

The NCSA Says: Sheriffs’ “local knowledge” gives them familiarity with local residents that goes above and beyond what the NICS can provide.
The Fact Is: NCSA’s “local knowledge” argument is a stretch. Although sheriffs claim that familiarity with local residents gives them knowledge above and beyond that provided by NICS, the argument is rife with flaws. Just one example would be the fact that Mecklenburg County has processed 12,000 permits thus far for 2013. Is it the position of the NCSA that sheriffs in large counties routinely check tens of thousands of households? Unlikely.

The NCSA needs to get its facts straight, and the antiquated pistol permit system needs to be replaced with a proper, twenty-first century alternative. It’s also a fact that the NCSA’s misguided opposition to this one provision in HB 937, threatens to derail the entire bill. That’s a real problem.

Honorable Members of the North Carolina House:

I have recently become aware that the North Carolina Sheriffs’ Association (NCSA) has been distributing misinformation about our State’s archaic pistol permit system, an outdated system that HB 937 seeks to replace with modern, computerized background checks. The NCSA has gone so far as to refer to the current system as “superior” even though it still contains the “arming felons loophole.”

I am writing to inform you that I strongly support HB 937, as currently written, and I would consider a vote against concurrence to be an anti-gun vote. I encourage you in the strongest terms to vote for concurrence in order to strengthen and modernize our State’s gun laws.

Originally, the NCSA had supported the bill entirely, and even now they still claim to support it, but only oppose the provision that removes the purchase permit requirement. The NCSA seems desperate to hang on to last century’s permitting method, no doubt so they can continue to use it to collect fees that they are currently attempting to double, and to maintain unchecked power over who can obtain a pistol permit. I have done my research, and I strongly disagree with the NCSA’s new position.

I’ve learned that thirty-six states are already using the dependable, computerized National Instant Criminal Background Check System (NICS) as the sole means of conducting background checks. I also know that the nature of our outdated pistol permit system opens the door for dangerous criminals to buy guns with pistol permits that were legally obtained before the criminals committed their crimes. These old-fashioned paper permits are not traceable nor are they revocable, and they remain valid for years. This “handguns for felons” loophole would be eliminated through use of the NICS.

The NICS is also a fair system in which everyone can expect to be treated equally under the law. Through the NICS, sane, law-abiding citizens cannot be denied their Second Amendment rights for arbitrary reasons. This is something that cannot be said of the current pistol permit system, which can be used to subjectively deny any citizen a pistol permit without due process. That is just wrong, and it’s time to do what’s right.

Again, I ask that you vote for concurrence on HB 937. A vote against concurrence would indeed be an anti-gun vote. Please do what’s right, and bring North Carolina’s gun laws into the twenty-first century. I will be monitoring your actions via Grass Roots North Carolina legislative alerts.

DEMONSTRATION GUIDELINES


  1. Firearms are prohibited by law at demonstrations and protests.
  2. Dress for the press: Please avoid wearing anything which allows the media to depict us as the radicals rather than our opposition (e.g. shirts with slogans which could be construed as racist, etc.)
  3. Keep signs on message: GRNC will have a large number of lime green “Guns Save Lives!” signs which are highly effective at showing up on TV cameras, but you are free to bring your own. However, please don’t use signs which could be used to depict us in a negative light, and stick to the pro-gun message.
  4. This is a peaceful counter demonstration: Do not engage in heckling or other altercations with the opposition.

Are NC Republicans Caving To Sheriffs’ Association?

Gov. Pat McCrory (R-NC) seems to be caving to the demands of the NC Sheriffs’ Association with regard to pistol purchase permits. According to GRNC, McCrory has instructed the House Republican Caucus to send HB 937 to a conference committee rather than to concur with the Senate version of the bill.

However, it should be noted that the House Republicans led by Speaker Thom Tillis are under no obligation to follow any instructions from McCrory. Tillis has announced his intention to run for the US Senate and will need the votes from gun rights supporters if he hopes to win the primary. As GRNC notes below, he needs to be reminded of this.

It has become clear that the cabal committed to preserving NC’s embarrassing and obsolete Jim Crow-era pistol permit system is being led by NC Sheriffs’ Association Executive Director, Eddie Caldwell. Not an elected Sheriff subject to the will of voters, but rather a lobbyist hired by the NCSA, he is clearly more interested in protecting his cushy job and benefits than the rights of North Carolinians.

HB 937 in jeopardy: McCrory needs spine injection

Worse, Governor Pat McCrory seems to be getting week in the knees in the face of sheriffs’ demands, and has instructed the House Republican Caucus to vote not to concur and to send the bill to a House-Senate conference committee to remove the measure. What is at stake, however, is not just the purchase permit repeal, but the entire bill, including restaurant and campus carry. Why? Because if the bill goes to conference committee — which will give the media and UNC more time to agitate, anything could be removed.

Implications of conference committee

GRNC has had extensive discussions with Senate Republicans, and we are certain they were sincere in the changes to HB 937 they made. There was no deliberate effort to cut out Eddie Caldwell and NCSA from legislative plans.

Currently, there have been no indications that the Governor intends to veto the bill, but he did tell the Republican Caucus that he wants the bill sent to conference committee to change the permit provision to one which “studies” the issue. Representatives for House leadership have indicated willingness to move “a” bill, but have not committed to what will be in it.

GRNC opposes the conference committee for the following reasons: As you may or may not know, once both chambers have passed different versions of a bill, it goes back to the first chamber for concurrence. By legislative rules, a bill cannot be amended on concurrence, so removing the PPP provision could only be done by voting not to concur and then sending the bill to a conference committee comprised of members from each chamber.

There are several problems with that, not the least of which is that once it goes there, we have absolutely no control over what comes out. Added to that, the media will get additional time to beat on Republicans for weakening amendments.

IMMEDIATE ACTION REQUIRED!

We need gun owners to do four things:

  • TELL McCRORY TO DEVELOP A SPINE: He should resist the feather-bedding of the NCSA, particularly given the fact that felons are bypassing background checks under the current system;

  • CONTACT ALL NC SHERIFFS: Tell them the rights of NC gun-owning voters are more important than Eddie Caldwell’s pay.

  • TELL SPEAKER TILLIS THE NEXT MOVE IS UP TO HIM: Tillis doesn’t have to kowtow to either the NCSA or the Governor. Given his announced bid for Sen. Kay Hagan’s seat, it would be shame for him to further alienate gun owners by failing to concur. Therefore, he should move quickly and resolutely to vote to concur.

  • HELP GRNC PASS HB 937: GRNC has spent tens of thousands of dollars on radio spots, alerts and legislative team expenses to pass what could be the most pro-gun initiative in North Carolina history, but we can’t do it without your support, so please go HERE or to: http://www.grnc.org/join-grnc/contribute

  • CALL YOUR NC HOUSE REP: Let him know the sheriffs’ association has known about the “felon loophole” for decades and done nothing. Their objections ring false. If you cause House Bill 937 to be sent to conference committee for the pistol purchase permit repeal to be removed, you will be in the position of obstructing Point of Contact background checks for gun purchases.

The North Carolina Sheriffs’ Association (NCSA) has known for decades about the loophole enabling felons to evade background checks. The National Instant Criminal Background Check System (NICS) has been in existence since 1998. What has the NCSA done to close this loophole?

Nothing. And the reason is as old as man himself: Power and money. If the measure dies and a felon uses a purchase permit to buy a firearm and then uses it in a crime, you will be responsible.

I strongly urge you to push for immediate House concurrence and final approval. Conference is too dangerous and potentially damaging to what now stands as a bill which balances Second Amendment freedoms with punishing violent predators. I will monitor your actions via Grass Roots North Carolina legislative alerts.

NC Sheriffs’ Associaton Threatens Passage Of HB 937

Just like any politician, there are some sheriffs in North Carolina who are resistant to give up a power over their constituents’ lives. It doesn’t matter that this power doesn’t improve public safety, that it allows felons to purchase firearms without a NICS check, and that its intent when passed in 1919 was to keep African-Americans from being armed. The power in question is the pistol purchase permit issued by each county’s sheriff and the resistance is coming from the North Carolina Sheriffs’ Association.

The Sheriffs’ Association is asking the NC House of Representatives to not concur with the State Senate on HB 937. Grass Roots North Carolina just released an alert about their opposition to HB 937.

Sheriffs’ opposition could sink restaurant/campus carry and other initiatives!

The North Carolina Sheriffs’ Association (NCSA) is pressuring both House Speaker Thom Tillis (R, Mecklenburg, GRNC ****) and NC Governor Pat McCrory (R, GRNC-***) to oppose GRNC’s repeal of the antiquated pistol purchase permit system that has been in place since 1919. As part of omnibus gun bill HB 937, which contains restaurant and limited campus carry, the purchase permit law would be repealed IF the House votes to concur with Senate improvements to the bill and IF Gov. McCrory doesn’t veto it.

Felons with purchase permits

The purchase permit law slated for elimination through HB 937 was designed to grant discriminatory power to NC Sheriffs and enable them to subjectively deny handguns to whoever they consider “undesirable.” To this day, several counties abuse the permit system in ways that make it difficult for law-abiding citizens to rightfully obtain handguns.

Ironically, as documented by The Charlotte Observer, the law sheriffs defend is letting untold numbers of felons bypass background checks to buy guns. Why? Because the untrackable slips of paper issued by sheriffs after background checks can’t be repealed and are good for 5 years. Eliminating the system would mean that checks using the National Instant Background Check System (NICS) would be done at the point of sale.

Sheriffs want money & power

Beyond the power to deny purchase permits for arbitrary reasons by claiming applicants don’t have “good moral character” (whatever that means), consider the fact that currently proposed legislation will double the fees sheriffs collect. Are Sheriffs refusing to do what’s right in order to maintain a cash cow worth millions?

IMMEDIATE ACTION REQUIRED!

Keep HB 937 from dying: Send 3 emails and make 3 phone calls:

  • GOVERNOR PAT McCRORY: First, email him BY CLICKING HERE or going www.governor.state.nc.us/contact/email-pat and then call him Monday morning at (919) 814-2000. Let McCrory know that contrary to what the Sheriffs’ Association claims, HB 937 IMPROVES background checks.

  • EMAIL ALL NC SHERIFFS: Using the copy-and-paste list of emails and the message below.

  • CALL YOUR SHERIFF: Ask them (1) Whether they oppose repeal of a Jim Crow law which allows felons to circumvent background checks, making law-abiding citizens vulnerable to gun control; and (2) Whether they know that is the position of the association which claims to represent them.   • EMAIL & CALL SPEAKER THOM TILLIS: Let him know that you appreciate his earlier efforts, but that the Senate has upped the ante and now he needs to resist the power-hungry NC Sheriffs’ Assoc. and pass HB 937 AS IS by making sure the House VOTES TO CONCUR. For reasons of money and power, North Carolina Sheriffs’ Association executive director Eddie Caldwell is placing you in the untenable position of supporting a Jim Crow-era handgun purchase permit law which is letting untold numbers of felons bypass computerized background checks. Tell me: What will you do if you kill or delay the measure and then one of those felons kills someone, perhaps a child? Will that death be on your shoulders?

As documented by The Charlotte Observer, as many as 60 felons in Mecklenburg County alone might continue hold purchase permits after being convicted, enabling them to bypass the computerized National Instant Background Check System (NICS) because the untrackable slips of paper issued by sheriffs after background checks can’t be repealed and are valid for 5 years. How many felons does that translate to statewide? 2,000? 3,000? Eliminating the system will mean that checks using the NICS would be done at the point of sale.

Support the purchase permit repeal: House Bill 937 does an exceptional job of expanding the Second Amendment rights of law-abiding citizens while strengthening background checks. I will be closely monitoring your actions on this issue via Grass Roots North Carolina legislative alerts. Rest assured that I will remember them in future elections.
