Even On Memorial Day The Prohibitionists Are At It In Illinois

I got the following alert last night from the Illinois State Rifle Association. It appears that the gun prohibitionists are still at it in their efforts to have state licensing of gun stores in Illinois. This would be over and above what is required by the Gun Control Act of 1968 and BATFE.

They are trying to use an amendment to an environmental protection bill to put gun dealers out of business.

On a positive note, there is an amendment to a crime bill that would allow Illinois residents to own suppressors.

If you are an Illinois resident, call your representatives and senators.

Things are moving swiftly in the Illinois General Assembly as we are down to the last scheduled days.

HB1016
If you recall HB 1016 with Amendment #6 was voted down on Friday.
It was expected to be called for a vote again today, but that did not happen.
However
the anti-gunners, the ARS, the Bloomberg Moms and others were combing
the halls today trying to pick up votes for this thinly veiled attempt
at curtailing your Second Amendment rights.

It is expected that it will be called for a House vote again tomorrow.
Yes, you are reading it correctly, the Illinois General Assembly will be in session on Memorial Day.

There is no additional amendment, so there are no witness slips to be filed, but please call your Illinois State Representative and your Illinois State Senator tomorrow urging them not to support HB 1016.

SB 206
SB
206 came out of the House Judiciary Criminal Committee hearing today on
a favorable vote of 9 to 5. It will be back in committee soon to
address the suppressor amendment to the bill, now House Amendment #2. 
This is a bill to allow suppressors in Illinois as long as there is NFA
compliance, and to be able to use them while hunting with long arms.

At this point there is no committee hearing to fill out witness slips for, so please call your Illinois State Representative and your Illinois State Senator to urge their support of SB 206 as amended.  There is a possibility that the bill number may change, so make sure that that your legislators know that you are in favor of suppressors in general.

Here are a couple of quick talking points for suppressors when you call your legislators:

  • They can decrease noise complaints that are increasingly used as an excuse to close lands to hunting.
  • They help prevent hearing loss among those hunting or accompanying.

Second, no matter where you live in Illinois, you can respond to this one. Under a bill being considered, you would need the permission of every building owner and tenant in a 1,000 yard radius to discharge a firearm while hunting. The bill exempts “licensed ranges”. That’s fine except there is no such thing in Illinois. The wording “licensed ranges” is something that has been used in Bloomberg-sponsored bills in other states. I don’t doubt that this is the origin of this bill as well.

The gun-grabbers are going all out with HB6008 in hopes of dealing a
fatal blow to hunting and target shooting here in Illinois.  We all
know that the next step would be a full out attack on defensive firearm
ownership and the shuttering of gun shops.

Under HB6008, it would
be illegal for anyone to discharge a firearm for hunting purposes
within 1,000 yards of any building without the permission of the
building owner or tenant.  Yes, that’s right – 1,000 yards!  What that
means is that if you want to bag a rabbit for dinner, you have to get
the permission of every person living or working within one square mile
of where you’re standing.  What are the odds of success with that
endeavor? 

Meanwhile, your dinner has hippity-hopped his way down the road.

Even
crazier is the provision in HB6008 that would make it illegal for you
to allow a dog to hunt within 1,000 yards of any building without the
permission of the building owner or tenant.  So, you’re out walking your
dog one evening and Scooby-Doo happens to flush out a couple of
sparrows.  Ruh-row…no permission from the neighbors so it’s off to the
big house for the two of you.

The gun controllers are especially
sneaky when it comes to the third provision of HB6008 – a provision
that exempts “licensed” ranges from the 1,000 yard rule.  If you feel
good about that exemption, you shouldn’t because there are no licensed
ranges in Illinois.  No license – no neighbor permission – no range. 
It’s as simple as that.

HERE’S WHAT YOU NEED TO DO TO SAVE YOUR FIREARM RIGHTS

1. 
Call the bill’s main sponsor, Rep. Carol Sente at (217) 782-0499, and
POLITELY inform her that you are a lawful Illinois firearm owner and
that you won’t be fooled by what’s contained in HB6008.  Tell her that
you expect her to withdraw the bill or you will do everything in your
power to see that HB6008 is defeated and that you will work tirelessly
to prevent her from being re-elected.

2.  Call your own State
Representative and tell him or her that you are a law-abiding firearm
owner and that you deeply oppose HB6008.  Tell him or her that you

Good News Out Of Illinois

The Illinois Senate today passed SB 836 which contains improvements in the FOID Card Act, the Concealed Carry Act, and the Criminal Code. The vote was 43 yea, 8 nay, and 5 not voting. Included in the nay votes was perennial gun prohibitionist Sen. Dan Kotowski (D-Park Ridge). This is not surprising in that he had been the Executive Director of the Illinois Council Against Handgun Violence (sic) prior to being elected to the Illinois Senate.

The bill had passed the Illinois House on Saturday. The vote there was 84 yea, 23 nay, and 3 not voting. The bill now goes to Gov. Bruce Rauner (R-IL) for his signature. It is expected that he will sign this bill.

The full text of the bill is here. The Illinois State Rifle Association emailed this summary of the main provisions of the bill this evening. They along with Illinois Carry and other gun rights groups in Illinois fought hard for this bill.

After months of working with the Illinois General Assembly on improvements to the Firearms Concealed Carry Act, FOID Act and Criminal Code, SB 836 passed the Illinois Senate with a vote of 43 Yes, 8 No and 5 Present. It is on the way to the Governor’s desk.

SB 836 contains the following changes:

Firearms Concealed Carry Act:

1. Limits the waiver of privacy rights regarding the concealed carry application to only those records pertinent to obtaining a concealed carry license.

2. Clarifies that if a concealed carry licensee presents their ICCL during a law enforcement investigative stop that it is presumed they are carrying a firearm.

3. Clarifies the definition of a “mental disability” as it pertains to persons seeking a concealed carry license.

4. Eliminates the requirement that a licensee unload his or her firearm when storing or retrieving a firearm from the trunk of their vehicle.

5. Provides that Emergency Service personnel may ask anyone lawfully carrying a firearm to secure the firearm for the duration of the contact.

6. Changes mental health reporting requirements.

FOID Act:

7. Allows the use of a concealed carry license when purchasing firearms or ammunition.

8. Allows concealed carry licensees to possess firearms and ammunition without being in physical possession of their FOID card.

9. Changes the FOID Act to ensure that non-resident competitors may purchase firearms and ammunition at events held at the World Shooting Complex.

Criminal Code:

10. Eliminates a contradiction between Concealed Carry Act and the criminal definition of unlawful use of weapon.

The Illinois State Rifle Association has released an urgent alert regarding a public meeting held by the anti-concealed carry forces including the Illinois Council Against Handgun Violence (sic) and anti-gun State Rep. Elaine Nekritz. They are trying to build support for more restrictions on concealed carry in Illinois. After fighting so hard for so many years, it would suck to see all that hard work go to waste through overbearing regulations.

Early Morning Fire At Winchester’s East Alton Plant

There was a fire in the early hours of the morning at Winchester’s East Alton, Illinois ammunition plant. Fortunately, it seems that only a maintenance shed was destroyed and the fire did not spread to other areas of the plant.

From the St. Louis Post-Dispatch:

An early-morning blaze and propane explosion at an ammunitions factory in East Alton was contained to a maintenance shed and caused no injuries, according to police.

A motorist spotted fire in a maintenance shop at the Winchester Ammunition plant, which is a division of Olin Corp., and called 911 about 3:15 a.m., according to East Alton Fire Chief Randy Nelson.

Reports vary as to when the fire was first spotted but it was finally extinguished around 7:30 this morning. The blaze caused propane cylinders to explode and steam lines to rupture from the intense heat.

Winchester has been in the process of moving its center-fire ammunition production from the East Alton plant to its much newer plant in Oxford, Mississippi. Winchester started this move in mid-2010. Rimfire ammunition was moved to Oxford earlier.

 Olin Corporation, the parent of Winchester, has not made any official statement on the fire that I can see on their website. Given that it happened on a Sunday morning, this is not too surprising.

Jumping The Gun On CCW In Illinois – A Warning



Despite the speculation by TTAG that Illinois is now a constitutional carry state with the Illinois Supreme Court’s decision in Aguilar v People, Thirdpower at Days of our Trailers has a warning about not to tempting fate.

Even though TTAG is claiming that IL is a ‘Constitutional Carry’ State, you can still get your @ss arrested.

If we find somebody carrying a weapon, we’ll likely write a report and hand it over to the state’s attorney and let him use the facts of the case to decide whether he wants to prosecute. If we feel it’s necessary, there’s a very good chance we’ll seize the weapon.”

Given that Thirdpower is a lifelong Illinoisian and is active in Illinois gun politics, I’m going with him on this one. You might beat the charge of unlawful use of a firearm but you’ll probably never see your gun again.

First Impact Of Illinois Supreme Court Ruling On Right To Carry

This past Thursday, the Illinois Supreme Court ruled unanimously in People v. Aguilar that the Illinois law that banned carry outside the home was illegal under the Second Amendment. Yesterday, this ruling caused Cook County Circuit Judge Ellen Mandeltort to reverse herself and drop charges against Deafalla Haddad. Mr. Haddad had been charged with the unlawful use of a weapon after he was found in possession of a handgun during a routine traffic stop.

Cook County Circuit Judge Ellen Mandeltort last week denied Deafalla Haddad’s request to drop the charges.

But the Supreme Court ruled Thursday that part of the state’s gun law was unconstitutional and advised prosecutors to drop charges in certain cases. That ruling fell in step with a federal court decision earlier this year declaring that the state’s gun laws violated the U.S. Constitution.

At Monday’s hearing, defense attorney Matt Fakhoury asked Mandeltort to reconsider the request in light of the Supreme Court decision. She agreed and found the case against Haddad violated his Second Amendment rights.

“This court finds that the charges (against Haddad) are unconstitutional,” Mandeltort said from the bench.

Fakhoury said it was the first case in Cook County to be dropped after last week’s ruling and that there could be more challenges filed.

“Basically the federal courts said one thing and the state court said another,” Fakhoury said. “But the state court is now following the federal ruling.”

Mr. Haddad, an IT professional and married father of three, obtained his FOID card and then a .45 caliber handgun after he was attacked while stopped at stop sign. Mr. Haddad also started carrying his pistol despite the general prohibition against carry by Illinois state law. This is what led to his arrest for unlawful use of a weapon.

Friday Will Be Last Day For Towns In Illinois To Ban Guns

With the override of the amendatory veto of HB 183, the clock is ticking for towns and cities in Illinois who want to impose their own semi-auto firearm restrictions. The bill gave Illinois municipalities 10 days after its passage to have these ordinances in place or forever forego them.

Quinn’s Veto Overriden In The Illinois General Assembly

Gov. Pat Quinn’s amendatory veto of HB 183 was overriden in the Illinois House today on a vote of 77 for and 31 against. It now goes to the Illinois Senate where Sen. Gary Forby (D-Marion) has introduced a motion to override the veto.

Today is the day that the stay issued by the 7th Circuit Court of Appeals in the joint cases of Shepard v. Madigan and Moore v. Madigan expires.

UPDATE: Interestingly enough, the Illinois State Police is prepared for the bill’s passage. It has up a  FAQ page on concealed carry permits including the cost of permits and the qualifications to obtain a permit.

UPDATE II: Both houses of the Illinois General Assembly overrode Gov. Pat Quinn’s amendatory veto. The Senate vote was 41 to 17.

The State of Illinois now has concealed carry. While it will take a while to get things up and running, the state does have concealed carry.

Latest Round Of Municipal Meeting To Ban Guns In Illinois

The Illinois State Rifle Association has posted their updated list of cities and towns in Illinois seeking to ban guns. Assuming that the Illinois General Assembly overrides Gov. Pat Quinn’s amendatory veto of HB 183, they have 10 days to have their gun bans in place. The override is on the calendar and the General Assembly is expected to take it up this coming week.

The order staying the ruling in Shepard v. Madigan and Moore v. Madigan expires on Tuesday. The 7th Circuit Court of Appeals has stated there will be no more extensions of their stay. Attorney General Lisa Madigan does have until July 22nd to file an appeal of the Court’s ruling. An override would, it is my understanding, moot those cases and any chance of overturning it on appeal.
