Michael Bane On Wayne’s Departure

I had been waiting for Michael Bane’s weekly MBTV On the Radio podcast on Wayne LaPierre’s departure from the NRA. I was not disappointed.

As he has related in the past and did so again today, he openly acknowledges that he has crossed swords with Wayne over outreach and public relations. That said, Michael said we have needed the NRA in the past and will continue to need them. He also emphasized that we are the NRA and the NRA is not Wayne and not his pack of enablers on the board.

Listen to the first 25 minutes of the podcast here. I agree with him that if Wayne had left in 2019 Wayne might have rode off into the sunset with both his reputation and wealth intact.

If you are not a regular listener, you should be.

You Are On Your Own

Michael Bane constantly reminds his listeners that in times of unrest or natural disasters that “you are on your own.” Reliance on police or emergency services to save you can be futile. Many Israeli civilians have just learned that fact. The Times of Israel estimates that the death toll from the Hamas terror attacks this weekend has reached 800 with many more wounded. If you were to scale that number up in the United States like blogger Cdr Salamander did, the number would approach 25,000 in a day.

We often think that Israel is an armed country. We have all seen the pictures of off-duty IDF women carrying their issued M-16s. The reality is much different. It is estimated that only 2.5% of Israeli civilians have gun permits. Those permits allow them one firearm and 50 cartridges.

As Stephen Gutowski of The Reload reports, this crisis has forced the government to relax the requirements.

Israeli Minister of National Security Itamar Ben-Gvir announced on Sunday he has ordered officials responsible for issuing gun licenses to broaden its standards. As the death toll inflicted by terror group Hamas grew to over 600, Ben-Gvir said he wants more Israelis to be able to legally arm themselves.

“Today I directed the Firearms Licensing Division to go on an emergency operation in order to allow as many citizens as possible to arm themselves,” he posted, according to a Google translation. “The plan will take effect within 24 hours.”

Ben-Gvir also increased the amount of ammo that one can have from 50 rounds to 100 rounds. To my mind, both amounts are insignificant when faced with terrorists armed with full-auto AK-47s.

Tom Gresham on his Sunday Gun Talk Radio broadcast devoted time to the attack on Israel and its people by suggesting an “imagination exercise”.

While there is no magazine in my ready AR-15, this is what is next to the AR along with a ready bag with more filled magazines and a first aid kit. In retrospect, I think I need to add a set of shooting muffs to the setup.

I can’t say my idea is original. I got it from author Matt Bracken who first wrote about how to make duplexed magazines in 2010. I modified mine a bit from his in that I used a piece of dowel instead of a pencil for the spreader and I didn’t fill the space in between with silicone caulk. If you decide to make your own, use GI-type metal magazines. I think mine were either C-Products or D&H. P-Mags just won’t work for this. You could just get the 60-round drum mag from Magpul but the duplexed mag is a lot cheaper and works just as well.

I don’t expect to be attacked by Hamas, Hezbollah, or Mexican drug cartels. But then again neither did most of the Israeli citizens who were killed or kidnapped this past weekend. That said, home invasions with multiple attackers are on the rise. Being prepared doesn’t mean you are paranoid. It just means you are prepared for something you hope will never happen. If you are prepared, then it will be one less thing to have to worry about.

Those Damn Assault Revolvers!

I saw a tweet today from KCAL-TV that had me shaking my head. KCAL-TV is the CBS affiliate in Los Angeles, California. It was talking about a weapon recovered at the scene of a shooting.

An assault revolver with high cap mags? OMG!

Michael Bane has spoken in the past many times about a program that he and NSSF put on for journalists. It was to teach them the basics of firearms. I think it may be past time to bring it back.

On the other hand, seeing so-called journalists making stupid comments like this about firearms does illustrate my point about their naivete’ and stupidity. Unfortunately, too many of their listeners think they know of what they speak and believe them.

SHOT Show 2023 – It’s The People

Seeing all the new products being released at SHOT Show is cool. Since I caught the SHOT Show crud during the show and not after it, I didn’t get to see as much as I usually did. Nonetheless, what I really enjoy most about going to the SHOT Show is reconnecting with old friends and making new ones.

I’m not the best at taking selfies but others are. I ran into Charlie Chambers who I first met at a Gun Rights Policy Conference at Range Day. He was there with Amanda Suffecool and Rob Campbell of Eye on the Target Radio. This was taken early in the day before the rain arrived and the wind picked up.

Then there are the people you run into in the Media Room. In this case it was Charlie Cook of Riding Shotgun with Charlie and John Petrolino of BearingArms.com. As Charlie noted, all three of us were recipients of the Second Amendment Foundation’s Ray Carter Blogger of the Year Award.

Thursday was interesting as lunch and then dinner ran the political spectrum from Right to Left. Lunch was with Paul Valone and his wife Lori of Grass Roots North Carolina along longtime GRNC volunteer Josette Chmiel. Paul is the author of the book Rules for Anti-Radicals which deals with defeating leftism.

L-R: Me, Paul, Josette, Lori

Thursday evening I swung to the opposite end of the political spectrum when I had dinner with people from the Liberal Gun Club. Beyond the wonderful food at Bouchon, I had a great time reconnecting with Lara and Ed Smith and trainer/revolver guru Grant Cunningham. Grant was at the SHOT Show representing Lubriplate which makes non-toxic firearm lubricants (among many other things). It had been years since I had seen Grant face-to-face so it was really fun to catch up with him.

Finally, there is my old friend Michael Bane. I ran into him at Range Day where he introduced me to James Tarr. Later that evening, I had dinner with Michael and his “sweetie” along with Paul Erhardt and one person whose name I still don’t remember. The Complementary Spouse insisted I get a picture. Unfortunately, I forgot. Fast forward to Thursday when Michael was doing the giveaway for a customized Tisas 10mm 1911 at the SDS Imports/Tisas booth. His “sweetie” was kind enough to take this picture of us and the Complementary Spouse was pleased.

There were a lot more people I ran into at SHOT than I can name without leaving someone out. Despite coming down with the crud and missing a day of the show because I stayed in bed, it was a good trip and it was the people that made the trip.

Against Guns, Against Self-Defense, or Both?

There was a shooting at the Greenwood Park Mall in Indianapolis, Indiana area on Sunday. Reportedly, the killer had hidden in the bathroom adjacent to the food court with a number of firearms in his backpack. As the mall was preparing to close, he entered the food court and killed three individuals as well as wounding two others. He might have killed more but he was stopped by 22 y.o. Elisjsha Dicken who was legally armed. Mr. Dicken was legally carrying concealed without a permit as was his right under Indiana’s recently passed permitless carry bill.

While the mall was posted as a so-called gun free zone, they have no force of law in Indiana. It would only be an offense if the carrier was asked to leave and refused. In that case, the concealed carrier could be arrested for criminal trespass.

Even though the mall was posted against carry by its owners the Simon Property Group, they had this to say about Mr. Dicken.

We are grateful for the strong response of the first responders, including the heroic actions of the Good Samaritan who stopped the suspect.

Contrast this dignified response with that of two of the leaders of the gun prohibition industry: Shannon Watts and Kris Brown.

First, Mrs. Watts who resided in the Indy area for many years until she left for more progressive pastures in the People’s Republic of Boulder and thence to California. She later deleted it.

And now Kris Brown, president of Brady United, who referred to Mr. Dicken as a “vigilante”.

Many on the progressive Left believe that government should hold the monopoly on violence. In other words, self-defense on behalf of yourself or others would be against the law and that any defense of a person should come from agents of the state, i.e., the police. If you respond like Mr. Dicken, then you are just as culpable in the eyes of the law as the killer.

Michael Bane discussed this at length in his MBTV On The Radio podcast last week. His example was that of the bodega worker who was being charged with first degree murder for protecting himself against a felon out on parole. This episode is well worth a listen.

We know that Mrs. Watts and Ms. Brown are anti-gun. It also appears that they are against self-defense. I am of the belief that as elitists, they fear firearms in the hands of the great unwashed. In other words, thee and me. They want the monopoly of violence – and the tools with which to secure it – to be in the hands of the state. This fits in directly with what Chairman Mao’s speech to the Chinese Communist Party said in 1938.

Every Communist must grasp the truth, “Political power grows out of the barrel of a gun.” Our principle is that the Party commands the gun, and the gun must never be allowed to command the Party… All things grow out of the barrel of a gun.

The founders of the United States, by contrast, were greatly influenced by the works of English philosopher John Locke. He was a proponent of natural law. One tenet of natural law is that you have a natural right to life and you have a right to defend this life.

From Locke’s Second Treatise on Government, Chapter II, Section 16:

it being reasonable and just, I should have a right to destroy that which threatens me with destruction: for, by the fundamental law of nature, man being to be preserved as much as possible, when all cannot be preserved, the safety of the innocent is to be preferred: and one may destroy a man who makes war upon him, or has discovered an enmity to his being, for the same reason that he may kill a wolf or a lion; because such men are not under the ties of the commonlaw of reason, have no other rule, but that of force and violence, and so may be treated as beasts of prey, those dangerous and noxious creatures, that will be sure to destroy him whenever he falls into their power.

Most countries of the world, whether they be communist, socialist, capitalist, authoritarian, democratic, or some other variant, do not recognize the individual’s right to self-defense. It doesn’t matter whether you are in China or Canada, the monopoly of violence remains in the hands of the state.

The United States, however, does recognize an individual’s right to self-defense. Whether by common law or codified law, it is a right recognized in all 50 states plus the District of Columbia. This is true even in the most progressive of states.

That Mrs. Watts and Ms. Brown reject the right of self-defense puts them, not us, outside the mainstream. It is a right that must be defended at all costs because without it we are slaves.

Comments On Polling

I came across a couple of comments on polls and polling this morning that make some sense.

First from my friend Michael Bane:

“Polls” are nothing more than psy-ops operations designed to demoralize voters ahead of an election; even an “average of polling data” is nothing more than an “average of lies,” which translates into a lie.

And then this Tweet from Sen. Lindsey Graham (R-SC) who was inundated by tons of out of state money for his opponent Jaime Harrison. In the end, all that money was wasted.

Remington Arms Eyeing Bankruptcy…Again

The Wall Street Journal reported Friday that Remington Arms is preparing to file for Chapter 11 bankruptcy again. If so, this will be the second time in about two years that they’ve sought the protection of the bankruptcy court.

As Michael Bane pointed out on Facebook, Remington had already shut down their AR brands and has missed out on the boom due to COVID-19. Moreover, pistols are selling like hotcakes – except for 1911s. Again, Remington missed out.

Now here is where the potential bankruptcy gets interesting. The probably lead bidder for Remington is the Navajo Nation.

From the WSJ:

The bankruptcy filing could come within days as the gun maker makes preparations for the Navajo Nation to serve as the lead bidder to purchase Remington’s assets out of chapter 11, these people said. Founded in 1816, Remington’s namesake weapons are mainstays in hunting, shooting sports, law enforcement and the military.

The Navajo Nation—a territory with roughly 175,000 people across parts of Utah, Arizona, New Mexico—could finalize a bid for Remington as soon as Friday, one of the people said. Any bid for the company would be subject to competing offers and require bankruptcy-court approval.

The timetable could be pushed back, and an offer from the Navajo Nation isn’t guaranteed to materialize, people familiar with the matter said.

The Navajo Nation, which explored buying Remington as far back as 2018, owns a set of business enterprises in industries including energy, transportation, and utilities. In 2019, a business owned by Navajo Nation purchased coal company Cloud Peak Energy’s mining assets out of bankruptcy.

What makes ownership by the Navajo Nation particularly interesting is that they have sovereign immunity. This is especially true in light of the litigation in Connecticut over Remington’s supposed liability for the Newtown murders.

Jim Shepherd of The Shooting Wire had some very astute comments on this issue today.

So what would a Navajo acquisition look like?

With their business acumen and consultants, it probably wouldn’t look very different from most other offers price-wise. But the Nation’s unique status would introduce two variables: sovereign immunity and tribal law.

Interpreting what sovereign immunity really means, especially in a business negotiation, is an assignment I’m not equipped to complete. It is a complicated relationship between the various tribes and the federal government. While their businesses generally operate under the U.S. tax codes including taxes, there are some very notable exceptions.

Tribes under the terms of sovereign immunity are shielded from litigation much the same as states. That protection “usually extends to suits arising from a tribe’s ‘off-reservation’ or commercial activities, including the activities of an off-reservation tribal casino.”

With regard to business endeavors, federal courts, according to the American Bar Association, generally do not distinguish between “governmental” and “commercial” activities. “Numerous courts,” says the ABA in Doing Business in Indian Country: A Primer “have thus held that tribal sovereign immunity extends to tribal casinos, businesses, schools and corporations (my emphasis).”

While it’s not absolute, there’s a “strong presumption” against any waiver of that immunity, and it can only be abrogated otherwise by an “unequivocal expression” of Congress.

Tribal officials and employees acting in their official capacities and within the scope of their employment are also shielded from damage suits and requests for injunctive relief. They’re also immune from subpoena enforcement to “compel production of tribal witnesses or documents.”

Think what having tribal sovereign immunity would do for a firearms manufacturer. They wouldn’t have to depend upon the Protection of Lawful Commerce in Arms Act which a President Biden and a Democrat-run Congress have promised to repeal. They could look both Brady Legal Project attorneys and ambulance chasing plaintiffs attorneys in the face and say “eff off.” Moreover, could you really imagine any Congress, Republican or Democrat majority, in these days and times trying to take immunity away from tribes?

2020 which was already an “interesting” year just got more interesting. I am anxious to see how this all plays out.

SHOT Show 2018: Rimfire Challenge World Championship Announced

Michael Bane announced the dates and the location of the Rimfire Challenge Shooting Association’s World Championship today at the SHOT Show. The championship will be held October 3rd through 7th at the Lucas Cattle Company Ranch in Crossed Timbers, Missouri.  The ranch is owned by Forrest Lucas who is the founder of Lucas Oil Company.

Crossed Timbers is located in the Ozark Highlands of Missouri. The Crossed Timbers Region is where the prairies of the Great Plains meet the Eastern deciduous forests. It is about a two hour drive from Kansas City and a 3 1/2 drive from St. Louis.

More information on the event will be posted as it becomes available.

Rimfire Challenge To Transition From NSSF To RCSA

Despite what Asheville’s Thomas Wolfe once wrote, you can go home again.

The Ruger Rimfire Challenge was originally developed by Ken Jorgenson of Ruger, Michael Bane, and the late Nelson Dymond. In 2014, the responsibility for running the Ruger Rimfire Challenge passed to the National Shooting Sports Foundation and it became known as the NSSF Rimfire Challenge. On January 1, 2018, the Rimfire Challenge will pass to a new non-profit organization run by Jorgenson and Bane called the Rimfire Challenge Shooting Association. Thus, it will have closed the circle and returned home to its founders.

Below is the NSSF’s press release, in part, on the transition:

NEWTOWN, Conn. — The National Shooting Sports Foundation® (NSSF®), the trade association for the firearms industry, is proud to announce that the NSSF Rimfire Challenge will be transitioned to a new organization: the Rimfire Challenge Shooting Association. The transition takes place Jan. 1, 2018.

Originally developed by Sturm, Ruger & Co.’s Ken Jorgenson, along with author and TV personality Michael Bane and the late Nelson Dymond, a long-time and well-known shooting match director who held a strong passion for rimfire firearms, the program was first known as the Ruger Rimfire Challenge. NSSF took over the administration of the program in 2014, changing its name to the NSSF Rimfire Challenge. The new organization will be led once again by Ken Jorgensen and Michael Bane.

Designed to introduce new shooters to the shooting sports in an exciting, family-friendly format, Rimfire Challenge matches focus on competition with .22-caliber rifles and pistols. Matches are open to shooters of all ages and shooting experience levels, with events conducted at ranges nationwide and an annual World Championship taking place each October.

“It’s truly a great thing to see this program return home to the people who had this wonderful idea to begin with,” said Tisma Juett, NSSF Manager, Recruitment and Retention. “The NSSF is proud to have been a part of growing a shooting sport that has proven to be such a wonderful activity for mothers and fathers, sisters and brothers, neighbors and friends in which to participate. We wish Ken and Michael much success and look forward to many more firearms owners joining the shooting sports with them.”

“I am excited to once again be involved in the day to day operation of the Rimfire Challenge events,” said Jorgenson. “The concept originally created by Nelson and implemented as part of the Ruger Rimfire Challenge is as valid today as it was in the beginning. We will work to continue that vision and grow the rimfire competition opportunities for shooters of all skill levels.”

“I could not be happier to once again be a part of the Rimfire Challenge!” Bane added. “It is a wonderful sport, a way to bring whole families into the competition. Ken and I are committed to bringing the Rimfire Challenge to the next level. It’s going to be fun!”

Michael Bane makes the announcement of the change on the video portion of his weekly podcast. You can see it at this link. As he notes, the first year will be about stability and communication. He doesn’t see any major rule changes coming immediately. The existing rulebook along with examples of courses of fire can be found here.

All shooting competitions go through life cycles and I think change like this is important. New management and new ideas along with a fairly low cost of entry should help the Rimfire Challenge continue growing and bringing in new shooters. The more that we can show that the shooting sports are fun, the less likely that the gun prohibitionists will be to convince the general public that guns are “icky”.

If You Get The Outdoor Channel…

If you subscribe to the Outdoor Channel (or have a friend who does), you will want to see the Best Defense tonight. It will feature their mass casualty event reenactment modeled on the Paris music hall terrorist attack. The goal was to find ways for you to survive such an event.

I don’t have the Outdoor Channel but I understand that the show will eventually be rebroadcast on their new My Outdoor TV (Shooting Gallery Online) digital network.

From Michael Bane:

THE BEST DEFENSE: MASS CASUALTY EVENT TO PREMIER THIS WEDNESDAY, 28 SEPTEMBER, ON OUTDOOR CHANNEL, 8:00 PM Eastern
Masonville,
CO — The two scariest words in the English language are “what it?”
There have been a dozen terror attacks in the United States in 2016;
“what if” you or your family are trapped in the worst case you can
imagine?
Award-winning
producers of THE BEST DEFENSE, Michael Bane and Jeff Murray, decided to
tackle that question head on in a compelling, and terrifying, special
premiering on OUTDOOR CHANNEL at 8:00 PM ET Wednesday, September 28,
encoring November 2 (Time to be announced).
“‘What
if’ is a simple question with a hellish answer,” said Bane. “Literally
days before the San Bernardino attacks, Jeff and I began discussing an
idea to create the most realistic terrorist attack simulation possible,
then use the tools we’ve developed in THE BEST DEFENSE over multiple
seasons to help people survive.”
The
producers’ number one goal was to create a scenario so realistic that
it was hard to turn away. Working from the basics of the Paris concert
hall attacks, Bane and Murray reached out to both law enforcement and
military counterterrorism experts and trainers who studied mass casualty
events, THE BEST DEFENSE training team of Mike Seeklander and Michael
Janich, paramedics specializing in first response and even renowned
mental health experts to build the scenario and capture as much as
possible the reality of being trapped in a mass casualty attack.
“We
made the decision to use FX to make the scenario more realistic,” Bane
said. “We were lucky enough to have the help of the Larimer County (CO)
SWAT team and local paramedics. The Mass Casualty Event is certainly the
most complex sim I’ve ever been involved with.”
A
film team headed by award-winning documentarian Brandon Green shot the
whole event in ultra-high resolution 4K. Green worked with the FX team
to make every shot fired as realistic as possible.
“Essentially,
this is the most ‘vetted’ scenario we could build. Every move, every
action taken is based in reality and run through some of the most
knowledgeable experts in the world,” Bane said. “Even the crowd reaction
is based on cutting edge research from Dr. William Aprill…as each
‘extra’ arrived, that person was given a card explaining how he or she
should react when the attack started. We were lucky enough to have
Michael Janich’s highly trained cadre of martial arts experts to create
an even more realistic sim. In fact, our main ‘terrorist’ served in the
Israeli Defense Force as a sniper and Master Breacher, and is an expert
in counterterrorism techniques.”
On-screen
experts, in addition to the TBD Team of Seeklander and Janich, include
Ken Hackathorn, considered one of the top firearms trainers in the
world; Gabe Suarez, probably the most experienced trainer in studying
and dissecting mass casualty events and teaching civilian response; Dr.
Dan Olesnicky, SWAT team physician, a first responder in terrorist
events and one of the leading trainers of tactical medicine; Dr. William
Aprill of Aprill Risk Consulting, considered the national expert on
criminal and terrorist mindset; former SEAL Jimmy Graham, who also
served as Lead Instructor for elite Federal Government Protective
details in high risk environments and presently heads up the Active
Shooter Response Training Center in the Denver area.
“Our
team is tremendously proud of this effort, and we thank OUTDOOR CHANNEL
for putting this information in front of so many people,” Bane said.
“Since we began planning for this special, there have been 12 terrorism
events in the United States and literally one a day around the world. We
believe this information is critical, and we hope our viewers never
have to use it.”
