GRNC Alert – Federal Gun Control Vote This Week

Grass Roots North Carolina released an alert concerning votes on HR 8 and HR 1112 which may be coming this week. The first mandates universal background checks for all purchases and transfers while the second changes the procedure for a “hold” on NICS checks. Tom Gresham has written about this combination and the danger it poses. While a Democrat president might not use emergency powers to declare an emergency over “gun violence” (sic), it has been threatened by Speaker Nancy Pelosi. When you add the combination of these two bills to a declared emergency, you could have a perfect storm for the gun culture. That, of course, is the intent of all these type of bills – to make it so hard to purchase or own a firearm that most people will just give up.

As you know, Democrats
in Washington are pushing dangerous gun control bills, and it appears the US House will be voting on these measures this
week…

After assuming power in the US House,
the anti-gun party went right to work pushing heavy-duty gun control—two bills particularly. In brief, H.R. 8 (Bipartisan Background Checks Act of
2019
) makes private firearms transfers a crime, while H.R. 1112 (Enhanced Background Checks Act of
2019
) establishes a nationwide waiting period for gun purchases.

Although bills such as
these seem like “Democrat” bills that would never make it through the
Republican-held Senate, don’t be so sure. As it stands, these bills are
labeled “bi-partisan” because some less reliable Republican
lawmakers (read: RINOs), have co-sponsored them. This allows for the
following scenario:

  1. If these bills have bi-partisan support, they’ll likely pass the House
    easily, even
    if a few conservative Democrats vote against them. As it stands, no less
    than five Republicans have signed on to H.R. 8. So far, H.R. 1112 has
    only
    one Republican co-sponsor, but it can still be labeled bi-partisan, and
    is quite likely to pass the House. Other than the co-sponsors, it’s
    anyone’s guess how many other unreliable Republicans will vote for one
    or both of these bills.

  2. If there are Republicans in the House
    who sign on to these oppressive gun control laws, who’s to say that certain “moderate” Republicans in the
    Senate won’t do the same?
  3. While it’s true that we have a Republican
    executive, it’s also true that President Trump has dithered on questions of gun control. He has supported so-called “red flag” laws,
    which arbitrarily deny due process and strip citizens of their Second
    Amendment rights by bureaucratic whim. Also, by executive fiat the
    president
    recently banned bump stock devices.
    By these
    examples, you can see there is no guarantee that the president would
    veto a gun control bill, and there is even reason to believe that he
    would
    happily sign into law certain gun control measures.

In
the very possible scenario outlined above, one can see that there is real risk here, and
things could start sliding the wrong direction this
week
!
Clearly, it’s up to us, the people, to stop this.

It appears that the US House will

be voting on gun control measures this week

… so please, as soon as possible, contact your representative and demand that he or she continue to
recognize and vigorously defend guaranteed human rights

Dear Representative:

I am
writing to express unequivocal opposition to the gun control bills

introduced in the House of Representatives. In general, gun control is

H.R. 1112, are no exception and are truly egregious examples.

It’s discouraging to see that both
bills carry bipartisan sponsorship, but I want to make it clear that I
expect you to stand for what is right, not what seems most expedient due
to the
perceived zeitgeist, nor out of a belief that there is virtue in all
compromise. While compromise has its place, there can be none when it
comes to
questions of Natural human rights, particularly Second Amendment rights.

Oppose H.R. 8 and H.R.
1112. Oppose them publicly and vigorously. This is the only proper and
acceptable path for a member of the Republican Party, a party that has
documented its broad support for the Second Amendment in its party
platform. As
my representative, I expect you to live up to this.

Gun-free Zones: the Psychotic-Killer Loophole
The most effective way to reduce mass public shootings is for our elected officials to wise up and eliminate dangerous gun-free zones (GFZs). 

Along with improved security provisions, such as fewer unlocked entrances and generally beefed up security, the most effective way to protect school children is to proclaim that any attack will likely be met with rapid armed resistance from an unpredictable source; that source would be teachers and other school personnel. 

Remove the ShacklesOf course, teachers who do not want to carry defensive weapons should not be required to. However, the SHACKLES MUST BE removed from those willing to mount effective resistance should the worst occur.

Since the recent disturbing events in Florida, all the usual gun-control voices have called for all the usual ineffective and unconstitutional schemes. None of these useless and ominous notions are acceptable, and I insist that you not lend them credence during your upcoming committee meetings. I do expect you to discuss school security concepts that are actually effective and will truly result in the protection of school children.

Removing the shackles from school employees who have concealed handgun permits would be the simplest and most effective solution. The legislature could do this almost immediately by removing the dangerous gun-free zone (GFZ) status from school buildings and grounds. Teachers and other school staff are no danger to students. If they were, we wouldn’t allow them unfettered, daily access to our children. Yet, the threat of swift armed resistance from an unpredictable source is a highly effective deterrent. This is why a full 98% of all mass public shooting since 1950 have occurred in so-called “gun-free” zones. Should the worst occur, teachers defending their students with deadly force is not such a terrible thing when you imagine the alternative. Indeed, no imagination is necessary, as recent events have shown us exactly what the alternative looks like.

A large number of teachers are already willing and ready for classroom carry. A recent Elon University Poll of North Carolina teachers (which skewed heavily Democrat) revealed that roughly 20% of teachers are open to the idea of concealed handguns in the classroom. Consider that the number of every day citizens who legally carry a gun in our state is something less than 10%. This means the number of teachers willing to consider classroom carry is at least twice the number in the general population who already carry a handgun. This is great news, and further evidence that dangerous GFZs have run their course. 

Our children’s very lives are at stake. I demand that your time on the School Safety committee be used to consider and implement only practical and effective policies. I will be monitoring your actions on this matter through Grass Roots North Carolina legislative alerts.

It is essential that they hear from those of us who have real and actionable suggestions and not merely those with ineffective, looks good on paper, feel good schemes.

Indeed, no imagination is necessary, as recent events have shown us exactly what the alternative looks like.

A large number of teachers are already willing and ready for classroom carry. A recent Elon University Poll of North Carolina teachers (which skewed heavily Democrat) revealed that roughly 20% of teachers are open to the idea of concealed handguns in the classroom. Consider that the number of every day citizens who legally carry a gun in our state is something less than 10%. This means the number of teachers willing to consider classroom carry is at least twice the number in the general population who already carry a handgun. This is great news, and further evidence that dangerous GFZs have run their course. 

Our children’s very lives are at stake. I demand that your time on the School Safety committee be used to consider and implement only practical and effective policies. I will be monitoring your actions on this matter through Grass Roots North Carolina legislative alerts.

Firearms Restraining Orders In NC? No, Thank You!

Rep. Marcia Morey (D-Durham) who was appointed to fill an empty seat in the North Carolina House of Representatives is proposing the establishment of firearms restraining orders a’la California. Though Morey is a former judge, it seems she sees no problem in adopting something flies in the face of due process.

Grass Roots North Carolina sent out an alert on this yesterday asking that gun rights supporters email every Republican in the NC House and demand an end to this.

GUN CONFISCATION
COURTS TO BE PROPOSED
You read that right. Rep. Marcia Morey (D-Durham), a former judge, whose April appointment to the NC House filled a vacant seat, is looking to turn North Carolina into California—but not regarding sunshine and fad diets. In short, Morey will be proposing the establishment of “firearm restraining orders” (FROs) in our state. An FRO would be issued as a result of an “exparte” (emergency) hearing, where a judge can authorize the seizing of a private citizen’s guns where no crime has been proven (no guilty verdict delivered), and in fact, even where no arrest has taken place. Most likely, the proceedings will be allowed to take place even in the absence of the accused. This means the accused citizen cannot face his accusers, nor defend himself through counsel or otherwise. This is a serious violation of fundamental Constitutional due process rights.

A First Amendment Analogy
One could liken an FRO hearing, and subsequent confiscation, to accusing a reporter of so-called “hate speech,” and then, once the accusation is made, an emergency hearing is held without the presence of the accused reporter. The hearing could result in a ten-day gag order being placed on the reporter, barring the reporter from speaking (or reporting) until a primary hearing. So, the reporter’s First Amendment rights are suspended—absent any due process! In the case of Second Amendment rights, even if the accused’s firearms are returned after ten days, there is nothing to prevent the police from having registered them with the BATFE. Moreover, the accused will still be out thousands of dollars spent on the ensuing legal defense—that is, only if the accused can afford it in the first place.

No Pretense, Just Straight-up Confiscation
FROs are not a foot in the confiscatory door. There is no pretense here. FROs blatantly and aggressively kick that door down, and once FROs are in place, the valid reasons for establishing an FRO against an individual will surely loosen. At first, perhaps close family members and a few others very close to a person may be able to point a finger and “report” him. That’s bad enough, but be sure, the already Orwellian rules surrounding FROs will surely expand. It’s likely that, eventually,virtually anyone in a person’s sphere will be able to accuse a person and begin the unconstitutional process of having the accused’s legally owned firearms forcibly confiscated. Does this sound like a free country to you, a free state?

Will Republicans Protect the Citizenry?
As of now, we don’t know how the Republican majority in Raleigh will react when asked to establish a gun confiscation mechanism. We do know that there is always danger that politicians will stick a finger in the air and just “go with the flow,” as the anti-gun crowd aggressively pushes to not “let a crisis go to waste.” There is real danger here. We need to inform our representatives that we will not allow them to rescind our Constitutional due process rights. Free, law-abiding citizens are to remain free, and we will not tolerate being punished for the crimes of another.

I am writing because I’ve just been informed of the horrifying proposal that Rep. Morey is preparing to introduce. I understand Rep. Morey would like to establish “Firearm Restraining Orders” (FROs) in our state. FROs are simply mechanisms for bypassing constitutional due process protections in order to confiscate firearms, at whim, from accused persons who have not been convicted of any crime. Not only can one’s firearms be confiscated based on accusation alone, FRO hearings can also be held without the presence of the accused. To say this is unacceptable is an understatement.

I am incensed that any representative in an ostensibly free state would even suggest such an ominous mechanism be established within our legal system. I assure you, citizens like me will not stand for the suspension of our Constitutional rights. I insist that you act now to put a stop to any legislation that would establish these extra-constitutional judicial bodies, which are designed to strip people of their rights based on accusations alone.

Also, I must insist that you explain to me where you stand on this issue. I must be sure that my representatives are on the side of liberty—protecting my rights—and are not willing to oppress Constitutional guarantees simply due to the current direction of political winds.

The North Carolina General Assembly returns to Raleigh on October 11th and Squish and his friends at Grass Roots North Carolina will be there to welcome them back. HB 746, which would allow permitless concealed carry among other things, is still stuck in the State Senate. While it has passed the House, Senate leaders seem to think bowing down to a certain wealthy ex-mayor and his hired minions is preferable to listening to those that got them elected.

Do you remember all of the speeches
during the last election cycle, how the Republican candidates couldn’t
say
enough about how pro-Second Amendment they are? Unfortunately, it seems
that Republicans have since become complacent, and they are taking gun
owners
like you for granted.

We know this because House Bill 746 is still stuck
in the Senate, a bill that gives NC Republicans a perfect opportunity to
follow through on their campaign rhetoric. Yet, “stuck” is the key term
here, not “follow through.” 

Worse yet, we
know that Michael Bloomberg’s out-of-state money has been hard at work
in North Carolina, with a few well-paid operatives whispering fear and
doubt
into the ears of our elected leaders. This isn’t a new game for them,
since they prognosticate doom about every pro-Second Amendment measure
that
comes up … and when these pro-gun bills are passed into law, their
fears of doom are proven to be completely unfounded. Still, we want to
make sure
that responsible, law-abiding gun owners are being seen and heard by
their elected leaders. Let’s remind them that rich New Yorkers and a few
paid
minions don’t speak for us in our state legislature.

Smug Mugs In NC Senate Need A Reminder Who Put Them There

Leave it to Alex Trebek and Jeopardy to help me with a headline.

Nonetheless, the Republicans in the North Carolina State Senate need a reminder that it was gun owners and their votes that helped them get a super-majority. They currently are dragging their feet on HB 746 – the Omnibus Gun Bill – which has passed the House and which contains constitutional carry as one of its provisions. With the projected adjournment date of July 1st fast approaching, they need to act soon or all gun rights legislation will be lost for 2017.

Grass Roots North Carolina is calling upon gun owners to contact the Republican leadership, all Republican state senators, and their own state senator to urge them to get a move on regarding HB 746.

After pro-gun posturing by
Republicans in the NC Senate, it turns out they may never have had any
intention of
voting with gun owners on HB746. Senate leadership insisted, as long as
gun owners were patient, as long as we were quiet, and we minded our
“Ps&Qs,” we could count on the Senate to uphold their own Party
platform, live up to campaign rhetoric, and push Constitutional Carry to
the governor’s desk. Well, we’ve re-learned the lesson about the value
of a politician’s promises. With the projected date of
adjournment fast approaching, July 1st, Republican senators have yet to
budge on Second Amendment legislation.  If they don’t move
NOW, all gun legislation is likely dead for 2017!

Remind Senators of Approaching
Elections


Thank goodness for the ballot box. Every time
an
election is over, there is always another one just down the road. And
nowadays, voters have electronic reminders on their phones, a
twenty-four hour
news cycle, GRNC’s alerts, and GRNC’s “Remember in November” campaign to
remind them during Primary season, and again in November,
which politicians stood with them, and which did not. Nowadays, finding
new blood to send to Raleigh is almost too easy.

With that in mind, we’re
asking you to once again phone a couple of key Republican senators,
along with your own senator, and to also send an email to the entire
Republican
Senate. It appears that the entire Republican caucus may be giving you
the brush off, and one wonders if they’re having a good laugh over the
little
trick they played: “Be patient with us, and we’ll live up to our Party’s
platform and our campaign promises.”

Well, we’re not laughing, and if these senators do not immediately
redeem themselves in the eyes of gun rights supporters, we the voters
will

over your treatment of gun owners like me. We’ve done our job. We have
consistently renewed your veto-proof majority, and supported you when
you needed us, with our money and our votes. Now, as our
representatives,
it’s time to live up to your end of the bargain. Support the Party
platform you profess to believe in. Follow through on your pro-Second
Amendment campaign rhetoric.

Move HB746 to the Senate floor for a vote
now—on Thursday, June 22nd. Vote “yes,” and send it to the
Governor’s desk. Voters will not forget your actions during this
critical time.

Grass Roots North Carolina sent out an alert last night requesting that people call Speaker Tim Moore (R-Cleveland) between 9am and 11am this morning. They are also asking people to send an email to him asking them where is the progress on gun rights.

Republicans lost in the spoils of power, just laying
back and enjoying their super majority at the expense of good gun bills
being left to languish?  Why the reluctance to move on anything
pro-Second Amendment?  These are good questions to ask of House Speaker
Tim Moore.

Dear Speaker Moore:
Now
that Republicans are enjoying their super-majority spoils, it seems the
legislature has
become lackadaisical in pushing through any pro-Second Amendment
legislation.  This is deeply disappointing to me as a gun rights voter. 
We
expect our representatives to display the same character and conviction
in Raleigh that they claim to have while on the campaign trail.

As other
states
move forward on pro-gun bills such as constitutional and campus carry,
North Carolina seems to have dropped the ball on these very same
issues. 
Why is that?

The need for passing House Bills 438, 588 and 746 is
obvious, and the window of opportunity is closing! Fourteen states now
have
Constitutional Carry without any dire consequences.  New Hampshire
became “Lucky 13”, beating North Carolina to the finish
line.  Georgia Governor Nathan Deal recently signed campus carry
legislation into law, so once again, another state passes North
Carolina.

The
naysayers continue to be proven wrong in their dire predictions
regarding the results of pro-gun legislation.  As you rest on your
laurels, other
states are moving forward and advancing gun rights.  So I ask of you,
“What is happening with pro-Second Amendment legislation in our
state?”
