Is The Republican Majority In NC Using Democrat Roy Cooper For Cover On Gun Rights?

As the alert from Grass Roots North Carolina states below, the Republicans have held a veto-proof majority in both houses of the North Carolina General Assembly for the last three sessions. It seems that they are more interested in who can use a public restroom than in protecting an enumerated Constitutional right that is found in both the US and North Carolina Constitutions. It is time to say, “Get real!” and remind them that the reason many North Carolinians put them in office was to protect and enhance our fundamental right to self-protection which includes getting rid of the racially-inspired pistol purchase permit system.

expected this you would be disappointed. Republicans have gone squishy
on gun rights, and you’ll probably be perplexed by their excuse.

Anti-gun Governor is Calling the Shots for Republicans

Republicans have cited a likely “veto from Governor Cooper” as a reason to sell out gun
owners
. They think they don’t have the votes to override a veto. So, like true RINOs, the legislative actions the House majority
are willing to take are predicated on one thought: “what would Governor Cooper do?”

There is no reason that
House
leaders and committee chairs can’t see these bills to the House floor
for a recorded vote and simply let the votes fall where they may. Then
why
won’t they? It’s simple. If they were unable to pass a particular
pro-gun bill, or were unable to override Gov. Cooper’s veto, the
squishy, anti-gun RINOs who caused the failure would be exposed for what
they are—Pro-gun in Name Only. To keep these softer Republicans from
being exposed, the entire caucus is covering for them by hoisting the
white flag without a fight. This of course makes all of them complicit
in the
anti-gun charade.

A Ray of Hope

Although it is thin gruel, Rep. Chris
Millis
(R-Onslow, Pender) did indeed attach a fiscal note to pro-gun
legislation. The fiscal note means that a bill isn’t required to meet
the
fast approaching crossover deadline in order to remain viable. That
gives gun rights supporters more time to contact Republican
representatives to ask
them why Governor Cooper is running the Republican Party, and insist
Republicans get in gear and push through these important pro-Second
Amendment
bills.

have banded together to sell you out, and they’re on the cusp of

GRNC: HB 69 – Constitutional Carry – Needs Your Help

HB 69 was introduced in the North Carolina House of Representatives earlier this month. It provides for permitless concealed carry just as we have permitless or constitutional open carry in the state. It was introduced by Rep. Larry Pittman (R-Cabarrus) and has been referred to the Judiciary I Committee. That last part is not good for the bill’s chances of success and Grass Roots North Carolina has issued an alert requesting it be moved to the Judiciary II Committee where it will receive a fair hearing.

11 states now have constitutional carry and it looks like New Hampshire will be joining the list if Gov. Chris Sununu (R-NH) keeps his promise to sign the bill which has passed both houses of the legislature. That would make the three northern New England states bastions of freedom unlike the southern three.

GIVE HB 69 A FAIR HEARING!



As you know, Representative LARRY PITTMAN
(R-Cabarrus) 
introduced House Bill 69 (with GRNC’s feedback and support) to restore
our rights to constitutional (permitless) carry. The primary sponsors
of the
bill include Reps. MICHAEL
SPECIALE
(R-Beaufort, Craven, Pamlico), BEVERLY BOSWELL (R-Beaufort, Dare, Hyde, Washington),  and JAY ADAMS (R-Catawba).

Since its introduction, HP 69 currently resides in House Judiciary I which is chaired
by Representative TED DAVIS,
JR
.  We have reported his
actions in previous GRNC Alerts
and feel strongly that HB 69, if it stays in House Judiciary I under Rep. Davis, will be in danger of being
stopped.

GRNC
feels strongly that the seriousness of this bill deserves a fair hearing
and is asking everyone to contact your representatives to urge them to
move
HB 69 to House Judiciary II,
chaired by Representative JOHN M.
BLUST
.

To
recap the details of HB 69
(“Constitutional Carry Act”) and the reasons for GRNC’s support:
  • Establishes a new Article 54C, under which handguns may be carried concealed without
    permits;
  • Removes the need
    to have a concealed handgun permit to carry a concealed handgun in
    restaurants, public assemblies, parades and funerals, and (with the same
    limitations as currently in law) onto educational properties;
  • and Retains the current CHP system for purposes of reciprocity with other states.
HB
69 is designed to be a “clean”
reciprocity bill (i.e. without other measures) in order to draw fewer
objections from potential supporters. GRNC will shepherd the
introduction of
additional legislative initiatives in other bills.

It is high time North Carolina joined those enlightened states
by relieving lawful North Carolinians from expensive and burdensome
permit
requirements which discriminate against people with lesser means.
Accordingly, I ask you to give a prompt hearing to HB 69
(“Constitutional

Each time we have expanded concealed carry – whether
into parks, restaurants, educational property or elsewhere –
naysayers have predicted gloom and doom. Each time, they have been

GRNC Needs Gun Show Coordinators

Working the Grass Roots North Carolina booth at the Asheville gun shows has been my way to help educate people face-to-face, one-on-one, about gun rights and related issues for a few years now. While we only pick up a few paying members per show, we do a good job of getting the word out on current issues. John Hammond, the coordinator for Asheville, does a great job in organizing our cadre of volunteers and I’ve met some great people through his efforts.

GRNC is in need of people to coordinate the volunteers at gun shows in other cities. The alert below mentions Hickory, Concord, Winston-Salem, and Lumberton. If you are a gun rights supporter in any of these areas, this is your chance to increase your outreach.

BE A GUN SHOW COORDINATOR


Grass Roots North Carolina is in need of Gun Show Coordinators at
several locations across the state, including:

  • Concord

  • Hickory

  • Lumberton

  • Winston-Salem



Responsibilities include promoting the goals and objectives of
GRNC,
signing up and renewing memberships, soliciting contributions, and
acting as GRNC’s ambassador to the public. Coordinators are encouraged
to
manage their show independently, but will receive all necessary training
and additional support from GRNC’s leadership team, many of whom
started out as gun show coordinators themselves.

Each coordinator will be provided a kit containing the necessary display equipment and
literature, and before each show GRNC will issue alerts requesting additional volunteer support.

The position requires individuals to be self-motivated,
organized and dedicated to advancing gun rights.  There can be as many as six shows per year at some locations.

This challenging position is also very rewarding, since gun show
coordinators are an integral part of NC’s only no-compromise gun rights organization
. During the past twenty years GRNC has been responsible for following:  

  • Castle Doctrine, enabling you to better defend your
    family against violent predators;
  • Concealed carry in state and municipal parks;
  • Concealed carry in financial
    institutions;
  • Harmonizing state laws on Title II firearms, as regulated by the National Firearms Act of 1934;
    and
  • Improvements in North Carolina’s concealed handgun permit application process.
  • GRNC was a litigant in Bateman v. Perdue, in which North
    Carolina’s universal ban on guns outside the home during declared states
    of emergency
    was struck down as unconstitutional. We then ensured repealed of NCGS
    14-288.7, ensuring that citizens can protect themselves outside their
    homes
    during declared states of emergency.
  • GRNC recently engineered passage of House Bill 937, which features:Concealed carry in
    restaurants;
  • Ability of handgun permit-holders to keep firearms in closed compartments in locked motor
    vehicles on educational properties;
  • Expanded concealed carry in state and municipal parks;
  • Concealed carry in
    parades and funerals; and
  • Ability to keep firearms in closed containers in locked motor vehicles in state government
    parking lots.
  • GRNC has killed too many anti-gun bills
    to count.

GRNC Doesn’t Take A Double-Cross Lightly

When you attempt to double-cross Grass Roots North Carolina by going back on your word, they don’t take it lightly. Their response may not always win them friends but it does put politicians on notice about going back on your word.

Sheriffs in North Carolina have been dragging their feet on issuing pistol purchase permits. What used to be an immediate issuance has now started to drag into weeks and months because of a new requirement for a mental health check. I spoke to a client recently in Henderson County who waited over four months for his pistol purchase permit.

What GRNC sought was a sun-setting of the paper medical-release provisions once the records had been digitized. Sen. Shirley Randleman (R-Stokes, Surry, Wilkes) had inserted these provisions into a bill that was due for a floor vote. Now she has taken what she wanted in that bill and transferred it into another bill due for a floor vote and left the sunset provision to die on the vine.

SENATOR SELLS OUT ON PISTOL PERMIT

MEDICAL-REPORTING FIX


Last week’s gun-rights hero is this week’s gun-rights turncoat . .

It was not even a week ago that
GRNC issued an update praising NC Senator Shirley
Randleman
(R-30, Stokes, Surry, Wilkes) for courageously standing up for gun owners alongside another courageous legislator, NC Rep. Michael Speciale (R-3, Beaufort, Craven, Pamlico).

Unfortunately, it appears that the victory Sen. Randleman helped hand to
gun owners last week was only a feint, and she apparently never
intended to
follow through on her pro-gun stance during this legislative session. In
short:

SENATOR SHIRLEY RANDLEMAN IS A
SELLOUT!

Last week, Sen. Randleman was a key figure in
helping GRNC fix the NRA’s previous blunder, a major blunder that was
giving sheriff departments cover to flout state law and force citizens
to wait inordinately extensive (and illegal) lengths of time to receive
pistol
purchase permits (PPP). Randleman helped to insert the administrative
fix to this problem into S89,
a bill that, at the time, was sure to receive a
hearing and a floor vote. This is all gun owners wanted from this bill,
and it’s such a small thing really—simply sun-setting the outdated
paper medical-release system once records-digitization is completed.

Unfortunately, even this small thing, this minor administrative fix that
will go a
long way in easing pressure on sheriff departments, and make life easier
for gun owners like you, was just too much for Sen. Randleman to
continue to
support. You see, this week, Randleman moved her favorite projects from
S89 to another bill, another bill that will surely receive a hearing and
a
vote. However, the medical-reporting fix must not have been one of her
favorites after all, because she left it where it was, and now it is
believed
that S89 is going to be left to languish and die without a vote. With
all of this in mind, there really isn’t any other way to say it: 
Sen. Randleman sold out gun owners—big time!

Randleman received her positive, “pro-gun” press last week, and
must have figured that was all she needed to gain some gun-rights cred.
However, she didn’t count on the fact that GRNC is still paying
attention. We are paying attention, and we are here to tell gun owners that Sen. Shirley Randleman pulled the ol’ slimy
politician’s feint against you when she thought you weren’t looking!
She may have been quietly laughing at you when she
pulled this little stunt, but she likely won’t be laughing once she learns that she has been caught.

Why Did Leadership Allow This
Trickery?


This cannot stand! We must demand that Shirley
Randleman
return the Medical Form Sunset provision to whichever bill is sure to
receive a hearing and a floor vote, and we want an explanation. Also, we
need to
know why GA leadership, Speaker Tim Moore and
Senate Leader Phil Berger, allowed this trickery
to occur in the first place.

Randleman, and also the House and Senate leaders. They must answer for
this!

Untrustworthy politicians like Shirley Randleman must be

Senate Bill 89. This language would sunset the antiquated paper medical
reporting requirement for pistol purchase permits, once the records are
digitized. An obvious update for the twenty-first century. A small
change perhaps, but this small change would make a huge difference.

As you know,
various sheriff departments around the state have been using this
antiquated reporting requirement as an excuse to delay pistol purchase
permits for
extended, and unlawful lengths of time. I was sure you were going to
help the voters end all of that, but I was clearly wrong. It appears you
have
sold out gun owners, and I am incensed.  Please understand that the
little trick you just pulled did not go unnoticed. I am fully aware that
you
moved all of your favorite projects to another bill, but have left the
medical-reporting fix in S89, where it will now surely languish and die.

I
am
demanding that you explain your about-face on this legislation, and I’m
insisting that you find a way to return the medical-reporting fix to a
bill that will receive a hearing and a vote.

GRNC On Anti-Gun Bills Looming

Grass Roots North Carolina sent out this alert yesterday. It is asking that people contact their Federal representatives to oppose any of these measures.

I agree with GRNC that it is disappointing that NC Attorney General and gubernatorial candidate Roy Cooper (D-NC) is calling for the no-fly list gun ban. You would think that after 16 years as the state’s attorney general he would have at least a little appreciation for due process. However, he must feel that it is politically expedient to ignore constitutional rights.

Roy Cooper Joins the Gun Control Frenzy

The problem is that you can be put on the Watch List without ever knowing it and once you’re on there you’ll find it almost impossible to get off the list.Mitch McConnell is opening the door to this as well. He’s announced that the GOP is “open to keeping guns from terrorists” but we have to be careful that sloppy legislation rushed through to appease the anti gun nuts doesn’t restrict the rights of law abiding gun owners. Appeasing noisy protesting anti gun nuts will do nothing to make us safer.

Anti-Gun County Commissioners In Haywood County?

I lived in Haywood County, North Carolina for 32 years and still have property there. Thus, when I got the alert below from Grass Roots North Carolina about the intended anti-gun actions of the Haywood County Board of Commissioners I began to get angry.

Then I read the three proposed ordinances and became really angry. There are parts of the first two ordinances that are direct violation of state law regarding carry in state, county, and municipal parks and that is just the beginning.

 Moreover, the outdoor range ordinance requires more of private ranges than it does of the county’s own sheriff’s department. The proposed ordinance §161.07(B)(1) states, “All shooting stations and targets on a range shall be located a minimum of three hundred feet (300’) from any property line.” The backstop of the range that they share with the Maggie Valley Police Department is a mere 90 feet from the nearest property line. §161.07(D) of the ordinance requires that ” All shooting stations, targets, and firing lines” be more than 1/4 mile or 1,320 feet from any occupied building. There are two retail stores at about 1,100 feet from the backstop and a handful of residences that are within the 1/4 mile radius of the target range. You can see this in the screen cap from the Haywood County GIS map. The HCSD/MVPD range is adjacent to the Town of Maggie Valley water and sewer plant. I have labeled the firing line, backstop, and distances to the property line and buildings.

If you are a Haywood County resident, taxpayer, or just someone who visits the county, I would urge you to either attend the meeting on Monday or email the commissioners. I most certainly intend to do so.

You may be unaware of the new trend
that is currently sweeping our state. In recent months, county after
county,
after recognizing the fallacy of “gun free” zones, has moved in the
direction of more gun-freedom rather than less: Pitt, Person, Wilkes,
Rockingham, Cherokee, and Alamance counties—just to name a few. There
are more, and the list continues to lengthen. This is a positive trend,
and I
would strongly recommend that Haywood County consider this course,
rather than a sure-to-be fruitless and disrespectful gun ban.

Keep
Haywood County free and safe for law-abiding voters and
their families. Vote ‘no’ on any sort of gun ban. I will continue to

UPDATE: I received an email last night from Commissioner Kevin Ensley (R-Haywood) who said he would be voting in favor of concealed carry on county premises. Kudos to Mr. Ensley to listening to the people of Haywood County. I fear that some of the other commissioners are not so willing to listen to their constituents. 


Jerrika Insco of WLOS has a report on the Monday evening meeting here. I sense a lot of backpedaling on the part of the Haywood County Manager Ira Dove. He is trying to portray the moves by the county as being misunderstood by residents. He’s trying to say it has always been banned and all the county is doing is updating their ordinances to comply with state law. That is only partially true. Including the county-owned Allen’s Creek Park in the list of places that ALL carry is prohibited flies in the face of NCGS Sec. 14-415.23 which specifies where and where not carry can be prohibited in county, municipal, and state parks.

HB 562 Comes Before The Entire NC Senate Tomorrow

HB 562, the Second Amendment Affirmation Act, comes before the North Carolina Senate tomorrow. The House version was approved without amendments by the Senate Judiciary II Committee on Thursday of this past week. The bill, even though weakened with amendments in the House, does give North Carolina gun owners some important wins. The alert below from GRNC spells out the good stuff and ask that gun owners contact the Republican members of the Senate to urge them to vote for the bill without any weakening amendments.

Last week, thanks in large part to the
insistence of GRNC supporters like you, HB562 moved smoothly through the Senate Judiciary
II Committee.
GRNC would like to thank Senate President Pro Tempore Phil Berger (R-Guilford, Rockingham) and Senator Tom Apodaca (R-Buncombe, Henderson,
Transylvania) for making sure this bill had a proper hearing.
Fortunately, the committee did not weaken the bill, which still contains
some great gun-rights advancements, such as: 
  • Expanded
    campus carry (and giving an affirmative defense for defensive gun use on campus);

  • Reduced penalties for carriage onto posted premises;

  • Expanded sport shooting range protection;

  • Reductions in arbitrary permit denials for both concealed handgun permits and pistol purchase
    permits while reducing the number of disqualifying prior offenses for those permits;

  • A new cause of action against local governments which violate our statewide firearms preemption
    law;
  • A requirement for sheriffs to sign Form 4s for
    qualified Title II applicants;
  • A provision for legal
    resident aliens to get concealed handgun permits; and
  • Short-barreled rifle hunting in addition to the suppressor hunting we passed in 2013. 
Now,
it’s time for HB562 to be considered by the
full Senate. To insure its passage, the Republican members of the
NC Senate need to be reminded that you expect them to support this bill,
and to
pass it without weakening amendments.

A Neutered HB 562 Passes The NC House

After considering 10 amendments and voting on seven of them, the NC House passed HB 562 by a 78 yea to 37 nay vote in its 3rd Reading. The pistol purchase permits system repeal was deleted in its entirety. As things were left yesterday, the pistol purchase permits would have only been required for private sales as an exemption was made for sales through FFLs. Today’s Amendment 10 by Rep. David Lewis (R-Harnett) stripped that provision out of the bill.

There are some good things left in the bill. The process for obtaining a pistol permit has been standardized, newer shooting ranges will be protected, state preemption is reiterated, and chief law enforcement officers have to sign off on NFA items if the applicant is not precluded by state or Federal law. Oh, and you can also carry an ordinary pocketknife in the State Capitol and on its grounds.

As you can probably imagine, the Everytown Moms for Illegal Mayors and their backers in the legislative gallery who wore their Felon-Orange shirts are crowing about the defeat of the pistol purchase permit repeal. In fact, they are proclaiming victory saying that “the Moms fought the law and the Moms won.”

“It was really great that most of the amendments were brought forth by Republicans. This is not a partisan issue: we are talking about common sense safety laws. We’re building strong, bipartisan opposition to the gun lobby,” said Sarah Green, state chapter leader of Moms Demand Action.

Sarah Green is correct that the amendments that neutered the bill were brought by the Republicans. The GOP is not called the stupid party for nothing. If the Republicans who knelt in obeisance before the state’s sheriffs think that avoiding the issue will gain them political points, they are even stupider than I thought. Those in the galleries wearing their Felon-Orange shirts will never support them and those of us in the gun rights community will never forget.

Paul Valone, president of Grass Roots North Carolina, certainly doesn’t intend to forget those Republicans who paid lip service to gun rights in 2014 and then deserted us in 2015. In an email to me, with which I have permission to quote, he said:

“Grass Roots North Carolina would like to thank North Carolina House Republicans for giving us exactly what we asked for: Recorded votes. Lots of recorded votes that tell us exactly who our friends are and are not, and which activate our core supporters going into the 2016 primary elections. Inevitably, the party in power becomes comfortable and unmotivated, in time forgetting who ‘brung ’em to the dance.’ When they achieve supermajorities and draw themselves comfy districts, that time apparently shrinks to four short years. But in their safe Republican seats, they forget something: Other Republicans can occupy those seats. In 2016, we will use those recorded votes to provide them a few little reminders of that fact.”

 Paul is correct. We know who our real friends are when it counts. We also know who is just a fair weather friend making nice noises about the Second Amendment but deserts us when push comes to shove.
